Lucknow, India: To Aishwarya, eight years old, RTI is an Act that can
work wonders. Especially since it helped her to bring to the notice of
civic authorities, the presence of a garbage disposal site in front of
her school.

shared more than happily. Aishwarya is a student of Class III of a
school in Rajajipuram in Lucknow.

The sight of a dumping ground right across the main gate of her school
was distressing for her each time she passed by.So much so that she
wrote to the chief minister's office requesting her to get the site
removed from the place.

There was a swine flu scare then and our school had asked us to wear
masks, she said. But seeing stray dogs and pigs loitering in the dump
scared me, she said. The girl raised the issue with her parents on a
lot of occasions. But even they could not provide any satisfactory
explanation for the existence of a garbage disposal site close to her
school.

It was then that she wrote to the CM. In my letter, I only requested
her to interfere, said Aishwarya. But her letter did not fetch any
response and we made her file the RTI, said her mother, Urvashi
Sharma.

Aishwarya wrote a three-point application to the public information
officer (PIO) of the chief minister's office seeking an answer to why
the garbage is being dumped in front of her school.

Her handwritten application had questioned the government on who would
own the responsibility if any one of us gets an infection from the
discarded waste.

It is here that the RTIs response giving machinery let down the girl.
Though authorities have shared the information on the site, she is
still to get the answers to her questions.

Six months after she sent the application to the CMs office, it has
been forwarded to the Lucknow Municipal Corporation (LMC) for doing
the needful.And, LMC has informed the girl that a modern garbage
disposal site was built at the place by Awas Vikas Parishad.
Authorities have already taken note of the fact that the site is now
close to a school and hence, dumping of garbage on the site has been
stopped.

However, it is the construction at the place which is blocking the
trucks of rubbish removal department to reach the spot and remove the
garbage, said the LMC. Thus, in effect, the problem persists with the
garbage still on the site and consequently, the threat to the health
of school kids is also very much there.

In fact, the parents of the girl still await action on these two
counts viz removal of garbage and answer to their daughters query.

However, the only credit, if any, that goes to RTI is keeping the
faith of a kid in its efficiency. As a beaming Aishwarya said, I am
happy that the right to information has helped me. After her first
brush with the Act, she is already defining it as something that can
make the wrong thing right.

need suggestions - Draft RTI users {Pevention of Atrocities, Violence and Protection against victimization ) Act

u all must agree that there is strong need of a central act which may
be named something like " RTI users {Pevention of Atrocities, Violence
and Protection against victimization ) Act 201__. or any other name
that we shall finalize in due course of time.

I have already started work on draft of such an act . very soon i
shall send this
draft to all rti family members for modifications. meanwhile i
request you all to send me your suggestions , views , points that must
be incorporated in this act .

After finalizing it we shall submit it to the Parliament and put our
best unified efforts forward so that this bill should make a smooth journey .

Jails in various districts of the state are plagued with the problem
of overcrowding with a total prison population of 83,805 against the
authorised capacity of 44,439, an RTI plea has revealed.


Urvashi Sharma, an activist, filed the RTI plea following the National
Human Rights Commission's recent report observing that overcrowding in
jail was a result of "unnecessary and unjustified arrests" coupled
with slow judicial process.


Admitting that the overall overcrowding ratio is 1.89, the information
released by the department of Jail Administration and Reform Services
indicates that in majority of the jails the occupancy is almost double
the sanctioned strength.


According to the status as on December 31, 2009, the worst scenario is
at the Moradabad district jail where around 2,274 prisoners are housed
against the sanctioned strength of only 605. At the time when the
records were released, Moradabad jail housed around 2,080 undertrials
and 194 convicts.

Similar was the plight at Shahjahanpur district jail where 1,791
prisoners were kept against a capacity of 511.


Of the 53 district jails in the state, majority had double the
sanctioned inmates. But the only exception was Mau district jail where
only 485 criminals have been housed as against the capacity of 540.


Interestingly, the Etah district jail, which received the coveted ISO:
9001 (2000) certification last year, has around 1,339 inmates as
against the capacity of 607 prisoners.


In the central jails, which are supposed to admit lifers and prisoners
who are serving long sentences, the occupancy ratio was no better. In
the five central jails of the state as many as 13,298 criminals were
lodged against the capacity of 7,037. While Naini, Varanasi, Fatehgarh
and Agra Central jail records showed almost double the occupancy,
Bareily Central Jail had more than two criminals lodged against one.


