instead of doing something concrete to stop the homeless from dying
due to cold, UP Govt. is busy providing 'Right to Entertainment' to
Safai.
Recently, Uttar Pradesh's biggest rural festival, Saifai Mahotsava,
being held at the native village of Uttar Pradesh Chief Minister
Akhilesh Yadav, organised by the Samajwadi Party MP Tej Pratap Yadav
was inaugurated by Rajya Sabha MP Jaya Bachchan. Ruling Yadav clan of
Uttar Pradesh was present in full force at Samajwadi Party president
Mulayam Singh Yadav's home district Mainpuri last Friday to launch the
17th edition of Saifai Mahotsav.
In 2013, the extravagant festival was criticised in view of the
Muzaffaranagar riots. Facing flak over the festivities in Saifai, Last
year Uttar Pradesh Government went too law to ban media from Saifai
Mahotsav from covering the event.
However, that did not deter Samajwadi Party Government to celebrate
the festival this year. Mulayam Singh Yadav went ahead and said that
not only the people living in urban centers have the right to enjoy
dance, but rural folks also take pleasure in it. Mulayam linked it to
'right to entertainment'.
Mulayam Singh's nephew Ranbir Singh used to hold an annual wrestling
meet in Saifai but after his demise in 1997, the party started
organising the event as Saifai Mahotsav every year so much so that the
event became a state financed event whenever Samajwadi party was in
Power in Uttar Pradesh.
This year also, Uttar Pradesh's Culture Department Secretary Anita
Meshram might have made media statements that state government has
approved Rs. 1 crore for the mahotsav but the fact is that the state
funded Saifai mahotsavs are closely-guarded secrets for UP government
so much so that Culture department's spineless officials are forced to
make lame excuses and play 'Hide & Seek' with info-seeker's RTI pleas
just to avert disclosure of info even when sought under RTI act.
A year ago, on 26-12-2013, this Lucknow based Social Activist Sanjay
Sharma had shot off a RTI plea to the PIO of CM office of UP. On first
point, Sanjay sought documents contained in files related to the whole
processes from proposal to decision making regarding organizing of all
Saifai Mahotsavas to which Dr. Lavkush Dwivedi of Culture Directorate
of UP, on 18 December 2014, has informed Sanjay that Information
sought by him is not clear. On Second point, Sanjay sought info of
Money spent from state coffers on all 'Safai Mahotsavas' ( Starting
from very first Mahotsava ) to which Dr. Lavkush Dwivedi has written
that it was not clear in RTI plea as to details of which year were
sought by Sanjay. On Third point, Sanjay sought Money earned by state
Govt. from organizing of all 'Safai Mahotsavas' ( Starting from very
first Mahotsava ) to which Dr. Lavkush Dwivedi has written that No
such points related to income from organizing of all 'Safai
Mahotsavas' are concern of Culture Department.
"Saifai mahotsavs are closely-guarded secrets for UP government so
much so that Culture department's spineless officials are forced to
make lame excuses and play 'Hide & Seek' with my RTI plea just to
avert disclosure of info even when sought under RTI act, so I have
every reason to doubt intentions of SP Govt. in organizing such
Mahotsavas" said Sanjay.

application in the office of the district magistrate, Etawah but this
has got no response till date. This application sought response on the
money spent in holding the event, guest list, programme list, money
spent by district administration and state government and frequency of
flights that operated to bring guests to the venue but on none of the
eleven points information ever came. "Even UP state information
commission, full of sycophant info-commissioners, refused to listen to
my complaint and same was dismissed by Information commissioner Vijay
Shankar Sharma" said Sanjay.
With grim picture being painted by UPSIC, the highest authority in
RTI matters in UP, Sanjay feels that info on loot of public money on
such events shall always remain a secret.
Terming State Govt's illogical viewpoint of providing 'Right to
Entertainment' to Safai @ deprivation of 'Right to life' to homeless
of UP as tragic, inhumane and autocratic, Sanjay condemned spending on
Safai Mahotsava from State coffers as a shear wastage of public money
and that too only to quench of thirst of unending Ego of political
rulers of UP and referring the Death Toll In Uttar Pradesh Due to Cold
as 125, demanded the Govt. to ensure 'Right to Life' to each n every
homeless of UP before going to Safai like events.
Sanjay told that he is approaching Raj Bhavan of UP to personally
meet the Governor and apprise him of this high handed approach of
rulers of UP in this matter in detail to bring things to their logical
ends.

shall always remain a secret.
We, at TAHRIR feel that State Government's illogical viewpoint of
providing 'Right to Entertainment' to Safai at the cost of deprivation
of 'Right to life' to homeless of UP is tragic, inhumane and
autocratic and so we are condemning these behind the iron-curtain
spending on Safai Mahotsava from State coffers as a shear wastage of
public money and that too when all this is being done at the whims &
fancies of ruling Yadav Clan of UP, just to quench of thirst of
unending Ego of these insensitive political rulers of UP.
TAHRIR feels that the death toll In Uttar Pradesh Due to Cold as 125
is a not only deprivation of 'Right to life' to the deceased but a
complete failure of UP Government's functioning also and so we are
raising our demand to inquire all incidents of these deaths, get FIRs
of murder registered against the public authorities who failed to
protect these deaths due to cold and take appropriate measures to
ensure 'Right to Life' to each n every homeless of UP before
Government is going to Safai Mahotsava like events.
Sir, TAHRIR is , through this memorandum approaching your good-self to
personally meet us so that we should apprise your good-self with
TAHRIR's point of view of this high handed approach of rulers of UP in
this matter in detail so that things should be brought to their
logical ends. In the meantime, your good-self is requested to
intervene and take appropriate action in this matter and oblige.

