An Open Letter to Sri Anna Hazare Smt Aruna Roy and Sri Manmohan Singh

Dear Sri Hazareji arunaji and Manmohanji,

Right now nation is in the grip of anti-corruption drive. This is nothing but the public anger against the system which is spilling out on the streets with media going into overdrive . Seemingly , the followers of honesty are full of unquestioning faith and euphoria, and they are swearing to die for honesty or we can say fight against corruption . To be successful in true sense , a drive should be based on truth , moral force , humility , non-violence , peace apart from it being subjective and compassionate .

There is dire need of a panel of expert in each constituency of parliament who should be well acquainted with the shortcomings of the government's version of Lokpal . They should be ready with a feasible alternative of each and every shortcoming . Its our duty to dispel any sort of ignorance / misinformation and imbibe moral force with humility in creating a change of heart of the target section of the society.

To get the good legislation through campaign, a more conciliatory approach shall be needed .Our aim is to make a dent in the problem of corruption and not to destabilize the parliament in any way. More focus should be on tight implementation of the key provisions of the legislation. We all are seeing the pathetic state of RTI act all across the nation and in each state because of the poor implementation of its key provisions.

In India Constitution is Supreme and is above Parliament .Courts in India have the authority to strike down laws passed by the parliament if the judiciary feels that the law goes against the basic principles of the Constitution of India .So Parliament is NOT Supreme in India. It is the Constitution of India which is Supreme and judiciary is established to ensure that both executive and legislative function without violating the principles of the Constitution. Keeping this in mind Higher judiciary should be out of ambit of Lokpal.

There is no provision for a referendum in the Constitution,but the statute doesn't explicitly bar them either. After all Public referendums are actually an integral part of any real democracy. Governments should do only what the people of the country want it to do. Some may say that it shall involve large amount of time and money but for an issue like corruption , this is immaterial. The government should hold a national public referendum across the country on the sticking points of the Lokpal and see what the people actually want on controversial points i.e. (i) Prime Minister should be under Lok Pal scanner even during his term in office. (ii) Judiciary, MLAs, MPs, bureaucrats, clerks, peons etc should all be under the same authority. (iii) Life imprisonment should be awarded for corruption (iv) appointment procedure of Lokpal members etc. Lokpal should be elected by whole of the nation . Eligibility for lokpal should also be decided by the referendum.

Pending any decision on referendum , Any of all the M.P.s who has a clear conscience should immediately introduce Jan Lokpal Bill as a private members bill. Then both the bills be referred to the Parliamentary standing committee which should get advice from experts,including those from Civil Society .The committees final view should be processed for further action as detailed herewith. After the outcome of the referendum , the result of the referendum should prevail.

We all know the process how a bill becomes an act . A Bill is the draft of a legislative proposal. It has to pass through various stages before it becomes an Act of Parliament. The initial stage is First Reading of the bill .

The legislative process starts with the introduction of a Bill in either House of Parliament-Lok Sabha or Rajya Sabha. A Bill can be introduced either by a Minister or by a private member. In the former case it is known as a Government Bill and in the latter case it is known as a Private Member's Bill.

It is necessary for a member-in-charge of the Bill to ask for leave to introduce the Bill. If leave is granted by the House, the Bill is introduced. This stage is known as the First Reading of the Bill. If the motion for leave to introduce a Bill is opposed, the Speaker may, in his discretion, allow brief explanatory statement to be made by the member who opposes the motion and the member-in-charge who moved the motion. Where a motion for leave to introduce a Bill is opposed on the ground that the Bill initiates legislation outside the legislative competence of the House, the Speaker may permit a full discussion thereon. Thereafter, the question is put to the vote of the House. However, the motion for leave to introduce a Finance Bill or an Appropriation Bill is forthwith put to the vote of the House.

After a Bill has been introduced, it is published in the Official Gazette. Even before introduction, a Bill might, with the permission of the Speaker, be published in the Gazette.

