SP leaders spar over Modi's dig at party

Samajwadi party general secretary Naresh Agarwal's remarks over the
BJP prime ministerial candidate Narendra Modi's speech at Jhansi rally
recently, threatened to boil into a major controversy within the party
after it turned into an ugly spat between Agarwal and another senior
party leader.

On Sunday, Agarwal sought to challenge SP spokesperson Rajendra
Chaudhary's authority, who had criticised him for the remarks.

"Rajendra Chaudhary ki kya haisiyat hai mere upar bolne ki...jo bhi
bolna hoga woh netaji bolenge" (Rajendra Chaudhary is no one to
comment on me. Only Mulayam Singh Yadav can tell me what to say and
what not), Agarwal said.

On Saturday, Chaudhary had said that Agarwal was not the official
spokesman of the party and that whatever he had said was his personal
opinion and not the views of SP.

"We have made it very clear that we will not tolerate indiscipline
under any circumstances," he had said.

Agarwal's remarks had also irked the women activists, who had sharply
criticised the remarks and sought action against Agarwal.

In a letter to the UP State Commission for Women, Zareena, social
activist Urvashi Sharma asked her to take cognisance of sarcasm and
use of 'derogatory' words showing utter disrespect towards the widow
community by Agarwal and 'get him punished according to law of the
land'.

Agarwal had reportedly said, while commenting on Modi's remarks that
SP is a parivaarvadi (family) party, that Modi could not be expected
to know about the family as in 'BJP, marriage is not a tradition'.

"There is a saying in the villages, if one goes to seek blessings of a
widow, she wishes that he also becomes like her," Agarwal had
reportedly said.

"Modi should speak on important issues like Indo-Pak relations,
inflation and other similar issues. But Modi does not do so as he does
not have any knowledge about them," Agarwal had said.

लखनऊ: सैनिकों की शहादत पर विवादित बयान देने वाले आईएएस अफसर राजीव
रौतेला के खिलाफ सामाजिक कार्यकर्ता उर्वशी शर्मा की शिकायत पर
जांच-पड़ताल शुरू कर दी गई है। अलीगढ़ के डीएम राजीव रौतेला ने कहा था कि
हमारा देश बात-बात पर रोने वाला देश है।

रौतेला ने भारत की तुलना में अमेरिकी सैनिकों की तारीफ भी की थी।
उन्होंने कहा था, 'सिपाही का काम देश की रक्षा करना है। सेना में उसकी
केवल 12 साल की सेवा होती है। उसके बाद वह पेंशन लेता है और अगर वह सेवा
करते हुए अपने प्राण न्योछावर कर देता है तो गांव और परिवार कहता है कि
जब तक नेता नहीं आएंगे, जब तक 50 लाख रुपये नहीं मिलेंगे, पेट्रोल पंप
नहीं मिलेगा, सड़क नहीं बनेगी, तब तक शव नहीं उठेगा।'

सामाजिक कार्यकर्ता उर्वशी शर्मा ने सार्वजनिक रूप से दिए बयान को देश के
लिए अपमानकारी, देशद्रोह वाला, मानवाधिकारों का उल्लंघन और देश के शहीद
सैनिकों का अपमान बताया था। उन्होंने कहा कि राजीव रौतेला ने अपने बयान
में सैनिकों की सेवा 12 साल होने, सैनिकों को पेंशन देने, शहीद सैनिकों
को मुआवजा देने आदि की सरकारी नीतियों की सार्वजनिक रूप से भर्त्सना की
है, जो सेवा नियमों के तहत दंडनीय अपराध है। इन बिन्दुओं के आधार पर
उर्वशी ने प्रदेश और केंद्र सरकार से राजीव रौतेला को तत्काल निलंबित
करने और जांच कराकर नियमानुसार दण्डित करने की कार्रवाई करने का अनुरोध
किया था।