Safai Mahotsava from State coffers as a shear wastage of public money
and that too only to quench of thirst of unending Ego of political
rulers of UP and referring the Death Toll In Uttar Pradesh Due to Cold
as 125, demanded the Govt. to ensure 'Right to Life' to each n every
homeless of UP before going to Safai like events.

दरअसल संजय ने बीते 22 नवम्बर को मुख्यमंत्री कार्यालय के जनसूचना
अधिकारी को एक आरटीआई आवेदन भेजकर यूपी के रामपुर जिले में मनाये गए
समाजवादी पार्टी मुखिया मुलायम सिंह यादव के सालगिरह जश्न में हुए सरकारी
खर्चों आदि की सूचना मांगी थी l संजय की आरटीआई का बिंदु 5 सालगिरह जश्न
में सरकारी हवाई जहाजों के इस्तेमाल से सम्बंधित था l
बीते 5 दिसम्बर को संजय की आरटीआई मुख्यमंत्री कार्यालय से उत्तर प्रदेश
शासन के नागरिक उड्डयन विभाग को अंतरित हुई l उत्तर प्रदेश शासन के
नागरिक उड्डयन विभाग ने बीते 17 दिसम्बर को ये आरटीआई उत्तर प्रदेश के
नागरिक उड्डयन निदेशालय को अंतरित की जिसे अगले ही दिन लखनऊ एयरपोर्ट की
परिचालन उप इकाई को अंतरित कर दिया गया l
लखनऊ एयरपोर्ट की परिचालन इकाई के जनसूचना अधिकारी कैप्टन दीपक
श्रीवास्तव ने बीते 19 दिसम्बर को संजय को सूचना दी है कि राजकीय विमानों
का उपयोग महामहिम राज्यपाल महोदय,मा० मुख्यमंत्री जी एवं राज्य सरकार के
गणमान्य महानुभावों की शासकीय यात्राओं के संपादन हेतु किया जाता है जबकि
राजनेताओं के निजी आयोजनों हेतु राजकीय विमानों का उपयोग नहीं किया जाता
है l
सामाजिक कार्यकर्ता संजय ने इसे एक अच्छी पहल बताते हुए सभी राजनैतिक
दलों से इसी प्रकार का आचरण करने की अपील की है l

Uttar Pradesh Lokayukta has formally started a probe into the
allegation of corruption against Uttar Pradesh state mining minister
Gayatri Prasad Prajapati on the basis of 1,727 pages complaint's
documents he has before him.A complaint was filed with UP Lokayukta NK
Mehrotra by Om Shankar Dwivedi on December 11,2014 against the
minister alleging that he has amassed wealth disproportionate to his
known sources of income. In the complaint, it has been alleged that
Gyatri and his family members have properties in Amethi, Lucknow and
Mohanlalganj.Dwivedi also mentioned five companies in which Gyatri,
his wife and son are directors.It has been alleged that the mining
minister amassed assets worth crores of rupees misusing his office.
Close on the heels of allegations of the state's Mining Minister
Gayatri Prasad Prajapati amassing huge wealth through corrupt deals,
another minister in the Akhilesh Yadav cabinet has been accused of
taking bribes to make blacklisted schools and colleges centres for the
forthcoming UP board examinations.A complaint has been filed with the
state Lokayukta Justice (Retd) N K Mehrotra against Minister for
Secondary Education Mehboob Ali accusing him of taking bribes from the
managements of schools and colleges, which had been blacklisted after
allegations of mass copying there in the past examination, to allow
them to become centres again this year.The complaint has been filed by
the manager of a school in UP's Hardoi district. The complainant
alleged that the minister had granted recognition to the schools which
did not have even enough rooms to conduct classes."Lakh of ruppes had
been paid by such schools to get recognition," said complainant Bhagat
Tejgiri.He also alleged that the minister was patronizing the nakal
mafia, the organized gangs, which facilitate use of unfair means
during the board examinations. Just a few days back, a senior official
in the Secondary Education Department, who had taken on the mafia and
blacklisted several schools and colleges infamous for mass copying,
was removed from his post and transferred elsewhere.
Through this memorandum, we are raising our demand to sack these two
ministers facing graft charges from UP Cabinet. TAHRIR demands that
these cabinet ministers, who are facing lokayukta probe in alleged
graft cases against them, should immediately be terminated from the
post of ministers so that the investigation is not affected at all. We
are sending this memorandum to both you, namely the Governor and as
the chief minister of the state, with the demand to both of you, to
take necessary actions to immediately sack these two ministers who
face charges of corruption and a lokayukta probe because Continuing
them as minister would surely affect free and fair inquiry.
We, at TAHRIR are well aware that Uttar Pradesh Governor has recently
written a letter to the chief minister seeking 'explanatory
memorandum' on the action taken against four BSP ministers and eight
other officials against whom Lokayukta had made recommendations,
finding them guilty of corruption and other charges. Referring to the
special representation received from the Lokayukt in this regard,
Governor has asked the chief minister to promptly make available his
and chief secretary's explanatory memorandum in connection with the
action taken by the government on the recommendations of the
Lokayukta. We are also aware that the letter from Governor also stated
that the Lokayukta, after completing the investigations, had found
these four ministers and eight other officials and employees guilty of
corruption and other charges and had also made his recommendations
expecting to be apprised of the action taken in three months time,
which had then lapsed.The Lokayukt had send special representations to
the governor recently that he had not been informed with the action
taken on his recommendations against BSP ministers Swami Prasad
Maurya, Avadhpal Singh Yadav, Ramvir Upadhaya and Badshah Singh and
others.
We are also aware about a reminder by UP Lokayukta over
disqualification of two MLAs, Bahujan Samaj Party MLA from Rasra in
Ballia Uma Shankar Singh and BJP legislator Bajrang Bahadur Singh from
Pharendra in Maharajganj district indicted on charges of bagging
government construction contracts and holding office of profit. If
this is because one of the two MLAs belongs to the BJP and a decision
over termination of their memberships from Assembly has to be taken by
Governor in consultation with the Election Commission of India on the
inquiry report submitted way-back in February 2014. We are aware that
Lokayukta has informed the governor once again about the findings of
his inquiry report.
BSP MLA Uma Shankar Singh was heading a sole proprietorship firm that
was awarded work contracts by PWD worth crores. Same was the case with
BB Singh of the BJP. Being public servants they cannot hold an office
of profit.Hence, their actions disqualify the two under section 9 (A)
of the Representation of Peoples' Act and Article 191 (E) of the
Constitution.
Through this memorandum, we are also raising our demand to take
immediate action on all reports submitted by the UP Lokayukta to Uttar
Pradesh Government and also to initiate departmental enquiries to
fix the responsibility for the resultant loss to the state exchequer &
subsequent actions to recover this money.