The picture at special jails is far better than that of Central or
district jails. In Model Jail, only 371 prisoners were housed against
a capacity of 600 while in Nari Bandi Niketan, 143 women convicts were
lodged as against the sanctioned strength of 420. Overall, 2,759 women
were shown to be lodged in different jails.


At Kishore Sadan, Bareily, the only jail in Uttar Pradesh for children
with a capacity of 188, only six children were housed as on December
31, 2009.


In the other jails, however, 96 children were shown to be living with
women who were convicted. Also, as many as 182 foreigners were also
shown to be lodged in different jails of the state.


The reply under the RTI failed to answer another important question
raised in the plea concerning the details of convicts serving jail
terms despite completing their sentences decreed by court.


In a reply filed by K B Joshi, Research Officer, department of Jail
Administration and Reform Services, the department asked for more time
on the pretext of collecting the relevant data.


"I have filed the first appeal requesting to provide the data as early
as possible," said Urvashi Sharma.

There are many negative news in the rti arena from across the country
that may dishearten rti-users but as an eternal truth , the life
begins from where it ended. At least the effort of 8 years' girl
student of city Montessori school of Lucknow proves this.

Aishwarya is a student of Rajajipuram branch of this school . There is
a garbage house by the opposite side of the main gate of the school .

Months back , when swine flu panic gripped the country , the
schoolchildren of her school were asked to wear masks in the school.
Aishwarya also used the mask but a question was always there in her
mind as to why the Garbage- house was there at a distance of few yards
from the school when there was so much panic in the country. The
frequent movements of stray dogs , pigs and other animals into and out
of the garbage house was posing serious health threats to the students
. Moved by this , on 26 – 10 – 2009 she wrote a letter to the Chief
Minister of Uttar Pradesh . In this letter she requested the C.M. to
get the garbage house removed from the vicinity of the school n shift

Aishwarya waited each day in the hope that the garbage-house would be
removed but nothing happened. As an eternal course of action of most
of the Government offices of U. P. , the speed post letter of
Aishwarya got lost in the wilderness of the other world of the
babudom of the Chief Minister Office.On 30-11-2009 , she filed an RTI

The Reply sent by PIO of the Chief Minister puts a question mark on
the system that is governing us today . The PIO refused receipt of the
letter dated 26-10-2009 and transferred the RTI letter dated
30-11-2009 to the Commissioner of Lucknow Municipal Corporation . this

Had the RTI Act 2005 not been there , Aishwarya might have never been
able to know the fate of her letter.

The RTI reply by the Zonal health officer is not related to the point
2 and 3 of rti query of Aishwarya and shows his irresponsible

Though not fully satisfied , Aishwarya is sure not only to get the
information but to find her lost letter also. She has filed appeal to
the appellate authority , filed the rti to the PIO of the Chief
Minister to tell her the name of the person responsible for this
mishap and has written to the chief minister Km. Mayawati to initiate
enquiry to fix the responsibility of her lost letter.

As RTI Act is there to provide for setting out the practical regime of
right to information for citizens to secure access to information
under the control of public authorities, in order to promote
transparency and accountability in the working of every public
authority , So is Aishwarya to play her role of securing access to
information under the control of some public authorities, in order to
promote transparency and accountability in the working of them , but
these public authorities are not ready to play their role.

May more n more aishwaryas come forward to raise local issues and
fight them till they succeed to have true democracy in INDIA.

As democracy requires an informed citizenry so I think it would be
more appropriate to make RTI act a compulsory part of course
curriculum at primary level because this is the best solution to have
more n more Aishwaryas in the system and more n more corrupts out of
the system.

When a 8 year old Student of Class III can pursue for it , why can't you ?

workshop and awareness programme on ‘Right to information and disabled people’

Handicare, an association of the handicapped, organised a workshop and
an awareness programme on 'Right to information and disabled people'
here on Wednesday. RTI activist Sandeep Pandey and his team comprising
Ashish Srivastava, Urvashi Sharma, Chunni Lal and Azizul Hasan told
the physically challenged people as to how to use the right to
information, an important tool for their empowerment.