In such cases, leave to introduce the Bill in the House is not asked for and the Bill is straightaway introduced.

After a Bill has been introduced, Presiding Officer of the concerned House can refer the Bill to the concerned Standing Committee for examination and make report thereon.

If a Bill is referred to Standing Committee, the Committee shall consider the general principles and clauses of the Bill referred to them and make report thereon. The Committee can also take expert opinion or the public opinion who are interested in the measure. After the Bill has thus been considered, the Committee submits its report to the House. The report of the Committee, being of persuasive value shall be treated as considered advice given by the Committees.

The Second Reading consists of consideration of the Bill which is in two stages. The first stage consists of general discussion on the Bill as a whole when the principle underlying the Bill is discussed. At this stage it is open to the House to refer the Bill to a Select Committee of the House or a Joint Committee of the two Houses or to circulate it for the purpose of eliciting opinion thereon or to straightaway take it into consideration.

If a Bill is referred to a Select/Joint Committee, the Committee considers the Bill clause-by-clause just as the House does. Amendments can be moved to the various clauses by members of the Committee. The Committee can also take evidence of associations, public bodies or experts who are interested in the measure. After the Bill has thus been considered, the Committee submits its report to the House which considers the Bill again as reported by the Committee. If a Bill is circulated for the purpose of eliciting public opinion thereon, such opinions are obtained through the Governments of the States and Union Territories. Opinions so received are laid on the Table of the House and the next motion in regard to the Bill must be for its reference to a Select/Joint Committee. It is not ordinarily permissible at this stage to move the motion for consideration of the Bill.

The second stage of the Second Reading consists of clause-by-clause consideration of the Bill as introduced or as reported by Select/Joint Committee.

Discussion takes place on each clause of the Bill and amendments to clauses can be moved at this stage. Amendments to a clause have been moved but not withdrawn are put to the vote of the House before the relevant clause is disposed of by the House. The amendments become part of the Bill if they are accepted by a majority of members present and voting. After the clauses, the Schedules if any, clause 1, the Enacting Formula and the Long Title of the Bill have been adopted by the House, the Second Reading is deemed to be over.

Thereafter, the member-in-charge can move that the Bill be passed. This stage is known as the Third Reading of the Bill. At this stage the debate is confined to arguments either in support or rejection of the Bill without referring to the details thereof further than that are absolutely necessary. Only formal, verbal or consequential amendments are allowed to be moved at this stage. In passing an ordinary Bill, a simple majority of members present and voting is necessary. But in the case of a Bill to amend the Constitution, a majority of the total membership of the House and a majority of not less than two-thirds of the members present and voting is required in each House of Parliament.

After the Bill is passed by one House, it is sent to the other House for concurrence with a message to that effect, and there also it goes through the stages described above except the introduction stage.

Its not that only MPs/Ministers at Centre are Pro-Corruption . M.L.A.s / Ministers of State governments are even more corrupt . More or less , all politicians are corrupt irrespective of the party , they are with right now . With so many defections and changeovers like monkey-jumps no one is able to identify as to who started from where and passed through which passage. We are seeing the present only . As such there is no ideology of today's politicians. So, The need is to direct a movement against all M.P.s and M.L.A.s of all constituencies . As citizen of India it is our dharma to first question ourselves and then to all our leaders and hold them to high ethical standards. We cannot have high benchmarks of accountability for politicians, and no benchmarks for ourselves. So instead of sitting on dharnas against the central government , we should mobilize the people first to practice high ethical standards for themselves from the day and then shift their focus against the M.P. of their constituency not only to mount pressure on him to support the required Jan Lokpal Bill in Parliament but also to practice high ethical standards in all his future ventures. There should be an open demand that the fast shall not be broken until n unless there is a written commitment from the respective M.P. that he shall not only support the required Jan Lokpal Bill in Parliament but also practice high ethical standards in all his future ventures. Yes , anti defection law,party whip etc. etc. are there . We know many a cases where M.P.s have gone against party whip , have defected their parties for their own selfish motive so this time why can't they do this for the people of their own constituency. After all they are in Parliament because of them ( The people ) . If they do it once this time , maybe they shall be in parliament forever.