पर पद का दुरुपयोग कर आय से ज्यादा संपत्ति जुटाने के आरोपों की शिकायत
पर लोकायुक्त जस्टिस एनके मेहरोत्रा द्वारा 1725 पेज के साक्ष्यों के
आधार पर गायत्री प्रजापति एवं कुछ अन्य को नोटिस भेजकर आरोपों पर जवाब
मांगने की कार्यवाही की जा रही है । गायत्री प्रसाद प्रजापति के खिलाफ ओम
शंकर द्विवेदी की ओर से दाखिल की गई शिकायत दर्ज कर शुरू की गयी जांच के
पहले चरण में लोकायुक्त ने तीन लोगों को नोटिस भेजे गए हैं, जिनके खिलाफ
ओम शंकर द्विवेदी की शिकायत के साथ प्रॉपर्टी की सेल डीड दाखिल की गई थी
। इनमें गायत्री के दोनों ड्राइवर रामराज और मनोज के साथ गायत्री की
महिला मित्र गुड्डा भी हैं। नोटिस में शिकायतकर्ता द्वारा लगाए गए आरोपों
पर इन लोगों का स्पष्टीकरण तलब किया गया है। इन्हें अपना जवाब देने के
लिए सात जनवरी से नौ जनवरी के बीच का समय दिया गया है। लोकायुक्त ने
उत्तर प्रदेश के माध्यमिक शिक्षा मंत्री महबूब अली के खिलाफ शिकायत करने
वाले हरदोई निवासी बाबा भगत तेजगिरि को भी नोटिस भेजकर नौ जनवरी तक
आरोपों के समर्थन में साक्ष्य उपलब्ध कराने की हिदायत दी है। इसके अलावा
माध्यमिक शिक्षा विभाग से परीक्षा केंद्रों के निर्धारण से जुड़ी
पत्रावली व अन्य दस्तावेज भी मांगे गए हैं।महबूब अली पर परीक्षा केंद्रों
के निर्धारण में वसूली व भ्रष्ट अधिकारियों को संरक्षण देने का आरोप
लगाते हुए लोकायुक्त के यहां यह शिकायत दाखिल की गयी है ।

This refers to media reports as per which on 24-12-14, During a public
meeting, called for the purpose of distribution of Identity cards of
Samajwadi Pension Scheme in Fatehpur district of Uttar Pradesh, Uttar
Pradesh Social Welfare Cabinet Minister Awadhesh Prasad , while
addressing the public-meeting as Chief Guest, used derogatory words
for the disabled community.

Awadhesh Prasad publicly called disabled persons as "burden on the
family and the society". Thus , Uttar Pradesh Social Welfare Cabinet
Minister Awadhesh Prasad has not only committed a crime but he has
also committed the unconstitutional act of open violation of the
right of dignified life to the disabled persons . The crime becomes
more grave and serious as these derogatory words have come out
straight from the mouth of Social Welfare Cabinet Minister of Uttar
Pradesh.
I am reporting the incident to the police department also to get a
proper F.I.R. filed against the perpetrator Awadhesh Prasad.
We are bringing forth this case where right to dignity of disabled has
been grossly violated. We are requesting you to take appropriate
actions to initiate inquiry and take subsequent punitive action
against the said perpetrator as per the law of the land.