उर्वशी की इस शिकायत पर अब उत्तर प्रदेश शासन स्तर से जांच प्रक्रिया
शुरू हो गई है। नियुक्ति विभाग के उपसचिव अनिल कुमार सिंह ने शिकायत पर
आगे की कार्रवाई के लिए उर्वशी से सभी सबूत नियुक्ति विभाग को मुहैया
कराने का अनुरोध किया। उर्वशी ने बताया कि वह जल्द ही रौतेला के भाषण के
अंश की वीडियो सीडी साक्ष्य के रूप में जांच की कार्रवाई में शामिल करने
के लिए नियुक्ति विभाग को मुहैया कराएंगी।

खिलाफ शासन ने जांच की कार्यवाही शुरू कर दी है|

विगत सितम्बर माह में अलीगढ़ के डीएम राजीव रौतेला जिन्होंने शहीदों को
लेकर निहायत शर्मनाक बयान दिए थे| राजीव रौतेला ने सभी हदें पार करते हुए
भारत देश को भी कोसते हुए कहा था कि हमारा देश बात-बात पर रोने वाला देश
है और भारत के सापेक्ष अमेरिकी सैनिकों की तारीफ करते हुए कहा था
"सिपाही का काम देश की रक्षा करना

है| सेना में उसकी केवल बारह साल की सर्विस होती है| उसके बाद वो पेंशन
लेता है और अगर वो सेवा करते हुए अपने प्राणों को त्याग देता है तो गांव,
परिवार कहता है कि जब तक नेता नहीं आएंगे, जब तक पचास लाख रुपये नहीं
मिलेंगे, पट्रोल पंप नहीं देंगे, सड़क नहीं बनवाएंगे तब तक लाश नहीं
उठेगी|"

रौतेला के खिलाफ यह जांच कि कारवाई सचिव - येश्वर्याज सेवा संस्थान व
सामाजिक कार्यकत्री एवं आरoटीoआईo एक्टिविस्ट उर्वशी शर्मा की शिकायत पर
शुरू हुई|

उर्वशी ने बताया कि राजीव रौतेला का सार्वजनिक रूप से दिया गया यह
वक्तव्य देश का अपमानकारी होने के कारण स्पस्ट रूप से देशद्रोह था|
जिलाधिकारी का वक्तव्य देश के शहीद सैनिकों का अपमान है एवं मानवाधिकार
उल्लंघन का

जीवंत उदहारण था| श्री राजीव रौतेला ने अपने वक्तव्य में सैनिकों की सेवा
बारह वर्ष होने,सैनिकों को पेंशन देने, शहीद सैनिकों को मुआवजा देने आदि
की सरकारी नीतियों की सार्वजनिक रूप से भर्त्सना की है जो सेवा नियमों के
अंतर्गत दंडनीय आपराधिक कृत्य था |

उर्वशी ने बताया कि इसलिए मैंने प्रदेश सरकार और भारत सरकार से अलीगढ़ के
जिलाधिकारी राजीव रौतेला द्वारा देश और शहीदों के सम्बन्ध में की गयी गयी
शर्मनाक टिप्पणियों से देशद्रोह होने ,मानवाधिकार उल्लंघन होने एवं सेवा
नियमों का उल्लंधन होने के प्रकरण में राजीव रौतेला को तत्काल निलंबित
करने और जांच कराकर नियमानुसार दण्डित करने की नियमपूर्ण कार्यवाही करने
का अनुरोध किया था |

उर्वशी ने कहा कि वह शीघ्र ही रौतेला के शर्मनाक भाषण के सम्बंधित अंश के
विडियो की सीडी को राजीव रौतेला के खिलाफ साक्ष्य के रूप में जांच की
कार्यवाही में शामिल करने हेतु शिकायती शपथ पत्र नियुक्ति विभाग को
उपलब्ध कराएंगी|

Meanwhile in another controversy which arises out of statement made by Samajwadi Party MP, Naresh Agarwal, another social activist Urvashi Sharma dispatched a complaint in this regard to Zareena urf Fatma Usmani, who is Chairperson of U.P. State Commission for Women. She demanded to take cognizance of sarcasm and use of derogatory words showing utter disrespect towards widow community by Naresh Agarwal and to get him punished according to law of the land.

there is a saying that if you ask a widow for blessings, she will ask

that India has been known for history of social reformers like Sri
Raja Ram Mohan Rai who worked for widows' welfare so that they are
socially acceptable like a normal woman. Even today governments run
various welfare schemes for widows. Even then, the attitude of a
minister of such stature using such mean and derogatory words towards
widows , thereby showing them in a most unacceptable way is not only
highly unwarranted under law but anti-social also.