लखनऊ : आज लखनऊ के झूलेलाल पार्क में 11 से 4 तक भ्रष्टाचार के खिलाफ "
क्या आप भ्रष्टाचार की धनराशि को गिन सकते हैं ? " विषयक जनजागरण एवं
हस्ताक्षर अभियान का आयोजन श्वर्याज सेवा संस्थान लखनऊ के तत्वावधान में
किया गया | इस संस्था ने झूलेलाल पार्क धरना स्थल पर आने वाले सैकड़ों
लोगों को भ्रष्टाचार के खिलाफ जागरूक करने का कार्य किया |

अभियान में प्रतिभाग करने वाले कार्यकर्ताओं नें लोगों से भ्रष्टाचार के
खिलाफ लड़ने के तरीकों के बारे में विचार विमर्श भी किया | इस अवसर पर
लोगों को संस्थान द्वारा चलाये जा रहे भ्रष्टाचार विरोधी अभियान हेल्प
लाइन नंबर 9455553838 एवं सूचना का अधिकार हेल्प लाइन नंबर 8081898081 की
जानकारी दी गयी |

आशीष कुमार श्रीवास्तव ने कहा कि जब हममें से अधिकाँश इस धनराशि को गिन
भी नहीं पा रहे हैं तो सोचिये उन भ्रष्टों के बारे में जिन्हें यह पैसा
हमारे देश की गरीब जनता के हलक से निकालनें में तनिक भी संकोच नहीं हुआ
है | वहीँ येश्वर्याज सेवा संस्थान की सचिव उर्वशी शर्मा का कहना था कि
हम नागरिकों को यह जानने का हक है कि हमारा पैसा कहाँ जा रहा है|
उन्होनें सभी से यह संकल्प लेने को कहा कि वे जहाँ भी हों , न तो किसी का
भ्रष्ट आचरण सहें और न ही किसी प्रकार का भ्रष्ट आचरण करें तभी
भ्रष्टाचार क्रमशः समाप्त किया जा सकता है |

इस अवसर पर उर्वशी शर्मा , आशीष कुमार श्रीवास्तव , ऐश्वर्या शर्मा ,

अभियान में येश्वर्याज सेवा संस्थान एवं सेव कल्चरल वेल्यूज Foundation

खिलाफ लड़ने के तरीकों के बारे में विचार विमर्श भी किया | इस अवसर पर

8081898081 की जानकारी दी गयी |

येश्वर्याज सेवा संस्थान की सचिव उर्वशी शर्मा एवं सेव कल्चरल वेल्यूज
Foundation के सचिव आशीष कुमार श्रीवास्तव ने एक संयुक्त वक्तव्य में
कहा कि जब तक पंक्ति का अंतिम व्यक्ति अपने अधिकारों के प्रति जागरूक
होकर , अपने जैसे लोगों के साथ संगठित हो उन अधिकारों को पाने के लिए
ईमानदार एवं लोकतान्त्रिक तरीके से प्रयास नहीं करता है , भ्रष्टाचार
पर काबू पाना असंभव है |

अभियान के दौरान एक प्रपत्र वितरित किया गया जिस पर स्वतंत्रता के बाद
हुए बिभिन्न घोटालों की धनराशि का विवरण एवं कुल धनराशि रुपये
910603234300000/- अंकित थी |अधिकाँश लोग इस धनराशि को पढ भी नहीं पा रहे
थे |