की सरकार के समाज कल्याण मंत्री अवधेश प्रसाद द्वारा छुद्र मानसिकता के
तहत सार्वजनिक रूप से दिया गया वक्तव्य "परिवार, समाज के लिए बोझ हैं
विकलांग" , विकलांग-जनों का अपमान है, विकलांग-जनों के मानवाधिकारों का
घनघोर उल्लंघन है साथ ही साथ विकलांग-जनों को भारत के संविधान द्वारा
दिए गए सम्मानजनक जीवन के अधिकार का हनन भी है, यह कहना है सामाजिक
संस्था तहरीर के संस्थापक लखनऊ निवासी सामाजिक कार्यकर्ता और इंजीनियर
संजय शर्मा का l
दरअसल उत्तर प्रदेश के ये मंत्री बुधवार को फतेहपुर जिले में समाजवादी
पेंशन परिचय पत्र वितरण समारोह को बतौर मुख्य अतिथि संबोधित कर रहे
थे।समारोह में मंच से उन्होंने सरकार की उपलब्धियां गिनानी शुरू की। इस
बीच वह विकलांगों के लिए चलाई जा रही विभिन्न योजनाओं को गिनाने लगे। फिर
बोले कि विकलांग परिवार और समाज के लिए बोझ बने हैं।
लोक जीवन में पारदर्शिता संवर्धन, जबाबदेही निर्धारण और आमजन के
मानवाधिकारों के संरक्षण के हितार्थ जमीनी स्तर पर कार्यशील संस्था
तहरीर ने अपने सामाजिक दायित्वों के तहत अवधेश प्रसाद के खिलाफ एक
शिकायत संयुक्त राष्ट्र संघ और राष्ट्रीय मानवाधिकार आयोग भेजकर अवधेश

की सरकार के समाज कल्याण मंत्री अवधेश प्रसाद द्वारा छुद्र मानसिकता के
तहत सार्वजनिक रूप से दिया गया वक्तव्य "परिवार, समाज के लिए बोझ हैं
विकलांग" , विकलांग-जनों का अपमान है, विकलांग-जनों के मानवाधिकारों का
घनघोर उल्लंघन है साथ ही साथ विकलांग-जनों को भारत के संविधान द्वारा
दिए गए सम्मानजनक जीवन के अधिकार का हनन भी है, यह कहना है सामाजिक
संस्था तहरीर के संस्थापक लखनऊ निवासी सामाजिक कार्यकर्ता और इंजीनियर
संजय शर्मा का l
दरअसल उत्तर प्रदेश के ये मंत्री बुधवार को फतेहपुर जिले में समाजवादी
पेंशन परिचय पत्र वितरण समारोह को बतौर मुख्य अतिथि संबोधित कर रहे
थे।समारोह में मंच से उन्होंने सरकार की उपलब्धियां गिनानी शुरू की। इस
बीच वह विकलांगों के लिए चलाई जा रही विभिन्न योजनाओं को गिनाने लगे। फिर
बोले कि विकलांग परिवार और समाज के लिए बोझ बने हैं।
लोक जीवन में पारदर्शिता संवर्धन, जबाबदेही निर्धारण और आमजन के
मानवाधिकारों के संरक्षण के हितार्थ जमीनी स्तर पर कार्यशील संस्था
तहरीर ने अपने सामाजिक दायित्वों के तहत अवधेश प्रसाद के खिलाफ एक
शिकायत संयुक्त राष्ट्र संघ और राष्ट्रीय मानवाधिकार आयोग भेजकर अवधेश
प्रसाद को दण्डित कराने की मांग की है और सूबे के मुख्यमंत्री अखिलेश
यादव और सूबे के राज्यपाल को मांगपत्र भेजकर अवधेश प्रसाद को समाज
कल्याण मंत्री पद से तत्काल वर्खास्त करने की मांग की है l

TAHRIR raises Demand to compulsorily print Actual Production Cost on Products : RTI reveals that since Independence, GOI did nothing to make printing Actual Production Cost on Products mandatory.

राष्ट्रीय उपभोग्ता अधिकार दिवस पर भारत के प्रधानमंत्री नरेंद्र मोदी को

उत्पादन लागत का अंकन अनिवार्य बनाने की मांग की है l

दरअसल संजय ने अपनी एक आरटीआई के माध्यम से भारत सरकार द्वारा बाजारों
में बिकने बाले सभी उत्पादों पर वास्तविक उत्पादन लागत का अंकन अनिवार्य
बनाने के सम्बन्ध में आजादी के बाद से अब तक की अवधि में गयी कार्यवाही
की सूचना माँगी थी l संजय को आरटीआई में भारत सरकार द्वारा दी गयी
सूचना के अनुसार सरकार ने आजादी के बाद से अब तक की अवधि में बाजारों में
बिकने बाले सभी उत्पादों पर वास्तविक उत्पादन लागत का अंकन अनिवार्य
बनाने के सम्बन्ध में कोई भी कार्यवाही नहीं की है l संजय ने अपनी
आरटीआई और इस सम्बन्ध में भारत सरकार द्वारा दी गयी सूचना के आधार पर ही
नरेंद्र मोदी से भारत के उपभोग्ताओं के हित वास्तव में संरक्षित करने के
लिए इस दिशा में ठोस कार्यवाही करने की मांग की है l