Urvashi requested the commission to take punitive action against
Naresh Agarwal (for his anti social acts) as per the rules and the law
of the land. It may be mentioned that National Commission for Women
had also taken cognizance of Naresh Agarwal's statement and claimed
that the Commission will took up the issue with the concerned SP
leader.

लखनऊ। सैनिकों की शहादत पर विवादित बयान देने वाले भारतीय प्रशासनिक सेवा
(आईएएस) के अधिकारी राजीव रौतेला के खिलाफ सामाजिक कार्यकर्ता उर्वशी
शर्मा की शिकायत पर जांच की कार्रवाई शुरू कर दी गई है।

अलीगढ़ के डीएम राजीव रौतेला ने कहा था कि हमारा देश बात-बात पर रोने
वाला देश है। उन्होंने भारत के सापेक्ष अमेरिकी सैनिकों की तारीफ भी की
थी। उन्होंने कहा था, "सिपाही का काम देश की रक्षा करना है। सेना में
उसकी केवल 12 साल की सेवा होती है। उसके बाद वह पेंशन लेता है और अगर वह
सेवा करते हुए अपने प्राण न्यौछावर कर देता है तो गांव, परिवार कहता है
कि जब तक नेता नहीं आएंगे, जब तक पचास लाख रुपये नहीं मिलेंगे, पेट्रोल
पंप नहीं देंगे, सड़क नहीं बनवाएंगे तब तक शव नहीं उठेगा।"

सामाजिक कार्यकर्ता उर्वशी शर्मा ने सार्वजनिक रूप से दिए गए इस बयान को
देश के लिए अपमानकारी, देशद्रोह वाला, मानवाधिकारों का उल्लंघन और देश के
शहीद सैनिकों का अपमान बताया था। उन्होंने कहा था कि राजीव रौतेला ने
अपने वक्तव्य में सैनिकों की सेवा बारह वर्ष होने, सैनिकों को पेंशन
देने, शहीद सैनिकों को मुआवजा देने आदि की सरकारी नीतियों की सार्वजनिक
रूप से भर्त्सना की है, जो सेवा नियमों के अंतर्गत दंडनीय आपराध है।

इन बिन्दुओं के आधार पर उर्वशी ने प्रदेश सरकार और केंद्र सरकार से राजीव
रौतेला को तत्काल निलंबित करने और जांच कराकर नियमानुसार दण्डित करने की
नियमपूर्ण कार्रवाई करने का अनुरोध किया था। उर्वशी की इस शिकायत पर अब
उत्तर प्रदेश शासन स्तर पर जांच प्रक्रिया आरम्भ हो गई है।

नियुक्ति विभाग के उपसचिव अनिल कुमार सिंह ने शिकायत पर आगे की कार्रवाई
के लिए उर्वशी से शपथ पत्र पर शिकायत उनके द्वारा ही किए जाने की पुष्टि
करने एवं समुचित साक्ष्य नियुक्ति विभाग को उपलब्ध कराने को कहा है।
उर्वशी ने बताया कि वह जल्द ही रौतेला के शर्मनाक भाषण के अंश की वीडियो
सीडी साक्ष्य के रूप में जांच की कार्रवाई में शामिल करने के लिए
नियुक्ति विभाग को उपलब्ध कराएंगी।