इसके सम्बन्ध में विचार व्यक्त करते हुए सेव कल्चरल वेल्यूज Foundation
के सचिव आशीष कुमार श्रीवास्तव ने कहा कि जब हममें से अधिकाँश इस
धनराशि को गिन भी नहीं पा रहे हैं तो सोचिये उन भ्रष्टों के बारे में
जिन्हें यह पैसा हमारे देश की गरीब जनता के हलक से निकालनें में तनिक भी
संकोच नहीं हुआ है | वहीँ येश्वर्याज सेवा संस्थान की सचिव उर्वशी शर्मा
का कहना था कि हम नागरिकों को यह जानने का हक है कि हमारा पैसा कहाँ जा
रहा है| उन्होनें सभी से यह संकल्प लेने को कहा कि वे जहाँ भी हों , न
तो किसी का भ्रष्ट आचरण सहें और न ही किसी प्रकार का भ्रष्ट आचरण करें ,
तभी भ्रष्टाचार क्रमशः समाप्त किया जा सकता है |

1945 में द्वितीय विश्व युद्ध के अंतिम चरण के दौरान, संयुक्त राज्य
अमेरिका ने जापान में हिरोशिमा और नागासाकी के शहरों के खिलाफ दो परमाणु
बम विस्फोट, 6 अगस्त, 1945 को पहली और 9 अगस्त, 1945 को दूसरी बार प्रयोग
किया | यह दो घटनाएँ ही युद्ध इतिहास में परमाणु हथियारों के प्रयोग
की एकमात्र घटनाएँ हैं परन्तु परमाणु बम की असीम ताक़त के पीछे भागते
देशों की अंधी दौड़ ने संसार को एक ऐसे विन्दु पर लाकर छोड़ दिया है कि
यदि अब युद्ध हुआ तो इस धरती पर जीवन पल भर में समाप्त हो जायेगा और
युद्ध हे बाद जीवन की संभावनाएँ भी नगण्य भर रह जाएँगी |
हिरोशिमा परमाणु बम आपदा के बाद यह एक प्रमुख प्रश्न है कि क्या हमारे
देश को भी परमाणु अस्त्रों को इकट्ठा करने की अंधी दौड़ में शामिल होना
चाहिए अथवा अंतर्राष्ट्रीय परिद्रश्य में देश की वर्तमान परमाणु नीति
को लेकर पुनर्विचार की आवश्यकता है ?आज की संगोष्ठी इसी विषय को लेकर
आयोजित की गयी थी |

परमाणु शक्ति का प्रयोग बिजली बनाने में भी हो रहा है | .परमाणु शक्ति
भारत में चौथा सबसे बड़ा बिजली का स्रोत है | आईटीईआर परियोजना में
अपनी भागीदारी के माध्यम से परमाणु संलयन रिएक्टरों और थोरियम आधारित
फास्ट ब्रीडर रिएक्टरों के विकास में भारत विश्व में अपनी एक पहचान बनाता
जा रहा है | किन्तु जापानी परमाणु आपदा के बाद यह एक प्रमुख प्रश्न है
कि क्या हमारे देश को भी परमाणु विद्युत परियोजनायों को लेकर पुनर्विचार
की आवश्यकता है ?आज की संगोष्ठी में इस विषय पर भी परिचर्चा की गयी |
साथ ही बिजली उत्पादन के अन्य ऐसे श्रोतों पर भी परिचर्चा हुई जो परमाणु
उर्जा का विकल्प बन सकें |

संगोष्ठी में बड़ी संख्या में लखनऊ के प्रबुद्ध जनमानस एवं समाजसेवियो ने
प्रतिभाग किया |