दिखावे करने के स्थान पर नरेंद्र मोदी को अब भारत के उपभोग्ताओं के हित
वास्तव में संरक्षित करने के लिए इस दिशा में ठोस कार्यवाही करनी होगी l
संजय का कहना है कि उत्पादकों द्वारा अधिकतम खुदरा मूल्य और वास्तविक
उत्पादन लागत में बड़ा अंतर रखकर सरकारी खरीद की व्यवस्था में
भ्र्ष्टाचार करके अपने उत्पाद खपाए जाते हैं और साथ ही साथ घटिया
गुणवत्ता के अधिकांश उत्पादों का अधिकतम खुदरा मूल्य भी अच्छी गुणवत्ता
के उत्पाद के बराबर रखकर उपभोग्ताओं को धोखा दिया जाता है l
संजय ने भारत के उपभोग्ताओं के हित वास्तव में संरक्षित करने के लिए सभी
उत्पादों पर अधिकतम खुदरा मूल्य के आधार पर उत्पादन शुल्क लगाने,
उत्पादों की कीमत न घटाकर पैकिंग की मात्रा कम करके उपभोग्ताओं को
अप्रत्यक्ष धोखा देने पर अंकुश लगाने के लिए पैकिंग की मात्रा का
मानकीकरण करने और साउथ अफ्रीका की भाँति निजी क्षेत्र को आरटीआई के
दायरे में लाने की भी मांग की है l

आमंत्रण / प्रकाशनार्थ मीडिया रिलीज़ : उत्तर प्रदेश के सूचना आयुक्तों के अमानवीय कृत्यों के विरोध में सामाजिक संस्था 'तहरीर' के साथ बिभिन्न सामाजिक संगठनों का कल दिनांक 21 दिसम्बर 2014 रविवार को 11 बजे से 3 बजे तक गाँधी प्रतिमा, हजरतगंज ,निकट जीपीओ ,लखनऊ पर शान्तिपूर्ण धरना / विरोध प्रदर्शन
उत्तर प्रदेश के सूचना आयुक्त अरविन्द सिंह बिष्ट द्वारा आरटीआई
प्रयोगकर्ता,मानवाधिकार पक्षकार और सीनियर सिटिज़न महेंद्र अग्रवाल से
सामंतवादी मानसिकता के तहत सुनवाई के दौरान अमानवीय व्यवहार किया गया l
वर्तमान कार्यरत सभी सूचना आयुक्तों द्वारा सरकारी भ्रष्टाचार और
अनियमितताओं के प्रति संवेदनशील मामलों में आरटीआई प्रयोगकर्ताओं को
अपमानित कर सूचना आयोग में आने के प्रति हतोत्साहित करने की रणनीति अपनाई
जा रही है ताकि आरटीआई प्रयोगकर्ता ऐसे मामलों को सूचना आयोग में उपस्थित
होकर न रख सकें और पूर्णतया अक्षम होने पर भी सरकारी कृपा से नियुक्त
सूचना आयुक्त सरकार द्वारा उनके ऊपर किये गए अनधिकृत उपकारों के ऋण से
मुक्त हो सकें l इस प्रकार उत्तर प्रदेश में आरटीआई के संरक्षक ये सूचना
आयुक्त ही आरटीआई के हत्यारे बन गए हैं l सूचना आयुक्तों के इन कुकृत्यों
से उत्तर प्रदेश के आरटीआई प्रयोगकर्ता जो मानवाधिकार पक्षकार भी हैं, के
मानवाधिकारों का तो हनन हो ही रहा है साथ ही साथ इन आरटीआई प्रयोगकर्ताओं
और मानवाधिकार पक्षकारों को संविधान द्वारा प्रदत्त सूचना के अधिकार से
वंचित रखने का असंवैधानिक कार्य भी एक साजिश के तहत किया जा रहा है और
भाई-भतीजावादी कार्य- संस्कृति में लिप्त सरकार इन संवेदनशील मामलों में
आँख-कान मूंदे बैठी है l
ज्ञातव्य है कि सूचना आयुक्त अरविन्द सिंह बिष्ट उत्तर प्रदेश के
सत्ताधारी राजनैतिक दल समाजवादी पार्टी के मुखिया मुलायम सिंह यादव के
समधी है और इसी वजह से वे सूचना आयुक्त हैं न कि अपनी किसी विशिष्ट
योग्यता की वजह से l सत्ताधारी राजनैतिक दल से नजदीकी के चलते ही सूचना
आयुक्त अरविन्द सिंह बिष्ट मतान्ध होकर सूचना आयुक्त के पद का दुरुपयोग
कर रहे हैं और 'तहरीर' के गुप्त सर्वे के अनुसार आज तक अपने द्वारा सुने
गए एक भी मामले का निस्तारण आरटीआई कानून के अनुसार नहीं कर पाये हैं l
'तहरीर' के एक गुप्त अध्ययन के अनुसार आरटीआई कार्यकर्ताओं द्वारा आरटीआई
एक्ट के प्राविधानों का हवाला देते हुए सूचना दिलाने की बात करते ही
बिष्ट सरीखे ये आयुक्त अपनी अयोग्यता छुपाने और सरकारी
भ्रष्टाचार/अनियमितताओं को छुपाने के लिए अपने पद का दुरुपयोग कर आरटीआई
कार्यकर्ताओं को सूचना आयोग में आने ही न देने की साजिश करने में लग जाते
हैं l

take appropriate actions to ensure that the government of Uttar Pradesh should establish a transparent regime of working in public life and ensure encouragement to RTI activists cum Human Rights defenders with no more humiliation to them at all. We are also requesting your good-self to look into this particular case of Harassment of RTI activist & Human Right Defender by Uttar Pradesh State Information Commissioner and to initiate inquiry and take subsequent punitive action against the said perpetrator as per the law of the land.