Sir ,

R.T.I. Act is a strong tool in the hands of a common . Through
effective use of this tool , true democratic values as enshrined in
our constitution can be ushered in all acts of the government . Since
its inception , R.T.I. act has experienced mixed treatments at the
hands of the info-seekers , the info-imparters and the watchdogs of
the act. There have been all types of statements and counter
statements .

To strengthen R.T.I. and for its effective implementation in U. P. ,
we need pure and selfless participation from all three major players
i.e. the info-seekers , the info-imparters and the watchdogs of the
act

To meet this objective in harmonious way and to work as an interface ,
N.A.P.M. , ASHA PARIVAAR & SUCHNA KA ADHIKAAR ABHIYAAN along with
many other likeminded Social Groups wish to organize a two week
R.T.I. – CAMP in U.P.S.I.C. premises from 10th May 2010 with a view to
interact with the info-seekers , the info-imparters and the
Info-Commissioners to get feedback from the all and draw conclusions
and send recommendations to the appropriate authorities for
implementation to ensure effective implementation of the act .

Please permit us to organize a two week R.T.I. – CAMP in U.P.S.I.C.
premises from 10th May 2010 .

Uttar Pradesh governor has asked the administrative reforms department
(ADR) to take action against the state's chief information
commissioner Ranjit Singh Pankaj.
The governor's instruction, in a letter dated March 9, came after
activists approached the governor asking for the removal of the
information commissioner.
In November last year, the Allahabad High Court slapped a fine of Rs
50,000 on Pankaj for extending favours to lessee involved in illegal
mining during his tenure as mining secretary in the state.
He had joined the state information commission in June.
After the court order, activists in Uttar Pradesh started making
demands for his removal.
They submitted a memorandum to Governor B.L. Joshi demanding the
suspension of Pankaj from the commission under section 17 (3) (b) of
the Right to Information Act 2005.
Under the section, the governor can suspend the information
commissioner if he has been convicted of an offence, which, in the
opinion of the governor, involves moral turpitude.

R.T.I. Act is a strong tool in the hands of a common man . Through

Since its inception , R.T.I. act has experienced mixed treatments at
the hands of the info-seekers , the info-imparters and the watchdogs
of the act. There have been all types of statements and counter
statements from all the three players of the RTI arena.

To strengthen R.T.I. and for its effective implementation , we need
pure and selfless participation from all the three players i.e. the
info-seekers , the info-imparters and the watchdogs of the act .

My short experience says that to meet this objective the RTI activists have to
- work as an interface between n among the info-seekers the
info-imparters and the Info-Commissioners ,
- ensure exhaustive interaction with the info-seekers , the
info-imparters and the Info-Commissioners to get feedback from them ,
- cross transfer these feedbacks ,
- draw conclusions and
- send recommendations to the appropriate authorities for
implementation to ensure effectiveness of the act in letter n spirit.

We wish to meet this objective in Uttar Pradesh , a state which is
generally believed to be and to a larger extent it really is
"infertile for the RTI crop" . When we talk of RTI in Uttar Pradesh we
have the only SCIC suspended in the country , we have the
unbelievable state of no representation of U. P. in PCRF survey , we
have the name of Mr. Ram Kumar as SCIC which was rejected by then HE
governor , we have acting SCIC with more black track record than Mr.
Ram Kumar , we have many rti users being victimized at all the stages
and many more things which we all know . This is really really a very
sorry state of affairs and it hurts a lot to any responsible citizen
who thinks of RTI in Uttar Pradesh .

To make U.P. Land fertile for the RTI crop and to make it bloom with
the fruits of info-plants i.e. " THE INFORMATION TO THE INFO SEEKER IN
TRUE PERSPECTIVE " , we wish to organize a camp at UPSIC premises
itself . This is the place where we can have optimum feedback and
interactions with all the players of RTI as discussed above. A letter
to this effect has already been sent to the concerned authorities.

As always , before going any further , I wish to have feedback from
all my respected seniors and fellow friends so as to make the camp
more effective.

Your suggestions shall go a long way off to strengthen RTI in Uttar Pradesh.