संगोष्ठी का आरम्भ करते हुए प्रसिद्ध समाजसेविका और येश्वर्याज सेवा
संस्थान की सचिव उर्वशी शर्मा ने कहा कि भारत के पास बिभिन्न परमाणु
हथियार हैं जिनमें लघु और मध्यम दूरी के बैलिस्टिक मिसाइलों, परमाणु
सक्षम विमान, सतह जहाजों, और पनडुब्बियों आदि हैं | हालांकि भारत ने
अपने परमाणु शस्त्रागार के आकार के बारे में कोई आधिकारिक बयान नहीं किया
है, हाल के अनुमान बताते हैं कि भारत के बीच 80 और 100 परमाणु हथियार हैं
| भारत के सामरिक परमाणु कमान को औपचारिक रूप से 2003 में स्थापित किया
गया था |संयुक्त सेवाएँ SNC भारत के परमाणु हथियार मिसाइलें और परमाणु
संपत्ति के संरक्षक है | यह भारत की परमाणु नीति के सभी पहलुओं को
क्रियान्वित करने के लिए जिम्मेदार है | हालांकि, सीसीएस के रूप में
नागरिक नेतृत्व, (सुरक्षा पर कैबिनेट समिति) एकमात्र संस्था है जो
परिस्थितियों के अनुसार एक परमाणु हमले का आदेश करने के लिए अधिकृत:
हैं | इस प्रकार भारत का परमाणु बटन प्रधानमंत्री के नियंत्रण में
ही है | उर्वशी ने प्रधानमंत्री से अपील की कि अब समय आ गया है जब भारत
को आगे आकर अंतर्राष्ट्रीय पटल पर परमाणु निरस्त्रीकरण के लिए सार्थक
प्रयास करने चाहिए |

प्रसिद्द समाजसेवी और सेव कल्चुरल values foundation के सचिव आशीष कुमार
श्रीवास्तव नें चर्चा को आगे बढ़ाते हुए सभा के सम्मुख यह तथ्य रखा कि
यधपि हथियार कार्यक्रम के लिए इस्तेमाल यूरेनियम को ऊर्जा कार्यक्रम से
अलग किया गया है तथापि उर्जा उत्पादन के लिए चल रहे संयंत्रो में समय समय
पर होने बाली दुर्घटनाएं समस्त मानव जाति के लिए खतरा हैं | उन्होंने
कहा कि परमाणु विकिरण मानव द्वारा बनायीं गयी भौगौलिक सीमाओं को नहीं
मानता और दुर्घटना होने पर निर्बाध रूप से सम्पूर्ण विश्व में फेलता है
| उन्होंने कुछ उदाहरण देते हुए बताया कि अमेरिकी विश्वविद्यालय में
शोधकर्ताओं ने 1993 और 1995 के बीच भारत में परमाणु संयंत्रों पर कम से
कम 124 "खतरनाक घटनाओं" गणना की थी | Fukushima आपदा के बाद आज देश की
सभी परमाणु विद्युत परियोजनाएं चिंता का विषय हैं | उन्होनें परमाणु
उर्जा के प्रयोग के स्थान पर उर्जा के वैकल्पिक साधनों के प्रयोग पर बल
दिया |

परिचर्चा में भाग लेते हुए अन्य वक्ताओं ने बिचार रखे कि हमारे पास
हवा, सूर्य, और बायोमास जैसे तीन अक्षय ऊर्जा श्रोत है | हमारे पास
धूप, हवा, बारिश, ज्वार, और धरती के गर्भ की गर्मी है, जो अक्षय हैं और
प्राकृतिक संसाधनों से आता है | अक्षय ऊर्जा जीवाश्म ईंधन और परमाणु
ऊर्जा के लिए एक विकल्प है | संगोष्ठी में परमाणु meltdowns और
Fukushima में (2011) परमाणु दुर्घटना, तीन माइल आइलैंड दुर्घटना (1979)
और चेरनोबिल आपदा (1986) जैसे अन्य रिएक्टर दुर्घटनाओं पर सामूहिक चिंता
व्यक्त की गयी | संगोष्ठी में इस तथ्य पर भी चिंता व्यक्त की गयी कि
कोयला और पनबिजली विद्युत उत्पादन कि तुलना में परमाणु बिजली उत्पादन
में प्रति यूनिट अधिक लोगों की मृत्यु का आकलन किया गया है | संगोष्ठी
में रेडियोधर्मी कचरे के भंडारण की समस्याओं पर भी चर्चा हुई|