and take punitive action against the perpetrator
Sir,
Mr. Mahendra Agarwal, a 62 year old Senior Citizen, male, Right to
Information ( R.T.I. ) activist, lives in 326, Prince
Complex,Hazratganj,Lucknow,Uttar Pradesh, India,Pin Code-226001. Mr.
Agarwal's Mobile no. is +919415376117 and his e-mail id is
newskootchakra@gmail.com .
Mr. Mahendra Agarwal takes up cases of exposures of
irregularities/illegalities in various Government offices of India
through use of Right to Information ( R.T.I. ) act 2005. Mr. Agarwal,
a lawyer cum journalist is also a Member of Working Committee of
Uttar Pradesh Chapter of Transparency International India and
Secretary of Society for Fast Justice Lucknow.
On 16-12-2014, Mr. Agarwal was not only humiliated but denied his
right to access information. The incident occurred within the
premises of Uttar Pradesh State Information Commission (UPSIC) which
is situated at 6th floor of Indira Bhavan at Ashok Marg in
Lucknow,Uttar Pradesh,India,pin code-226001.
Mr. Agarwal was sitting at hearing Room no. S-3 of Uttar Pradesh State
Information Commission (UPSIC) to present himself in the hearing of
second appeal number S-3/498/C/2014. Mr. Agarwal was humiliated by
Uttar Pradesh State Information Commissioner Mr. Arvind Singh Bisht
just for not standing-up before Mr. Arvind Singh Bisht when Mr. Arvind
Singh Bisht returned back from wash-rooms after attending his natural
calls in the midst of hearings. Mr. Arvind Singh Bisht not only used
derogatory words against Mr. Agarwal but got Mr. Mahendra Agarwal
thrown out of the hearing room forcibly by his peon and security
guards. This way Uttar Pradesh State Information Commissioner Mr.
Arvind Singh Bisht not only violated right to dignity of a right to
freedom of expression defender but violated Mr. Agarwal's right to get
information under R.T.I. act also. Since the hearing happens in open
hearing rooms fitted with CCTV cameras so all other appellants of
cases listed in hearing room no. 3 just before Mr. Agarwal's case are
witness to the incident and CCTV footage of the day is the most
befitting evidence that should be used while investigating the case.
Vide letter no. 2848 dated 16-12-14 ( Copy attached ),Mr. Agarwal has
reported the incident to Governor of Uttar Pradesh with copies to
Chief Minister of Uttar Pradesh, Chief Secretary of Uttar Pradesh and
Chairman of National Human Rights Commission of Uttar Pradesh. Mr.
Agarwal has made this violation public and reported the matter to a

Not only this Mr. Agarwal has reported the incident to the Incharge of
the concerned police station namely police station Hazratganj of
Lucknow district. Police department has done nothing in this matter
and no F.I.R. has been filed against the perpetrator.
A few months ago, in the month of April 2014, another R.T.I. activist
Mr. Ashok Kumar Goyal was humiliated and implicated in a false and
fabricated criminal case by Uttar Pradesh State information
Commissioner Mr. Arvind Singh Bisht. The case is in the court and
R.T.I. activist Mr. Ashok Kumar Goyal is now out on bail.
This is noteworthy to mention that Mr. Arvind Singh Bisht happens to
be Father-in-law of brother of Uttar Pradesh Chief Minister Mr.
Akhilesh Yadav and his appointment on the post of Uttar Pradesh State
Information Commission has been challenged in the Supreme Court of
India, for it being a political appointment based on favoritism
accorded by ruling Samajwadi Party of Uttar Pradesh to an undeserving
Mr. Bisht.
We are bringing forth this case where freedom of expression, human
rights defenders and humanitarian law are under attack in India. This
is a case where authorities have harassed and intimidated RTI
activists and human rights defenders. That, the Uttar Pradesh State
Information Commissioner has arbitrarily got RTI activist thrown out
of hearing and devoid him of his Right to information,this kind of
intimidation leads to massive censorship on free flow of Information
to the citizen and when the flow of information is suppressed, the
people's Right to know, seek, obtain, receive and hold information is
grossly violated.
Government of Uttar Pradesh has been slow to address many areas of
concern, and has demonstrated what appears to be a more hard-line
attitude in some areas such as restrictions on freedom of expression.
There is a worsening pattern throughout 2014 of harassment,
intimidation and target threats against RTI activists cum human rights
defenders, many of whom have been forced into exile so far as their
use of Right to information is concerned.
We are requesting you to take appropriate actions to ensure that the
government of Uttar Pradesh should establish a transparent regime of
working in public life and ensure encouragement to RTI activists cum
Human Rights defenders with no more humiliation to them at all. We are
also requesting your good-self to look into this particular case of
Harassment of RTI activist & Human Right Defender by Uttar Pradesh
State Information Commissioner and to initiate inquiry and take