Lucknow: There might be some action coming against the Uttar Pradesh
chief i n fo r m at i o n commissioner (CIC) Ranjit Singh Pankaj. At
least that is the hope running high among the RTI activists who had
been fighting tooth and nail to get the CIC removed.
The activists are spirited up over a letter sent to them from the
governor's office informing that the administrative reforms department
(ARD) has been directed to take immediate and necessary action against
the CIC. The ARD is the nodal department for the implementation of the
Right to Information (RTI) Act in the state.
The letter dated March 9 and under signed by special secretary to
the governor, M Devraj, is something that activists are now holding
their hopes on to. "If there comes an action nothing like that", said
activist Urvashi Sharma.
The activists went up in arms against Pankaj after the Allahabad
High Court slapped a fine of Rs 50,000 on him for "misleading the
court and extending favours to a lessee involved in illegal mining"
during his previous tenure as the mining secretary in the state
government. The order of the court was delivered on November 13.
After this the activist organisations sent a memorandum to the UP
Governor BL Joshi demanding the suspension of Pankaj from the post of
UPCIC. It was in June last year that he was appointed as the same.
The organisations and individuals had demanded action against him
under section section 17 of the Right to Information (RTI) Act and his
suspension "with immediate effect". The memorandum submitted by
various activists to the governor invariably mentioned that it is not
acceptable that CIC is conducting hearings into the State Information
Commission (SIC) even after being fined by the court.

This refers to my RTI query dated 04-10-2009 and subsequent part-reply
from the head office of jail administration & improvement services
Llucknow Uttar Pradesh , sent to me vide letter no.

districts of Uttar Pradesh as on 31-12-2009 . Scanned copies of the

Apart from many other aspects , the Report shows the poor plight of
jailed humans in the jails of Uttar Pradesh. The mean overcrowding
index of 53 districts is 1.89.A look at the overcrowding index makes
it clear that U.P. jails have high overcrowding index to the tune of
3.76 as in Moradabad Jail. This means that on an average 3.76 humans
are being kept in U. P. Jails having facility of only 1 human. The
position of these jails is grossly violative of human-rights and is
highly undesirable . The problem needs to be addressed at your level
on top priority basis.
Please intervene and take necessary actions to ensure that the problem
be solved to give a humane atmosphere to jailed humans in Uttar
Pradesh.

please find attached the reply as received from u. p. governor's
secretariate in reply to my mail forwarded herewith.

its surprising that when i am asking for time to meet h.e. governor ,
i am being told that the matter has been referred to the
administrative reforms department .

the file that is moving at snail's speed is being told to be moving
quickly. perhaps this is the folly of the system that the top-notch
ias officials don't shy at all when they become blindfolded to shield
the corrupts like r. s. pankaj.

Hon'ble Sir ,

Please refer my e-mails dated 18-11-09 & 23-11-09 , my meeting dated
27-11-09 with your Principal Secretary Mr. J. B. Patnayak , with
whom I submitted a memorandum addressed to you for removal of Uttar
Pradesh state chief information commissioner Mr. Ranjit Singh Pankaj
under section 17 ( 3 ) ( b ) of RTI act 2005. Mr. Patnayak received
the said memorandum on your behalf , discussed the matter at length
and assured action within 15 days.

Also refer to my RTI query dated 20-11-09 , sent to the PIO of your
secretariat . The PIO Mr. R. K. Saxena transferred the RTI query u/s
6(3) of RTI act to the Principal Secretary of administrative reforms
department ( the nodal department of U. P. Government for RTI matters
) . Administrative reforms department informed me vide letter no.
suu.aaa.raa.paa.253/43-2-2009 dated 16-12-09 that the matter of Mr.
Pankaj had not been referred to them by 16-12-09.

Its very painful that despite assurance from the highest official of
your secretariat , no action has been taken by your esteemed office in
which millions of people of Uttar Pradesh bestow their faith and look
forward to get justice .

Most of the information commissioners are working arbitrarily , thus
killing the spirit of the RTI act. The State Information Commission
has turned into a shelter-home for the corrupts . The SIC has grossly
failed to comply to the provisions of the RTI act. This way the SIC is
breeding corruption though it was conceptualized to eradicate it as
given in preamble of the RTI act 2005.

Under these circumstances I am compelled to write to you and wish to
avail a personal appointment with Yourself to handover a memorandum
for removal of state chief information commissioner under section 17 (
3 ) ( b ) of RTI act 2005 and discuss many other matters related to
poor plight of RTI act 2005 in Uttar Pradesh at length with your good
self so that the info-seekers of Uttar Pradesh should get justice .

please fix a date and time as per your own convenience and inform me
accordingly in the larger interest of the people of uttar pradesh.