मंत्री को वहां की सरकार को अस्थिर करने के मकसद से करोड़ों रुपये दिये

जाने के मामले से सुर्ख़ियों में आयी सेना की तकनीकी सहायता विभाग

(टीएसडी) से सम्बंधित सूचनाएं सार्वजनिक नहीं होंगी l भारत सरकार के

रक्षा मंत्रालय ने सामजिक कार्यकत्री उर्वशी शर्मा द्वारा इस सम्बन्ध में

माँगी गयी सूचनाओं की पूर्ति करने से मना कर दिया है l

दरअसल पूर्व थल सेनाध्यक्ष वी0 के0 सिंह के कार्यकाल में गठित तकनीकी

सहायता विभाग भारत की थल सेना की एक सीक्रेट इंटेलिजेंस इकाई थी l

सामाजिक कार्यकत्री उर्वशी शर्मा ने इसी महीने की चार तारीख को रक्षा

मंत्रालय के केंद्रीय जन सूचना अधिकारी से सूचना का अधिकार अधिनियम 2005

के तहत भारत सरकार द्वारा पूर्व आर्मी चीफ जनरल वीo केo सिंह के

कार्यकाल में स्थापित सेना की एक सीक्रेट इंटेलिजेंस यूनिट तकनीकी

सहायता विभाग (टीएसडी) पर अनऑथराइज्ड अभियान चलाने , फाइनेंशियल गड़बड़ी

करने, जम्मू-कश्मीर सरकार को अस्थिर करने के लिए गतिविधियों में शामिल

रहने आदि के आरोपों आदि के सम्बन्ध में सूचना माँगी थी l

पांच बिन्दुओं की सूचना में उर्वशी ने टीएसडी यूनिट की स्थापना के आदेश

की सत्यापित प्रति,टीएसडी यूनिट की स्थापना के दिनांक से 04-10-13 तक की

अवधि में इस यूनिट को आवंटित बजट की धनराशि की वित्तीय

वर्षवारसूचना,टीएसडी यूनिट की स्थापना के दिनांक से 04-10-13 तक की अवधि

में इस यूनिट द्वारा व्यय की गयी धनराशि की मदवार एवं वित्तीय वर्षवार

सूचना,तकनीकी सहायता विभाग (टीएसडी) द्वारा अनऑथराइज्ड अभियान चलाने ,

फाइनेंशियल गड़बड़ी करने, जम्मू-कश्मीर सरकार को अस्थिर करने के लिए

गतिविधियों में शामिल रहने आदि अनियमितताओं के सम्बन्ध में सेना की ओर

से भारत सरकार को दी गई रिपोर्ट की सर्टिफाइड कॉपी एवं तकनीकी सहायता

विभाग (टीएसडी) द्वारा अनऑथराइज्ड अभियान चलाने , फाइनेंशियल गड़बड़ी

करने, जम्मू-कश्मीर सरकार को अस्थिर करने के लिए गतिविधियों में शामिल

रहने आदि अनियमितताओं के सम्बन्ध में सेना द्वारा भारत सरकार को दी गई

रिपोर्ट पर भारत सरकार द्वारा की गयी कार्यवाही से सम्बंधित अभिलेखों की

नोट शीट्स सहित सर्टिफाइड कॉपी चाँही थी ।

रक्षा मंत्रालय के अवर सचिव ( समन्वय ) राजेश चौधरी ने 10 अक्टूबर को

उर्वशी की आरटीआई को थलसेना मुख्यालय अंतरित किया था l रक्षा मंत्रालय के

अवर सचिव ( जी एस-III ) एवं सीपीआईओ देवाशीष भारदवाज ने खेद व्यक्त करते

हुए उर्वशी को सूचित किया है कि सूचना का अधिकार अधिनियम के खंड 8 (1 )(a

) के प्रावधानों के तहत सूचना की पूर्ति नहीं की जा सकती है l

गौरतलब है कि सूचना का अधिकार अधिनियम के खंड 8 (1 )(a ) के प्रावधानों

के तहत ऐसी सूचना के प्रगटीकरण की वाध्यता नहीं है जिसके प्रगटन से भारत