Sir,
Mr. Mahendra Agarwal, a 62 year old Senior Citizen, male, Right to
Information ( R.T.I. ) activist, lives in 326, Prince
Complex,Hazratganj,Lucknow,Uttar Pradesh, India,Pin Code-226001. Mr.
Agarwal's Mobile no. is +919415376117 and his e-mail id is
newskootchakra@gmail.com .
Mr. Mahendra Agarwal takes up cases of exposures of
irregularities/illegalities in various Government offices of India
through use of Right to Information ( R.T.I. ) act 2005. Mr. Agarwal,
a lawyer cum journalist is also a Member of Working Committee of
Uttar Pradesh Chapter of Transparency International India and
Secretary of Society for Fast Justice Lucknow.
On 16-12-2014, Mr. Agarwal was not only humiliated but denied his
right to access information. The incident occurred within the
premises of Uttar Pradesh State Information Commission (UPSIC) which
is situated at 6th floor of Indira Bhavan at Ashok Marg in
Lucknow,Uttar Pradesh,India,pin code-226001.
Mr. Agarwal was sitting at hearing Room no. S-3 of Uttar Pradesh State
Information Commission (UPSIC) to present himself in the hearing of
second appeal number S-3/498/C/2014. Mr. Agarwal was humiliated by
Uttar Pradesh State Information Commissioner Mr. Arvind Singh Bisht
just for not standing-up before Mr. Arvind Singh Bisht when Mr. Arvind
Singh Bisht returned back from wash-rooms after attending his natural
calls in the midst of hearings. Mr. Arvind Singh Bisht not only used
derogatory words against Mr. Agarwal but got Mr. Mahendra Agarwal
thrown out of the hearing room forcibly by his peon and security
guards. This way Uttar Pradesh State Information Commissioner Mr.
Arvind Singh Bisht not only violated right to dignity of a right to
freedom of expression defender but violated Mr. Agarwal's right to get
information under R.T.I. act also. Since the hearing happens in open
hearing rooms fitted with CCTV cameras so all other appellants of
cases listed in hearing room no. 3 just before Mr. Agarwal's case are
witness to the incident and CCTV footage of the day is the most
befitting evidence that should be used while investigating the case.
Vide letter no. 2848 dated 16-12-14 ( Copy attached ),Mr. Agarwal has
reported the incident to Governor of Uttar Pradesh with copies to
Chief Minister of Uttar Pradesh, Chief Secretary of Uttar Pradesh and
Chairman of National Human Rights Commission of Uttar Pradesh. Mr.
Agarwal has made this violation public and reported the matter to a

Not only this Mr. Agarwal has reported the incident to the Incharge of
the concerned police station namely police station Hazratganj of
Lucknow district. Police department has done nothing in this matter
and no F.I.R. has been filed against the perpetrator.
A few months ago, in the month of April 2014, another R.T.I. activist
Mr. Ashok Kumar Goyal was humiliated and implicated in a false and
fabricated criminal case by Uttar Pradesh State information
Commissioner Mr. Arvind Singh Bisht. The case is in the court and
R.T.I. activist Mr. Ashok Kumar Goyal is now out on bail.
This is noteworthy to mention that Mr. Arvind Singh Bisht happens to
be Father-in-law of brother of Uttar Pradesh Chief Minister Mr.
Akhilesh Yadav and his appointment on the post of Uttar Pradesh State
Information Commission has been challenged in the Supreme Court of
India, for it being a political appointment based on favoritism
accorded by ruling Samajwadi Party of Uttar Pradesh to an undeserving
Mr. Bisht.
We are bringing forth this case where freedom of expression, human
rights defenders and humanitarian law are under attack in India. This
is a case where authorities have harassed and intimidated RTI
activists and human rights defenders. That, the Uttar Pradesh State
Information Commissioner has arbitrarily got RTI activist thrown out
of hearing and devoid him of his Right to information,this kind of
intimidation leads to massive censorship on free flow of Information
to the citizen and when the flow of information is suppressed, the
people's Right to know, seek, obtain, receive and hold information is
grossly violated.
Government of Uttar Pradesh has been slow to address many areas of
concern, and has demonstrated what appears to be a more hard-line
attitude in some areas such as restrictions on freedom of expression.
There is a worsening pattern throughout 2014 of harassment,
intimidation and target threats against RTI activists cum human rights
defenders, many of whom have been forced into exile so far as their
use of Right to information is concerned.
We are requesting you to take appropriate actions to ensure that the
government of Uttar Pradesh should establish a transparent regime of
working in public life and ensure encouragement to RTI activists cum
Human Rights defenders with no more humiliation to them at all. We are
also requesting your good-self to look into this particular case of
Harassment of RTI activist & Human Right Defender by Uttar Pradesh
State Information Commissioner and to initiate inquiry and take
subsequent punitive action against the said perpetrator as per the law
of the land.