की प्रभुता और अखंडता,राज्य की सुरक्षा,रणनीति,वैज्ञानिक या आर्थिक

हित,विदेश से सम्बन्ध पर प्रतिकूल प्रभाव पड़ता हो या किसी अपराध को करने

का उद्दीपन होता हो l

देवाशीष भारदवाज के उत्तर से असंतुष्ट उर्वशी का कहना है कि जो सूचना

सार्वजनिक होकर मीडिया के माध्यम से सारे संसार में पंहुच गयी है, उस

सूचना एवं उससे सम्बंधित अन्य सूचना को भारत के एक नागरिक ( उर्वशी शर्मा

) को विधिक माध्यम ( आर टी आई ) में देने से इनकार करना सही नहीं है l

उर्वशी ने बताया कि सूचना का अधिकार अधिनियम के खंड 8 (1 ) के परन्तुक के

अनुसार जो सूचना भारत की संसद को देने से इनकार नहीं किया जा सकता है, वह

सूचना देने से किसी नागरिक को भी मना नहीं किया जा सकता है l

उर्वशी ने बताया कि वे शीघ्र ही अपनी इन आपत्तियों के साथ रक्षा

मंत्रालय के निदेशक एवं अपीलीय अधिकारी एस के डोगरा के समक्ष अपील दायर

करेंगी l

तकनीकी सहायता विभाग (टीएसडी) से संबंधित सूचनाएं देने से सेना ने इन्कार
कर दिया है। सेना का कहना है कि आरटीआई की धारा-8 के तहत यह सूचना नहीं
दी जा सकती। यह सूचनाएं सामाजिक क्षेत्र में सक्रिय उर्वशी शर्मा ने
मांगी थीं।
उन्होंने रक्षा मंत्रालय से टीएसडी की स्थापना के आदेश की सत्यापित
प्रतिलिपि, उसे अब तक दिए गए बजट और व्यय का ब्यौरा और जम्मू-कश्मीर
सरकार को अस्थिर करने के लिए सेना द्वारा केंद्र सरकार को सौंपी रिपोर्ट
की प्रति आदि मांगी थी। रक्षा मंत्रालय के सूचना अधिकारी का कहना है कि
भारत की अखंडता और संप्रुभता को प्रभावित करने वाली कोई भी सूचना आरटीआई
के तहत नहीं दी जा सकती।

अपीलीय अधिकारी के समक्ष अपील दायर करेंगी उर्वशी

लखनऊ: भारतीय सेना की एक जांच के परिणाम स्वरुप जम्मू कश्मीर के एक
मंत्री को वहां की सरकार को अस्थिर करने के मकसद से करोड़ों रुपये दिये
जाने के मामले से सुर्ख़ियों में आयी सेना की तकनीकी सहायता विभाग
(टीएसडी) से सम्बंधित सूचनाएं सार्वजनिक नहीं होंगी| भारत सरकार के रक्षा
मंत्रालय ने सामजिक कार्यकत्री उर्वशी शर्मा द्वारा इस सम्बन्ध में माँगी
गयी सूचनाओं की पूर्ति करने से मना कर दिया है|

दरअसल पूर्व थल सेनाध्यक्ष वी0 के0 सिंह के कार्यकाल में गठित तकनीकी
सहायता विभाग भारत की थल सेना की एक सीक्रेट इंटेलिजेंस इकाई थी| सामाजिक
कार्यकत्री उर्वशी शर्मा ने इसी महीने की चार तारीख को रक्षा मंत्रालय के
केंद्रीय जन सूचना अधिकारी से सूचना का अधिकार अधिनियम 2005 के तहत भारत
सरकार द्वारा पूर्व आर्मी चीफ जनरल वीo केo सिंह के कार्यकाल में स्थापित
सेना की एक सीक्रेट इंटेलिजेंस यूनिट तकनीकी सहायता विभाग (टीएसडी) पर
अनऑथराइज्ड अभियान चलाने , फाइनेंशियल गड़बड़ी करने, जम्मू-कश्मीर सरकार
को अस्थिर करने के लिए गतिविधियों में शामिल रहने आदि के आरोपों आदि के
सम्बन्ध में सूचना माँगी थी|

पांच बिन्दुओं की सूचना में उर्वशी ने टीएसडी यूनिट की स्थापना के आदेश
की सत्यापित प्रति,टीएसडी यूनिट की स्थापना के दिनांक से 04-10-13 तक की
अवधि में इस यूनिट को आवंटित बजट की धनराशि की वित्तीय वर्ष
वारसूचना,टीएसडी यूनिट की स्थापना के दिनांक से 04-10-13 तक की अवधि में
इस यूनिट द्वारा व्यय की गयी धनराशि की मदवार एवं वित्तीय वर्षवार
सूचना,तकनीकी सहायता विभाग (टीएसडी) द्वारा अनऑथराइज्ड अभियान चलाने ,
फाइनेंशियल गड़बड़ी करने, जम्मू-कश्मीर सरकार को अस्थिर करने के लिए
गतिविधियों में शामिल रहने आदि अनियमितताओं के सम्बन्ध में सेना की ओर
से भारत सरकार को दी गई रिपोर्ट की सर्टिफाइड कॉपी एवं तकनीकी सहायता

विभाग (टीएसडी) द्वारा अनऑथराइज्ड अभियान चलाने , फाइनेंशियल गड़बड़ी
करने, जम्मू-कश्मीर सरकार को अस्थिर करने के लिए गतिविधियों में शामिल
रहने आदि अनियमितताओं के सम्बन्ध में सेना द्वारा भारत सरकार को दी गई
रिपोर्ट पर भारत सरकार द्वारा की गयी कार्यवाही से सम्बंधित अभिलेखों की
नोट शीट्स सहित सर्टिफाइड कॉपी चाही थी ।

रक्षा मंत्रालय के अवर सचिव ( समन्वय ) राजेश चौधरी ने 10 अक्टूबर को
उर्वशी की आरटीआई को थलसेना मुख्यालय अंतरित किया था| रक्षा मंत्रालय के
अवर सचिव ( जी एस-III ) एवं सीपीआईओ देवाशीष भारदवाज ने खेद व्यक्त करते
हुए उर्वशी को सूचित किया है कि सूचना का अधिकार अधिनियम के खंड 8 (1 )(a
) के प्रावधानों के तहत सूचना की पूर्ति नहीं की जा सकती है|

गौरतलब है कि सूचना का अधिकार अधिनियम के खंड 8 (1 )(a ) के प्रावधानों
के तहत ऐसी सूचना के प्रगटीकरण की वाध्यता नहीं है जिसके प्रगटन से भारत
की प्रभुता और अखंडता,राज्य की सुरक्षा,रणनीति,वैज्ञानिक या आर्थिक
हित,विदेश से सम्बन्ध पर प्रतिकूल प्रभाव पड़ता हो या किसी अपराध को करने
का उद्दीपन होता हो l

देवाशीष भारदवाज के उत्तर से असंतुष्ट उर्वशी का कहना है कि जो सूचना
सार्वजनिक होकर मीडिया के माध्यम से सारे संसार में पंहुच गयी है, उस
सूचना एवं उससे सम्बंधित अन्य सूचना को भारत के एक नागरिक ( उर्वशी शर्मा
) को विधिक माध्यम ( आर टी आई ) में देने से इनकार करना सही नहीं है|
उर्वशी ने बताया कि सूचना का अधिकार अधिनियम के खंड 8 (1 ) के परन्तुक के
अनुसार जो सूचना भारत की संसद को देने से इनकार नहीं किया जा सकता है, वह
सूचना देने से किसी नागरिक को भी मना नहीं किया जा सकता है|

उर्वशी ने बताया कि वे शीघ्र ही अपनी इन आपत्तियों के साथ रक्षा
मंत्रालय के निदेशक एवं अपीलीय अधिकारी एस के डोगरा के समक्ष अपील दायर
करेंगी|