Mr. Mahendra Agarwal takes up cases of exposures of
irregularities/illegalities in various Government offices of India
through use of Right to Information ( R.T.I. ) act 2005. Mr. Agarwal,
a lawyer cum journalist is also a Member of Working Committee of
Uttar Pradesh Chapter of Transparency International India and
Secretary of Society for Fast Justice Lucknow.
On 16-12-2014, Mr. Agarwal was not only humiliated but denied his
right to access information. The incident occurred within the
premises of Uttar Pradesh State Information Commission (UPSIC) which
is situated at 6th floor of Indira Bhavan at Ashok Marg in
Lucknow,Uttar Pradesh,India,pin code-226001.
Mr. Agarwal was sitting at hearing Room no. S-3 of Uttar Pradesh State
Information Commission (UPSIC) to present himself in the hearing of
second appeal number S-3/498/C/2014. Mr. Agarwal was humiliated by
Uttar Pradesh State Information Commissioner Mr. Arvind Singh Bisht
just for not standing-up before Mr. Arvind Singh Bisht when Mr. Arvind
Singh Bisht returned back from wash-rooms after attending his natural
calls in the midst of hearings. Mr. Arvind Singh Bisht not only used
derogatory words against Mr. Agarwal but got Mr. Mahendra Agarwal
thrown out of the hearing room forcibly by his peon and security
guards. This way Uttar Pradesh State Information Commissioner Mr.
Arvind Singh Bisht not only violated right to dignity of a right to
freedom of expression defender but violated Mr. Agarwal's right to get
information under R.T.I. act also. Since the hearing happens in open
hearing rooms fitted with CCTV cameras so all other appellants of
cases listed in hearing room no. 3 just before Mr. Agarwal's case are
witness to the incident and CCTV footage of the day is the most
befitting evidence that should be used while investigating the case.
Vide letter no. 2848 dated 16-12-14 ( Copy attached ),Mr. Agarwal has
reported the incident to Governor of Uttar Pradesh with copies to
Chief Minister of Uttar Pradesh, Chief Secretary of Uttar Pradesh and
Chairman of National Human Rights Commission of Uttar Pradesh. Mr.
Agarwal has made this violation public and reported the matter to a

Not only this Mr. Agarwal has reported the incident to the Incharge of
the concerned police station namely police station Hazratganj of
Lucknow district. Police department has done nothing in this matter
and no F.I.R. has been filed against the perpetrator.
A few months ago, in the month of April 2014, another R.T.I. activist
Mr. Ashok Kumar Goyal was humiliated and implicated in a false and
fabricated criminal case by Uttar Pradesh State information
Commissioner Mr. Arvind Singh Bisht. The case is in the court and
R.T.I. activist Mr. Ashok Kumar Goyal is now out on bail.
This is noteworthy to mention that Mr. Arvind Singh Bisht happens to
be Father-in-law of brother of Uttar Pradesh Chief Minister Mr.
Akhilesh Yadav and his appointment on the post of Uttar Pradesh State
Information Commission has been challenged in the Supreme Court of
India, for it being a political appointment based on favoritism
accorded by ruling Samajwadi Party of Uttar Pradesh to an undeserving
Mr. Bisht.
We are bringing forth this case where freedom of expression, human
rights defenders and humanitarian law are under attack in India. This
is a case where authorities have harassed and intimidated RTI
activists and human rights defenders. That, the Uttar Pradesh State
Information Commissioner has arbitrarily got RTI activist thrown out
of hearing and devoid him of his Right to information,this kind of
intimidation leads to massive censorship on free flow of Information
to the citizen and when the flow of information is suppressed, the
people's Right to know, seek, obtain, receive and hold information is
grossly violated.
Government of Uttar Pradesh has been slow to address many areas of
concern, and has demonstrated what appears to be a more hard-line
attitude in some areas such as restrictions on freedom of expression.
There is a worsening pattern throughout 2014 of harassment,
intimidation and target threats against RTI activists cum human rights
defenders, many of whom have been forced into exile so far as their
use of Right to information is concerned.
We are requesting you to take appropriate actions to ensure that the
government of Uttar Pradesh should establish a transparent regime of
working in public life and ensure encouragement to RTI activists cum
Human Rights defenders with no more humiliation to them at all. We are
also requesting your good-self to look into this particular case of
Harassment of RTI activist & Human Right Defender by Uttar Pradesh
State Information Commissioner and to initiate inquiry and take
subsequent punitive action against the said perpetrator as per the law
of the land.

This is noteworthy to mention that Mr. Arvind Singh Bisht happens to
be Father-in-law of brother of Uttar Pradesh Chief Minister Mr.
Akhilesh Yadav and his appointment on the post of Uttar Pradesh State
Information Commission has been challenged in the Supreme Court of
India, for it being a political appointment based on favoritism
accorded by ruling Samajwadi Party of Uttar Pradesh to an undeserving
Mr. Bisht.
We are bringing forth this case where freedom of expression, human
rights defenders and humanitarian law are under attack in India. This
is a case where authorities have harassed and intimidated RTI
activists and human rights defenders. That, the Uttar Pradesh State
Information Commissioner has arbitrarily got RTI activist thrown out
of hearing and devoid him of his Right to information,this kind of
intimidation leads to massive censorship on free flow of Information
to the citizen and when the flow of information is suppressed, the
people's Right to know, seek, obtain, receive and hold information is
grossly violated.
Government of Uttar Pradesh has been slow to address many areas of
concern, and has demonstrated what appears to be a more hard-line
attitude in some areas such as restrictions on freedom of expression.
There is a worsening pattern throughout 2014 of harassment,
intimidation and target threats against RTI activists cum human rights
defenders, many of whom have been forced into exile so far as their
use of Right to information is concerned.
We are requesting you to take appropriate actions to ensure that the
government of Uttar Pradesh should establish a transparent regime of
working in public life and ensure encouragement to RTI activists cum
Human Rights defenders with no more humiliation to them at all. We are
also requesting your good-self to look into this particular case of
Harassment of RTI activist & Human Right Defender by Uttar Pradesh
State Information Commissioner and to initiate inquiry and take
subsequent punitive action against the said perpetrator as per the law
of the land.