जनरल के 'सीक्रेट फंड' से जुड़ी जानकारी देने से इंकार

भले ही रक्षा मंत्रालय द्वारा की गई कथित जांच में जम्मू कश्मीर के एक
मंत्री को वहां की सरकार को अस्थिर करने के मकसद से करोड़ों रुपये दिये
जाने का मामला सुर्ख़ियों में आया हो और खूब हंगामा मचा हो लेकिन जब इस
बारे में रक्षा मंत्रालय से ही जानकारी मांगी गई तो उसने यह कहते हुए
सूचना देने से इंकार कर दिया कि ऐसी सूचना सार्वजनिक होने से राष्ट्रहित
को नुकसान पहुंच सकता है। रक्षा मंत्रालय का कहना है कि सेना की तकनीकी
सहायता विभाग (टीएसडी) से सम्बंधित सूचनाएं सार्वजनिक नहीं होंगीl भारत
सरकार के रक्षा मंत्रालय ने सामजिक कार्यकत्री उर्वशी शर्मा द्वारा इस
सम्बन्ध में माँगी गयी सूचनाओं की पूर्ति करने से मना कर दिया हैl

Lucknow: After nine years of the Right to Information Act being
implemented and becoming a potent tool for the common man,the
government said it was never visualised or considered to bring
political parties under its ambit.In the cabinet note on the proposal
to amend the RTI Act to keep political parties out of its ambit,the
Centre said, during the process of enactment of the RTI Act,it was
never visualised or considered to bring the political parties within
the ambit of the said Act."

The government has further expressed fear that if political parties
are held to be public authorities under the RTI Act,it would hamper
their smooth internal working as political rivals might file RTI
applications with malicious intentions to the CPIOs of the political
parties,adversely affecting thereby their political functioning.

What was so far an achievement to boast about for the Congress,till
the latest decision of the Central Information Commission (CIC) to
bring six national parties under the RTI ambit,has turned into
something to be wary of.

In the state assembly elections 2012,Rahul Gandhi,at all his
rallies,had harped on the Centre's two path-breaking schemesthe
Mahatma Gandhi National Rural Employment Guarantee Scheme and the
Right To Information Actand counted them as game-changers for UPA.
In the run-up to the Lok Sabha election,however,it may not be possible
for him to refer to the two schemes as Centre's achievements.Reason:
MGNREGS has already been shown as ailing in the CAG report and RTI is
what UPA-II is itself trying to clamp down upon by way of the most
recent amendment to keep political parties out of the RTI ambit.

What,however,adds to the Centre's discomfort is that political parties
are still under the ambit of the RTI Act.I have filed a non-compliance
with the Central Information Commission, said Delhi-based RTI activist
Subhash Agrawal,on whose complaint the CIC had passed the June 3 order
saying the national parties are covered under the RTI Act.In such a
case till the Centre comes up with the amendment or gets a stay from
the court,political parties are covered under the RTI Act as mentioned
in the order of the Central Information Commission.

Union cabinet's decision to amend the RTI Act to keep the political
parties out of its purview has already raised the RTI activists up in
arms.The RTI amendment bill has been referred to the parliamentary
standing committee after the protest grew stronger.

The activists said,some of those who have participated in the
deliberations of the committee have been instructed to not share the
discussions in the meeting with outsiders.I had sought information
about electoral reforms but political parties linked it to funding and
made it sensational, said Agrawal.The government,while advocating the
amendment of the RTI Act vis--vis the political parties,said any
information about the political parties can be sought from the
Election Commission of India,Agrawal was denied information from the
ECI as well,on the ground that political parties are private bodies
not covered under the RTI Act.

The cabinet note on the proposal to amend the RTI Act said that CIC
has made a very liberal interpretation of Section 2(h) of the RTI
Act,leading to an erroneous conclusion that political parties are
public authorities under the RTI Act;political parties are not
established or constituted by or under the Constitution or by any
other law made by parliament.The political parties have never been
forthcoming in providing the information.RTI activist Sanjay Sharma
has filed applications with Samajwadi Party,Bahujan Samaj
Party,Congress and the Bharatiya Janata Party seeking information
about the donations,but,has received no reply.Recently,I filed an
application with Aam Aadmi Party too.It has been started by RTI
activists and might not shy from providing the information, he said.

Meanwhile,this is not for the first time effort has been made to curb
the Act.In 2006,amendment was mulled in the Act to keep file noting
out of the RTI purview.In 2010,an amendment in the Act was discussed
yet again to keep frivolous and vexatious applications away.Had the
amendment come,government department would have rejected RTI
applications at their own sweet will.The activists raised an alarm and
amendments were put off.

UPS TRYST WITH RTI ACT

SURGING POPULARITY
Despite government departments lackadaisical attitude towards the RTI
Act,its popularity is surging in the state
In March 2006,UP state information commissions first year of
functioning,it received 6 RTI applications
Eight years after it,in March 2012,the number of RTI applications grew to 44,837
This is what only the commission received as complaints/appeals
There is no estimate available for hordes of RTI applications that
government departments mush have disposed of by now
SIC,at present,receives about 350 to 400 RTI applications everyday

STUMBLING BLOCKS IN UP

Biggest stumbling block is the attitude of the government
departments.The Act lays down that information should be provided
within 30 days to the seeker.But a survey taken up by an NGO shows
that six months is the average time taken to answer an RTI query in UP
by the government departments

Senior bureaucrat draws flak over corruption charges

Senior bureaucrat Sadakant, holding three important posts in the
Government came under sharp criticism by a social activists over
various corruption charges pending against him. She demanded that the
officer must be immediately suspended and to constitute a high level
enquiry against him.

Making the above request to the state government and also dispatching
letters to President, Governor etc, Urvashi Sharma, a Lucknow based
social activist claim that in a reply to imformation sought by her
under RTI from Union Government of India, she learnt that Sadakant, an
IAS officer of 1983 batch presently posted as Principal Secretary of
Housing & Urban Planning Department, Principal Secretary of
information Department and also Principal Secretary of Bal Vikas &
Pustahar Department in the State, was an accused in cases involving
not only Corruption but Anti-National activities also. He was accused
of leaking confidential information related to security of the nation
to the private companies for his own vested interests.

Sharma claimed that Government of India prematurely repatriated
Sadakant and put his services at the disposal of the State Government
for his alleged involvement in Anti National activities and
Corruption. She said that the IAS officer who was repatriated on May
20,2011 has been given many key positions in the State Government by
previous and present Governments without any formal enquiry into the
charges of his alleged involvement in Anti National activities
,Corruption cases and his using graft money for building a Hanuman
temple in his home town.

She further said that in her RTI Central government had informed her
that CBI enquiry is still against Sadakant. However, they refused to
give other details claiming that it would impede the process of
ongoing investigation against Sadakant. She said that this is ironical
that the IAS officer , who is an accused of leaking confidential
information related to security of the nation to theprivate companies
for his own vested interests, has been given chargeof three key
departments of the State. She claimed that as Sadakanthas an attitude
of colluding with the private companies for his vestedinterests, he,
as Principal Secretary of Housing & Urban Planning

Department can easily collude with land mafias and cause
irreparableloss to the State. Similarly, the officer who is an accused
of leaking confidential information , has been given charge of
Principal Secretary of information Department. This simply means that
all confidential information of Information departments of State
Government is at stake.

She said that these are very sad state of affairs that state
government is exuding confidence in that IAS against whom CBI is
probing charges of corruption and antinationalism for the last two and
a half years. She claimed to be having no hesitation to attribute the
poor quality of mid day meals in schools to the corrupt attitude and
vested interests of Sadakant who is also Principal Secretary of Bal
Vikas & Pustahar Department. She said that as all charges leveled
against Sadakant are of very serious nature, so state government
should place him under suspension so he could not influence the probe.
She also demanded a separate enquiry against Sadakant by the State
government.