संगोष्ठी में बिहार के प्रसिद्ध समाजसेवी सरफराज अहमद - प्रबंध निदेशक अल
खेर सोसाइटी , बिहार के प्रसिद्ध समाजसेवी मोहम्मद फरीदी , झारखण्ड के
प्रसिद्ध समाजसेवी मनोज चौबे , धर्मेन्द्र , अजय , प्रतापगढ़ के प्रसिद्ध
समाजसेवी सुशील , सेव कल्चुरल values foundation लखनऊ और येश्वर्याज
सेवा संस्थान लखनऊ के सदस्यों के साथ बड़ी संख्या में लखनऊ के प्रबुद्ध

थर्मल, पनबिजली और नवीकरणीय स्रोतों के बाद ही यह बिजली का स्रोत है |
भारत में छह परमाणु ऊर्जा संयंत्रों के 20 परमाणु रिएक्टर ४७८० मेगावाट
पैदा करते हैं जबकि अन्य संयंत्रों के निर्माण के पश्चात अतिरिक्त 2720
मेगावाट उत्पन्न होने की उम्मीद है| भारत में घरेलू यूरेनियम भंडार छोटे
हैं और देश को यूरेनियम के आयात पर निर्भर रहना पड़ता है | 1990 के दशक
के बाद से, रूस भारत को परमाणु ईंधन का एक प्रमुख आपूर्तिकर्ता था |
घरेलू यूरेनियम भंडार घटने के कारण भारत में परमाणु ऊर्जा से बिजली
उत्पादन में 2006 से 2008 12.83%तक गिरावट आई | सितम्बर 2008 में भारत
ने कई अन्य देशों के साथ असैनिक परमाणु ऊर्जा प्रौद्योगिकी सहयोग पर
द्विपक्षीय सौदों पर हस्ताक्षर किए हैं | 2032 तक ६४,००० मेगावाट परमाणु
बिजली उत्पादन में वृद्धि करने की योजना के साथ भारत का परमाणु ऊर्जा
उद्योग तेजी से विस्तार के दौर से गुजर रहा है | आईटीईआर परियोजना में
अपनी भागीदारी के माध्यम से परमाणु संलयन रिएक्टरों और थोरियम आधारित

Lucknow: Any query regarding the utilisation of Central funds released
for digitalisation of its records (to make data available online) is
apparently enough to put the state information commission on the
defensive. When the UPSIC was asked under the RTI what it did with the
money, it simply said it did not get the question.
In response to a query put up by an applicant, Urvashi Sharma,
under the Right To Information Act, the department of Personnel and
Training (DoPT), New Delhi, said it had allocated Rs 21 lakh to the
commission for digitalisation. But, it is yet to receive any
utilisation certificate from the state commission for the amount
released. Next, the applicant asked the commission about the funds.
The public information officer, UPSIC, said that the commission is yet
to start the digitalisation of records. However, when asked about the
financial aid given by the Central and state government, and work
undertaken by the commission to put the funds to intended use, the PIO
evaded the question and said it is not clear what the applicant wants
to know.
Notably, the UPSIC has entered its sixth year of functioning on
March 22, 2011. In all these years, the commission has not been able
to compile the orders passed by it.
Also, it does not have data on number of orders passed by different
information commissioners. But, the UPSIC officials have claimed time
and again that digitalisation process is on.

UPSIC invents yet another draconian procedure to harass info-seekers

Do you want to deposit second appeals in the office of Uttar Pradesh
State Information Commission ? Beware ! You are sure to be entangled
in UPSIC's self-proclaimed draconian procedure that compels you to
first get your appeals marked by the Secretary of the information
commission , only then the clerk shall receive your application and
give you a receipt.

The receipt counter is open upto 2 P.M. only , the time when the
secretary of UPSIC can be seen seated with the PIOs ( read Public
Servants ) and so , barring few daring info-seekers/activists , all
are not able to reach the secretary and get their appeals marked .
Many of them are forced to grease the palms of the clerks at receipt
counter to get their appeals received .

Going by the letter & spirit of the RTI Act 2005 , this process
should be as easy as one can ever think of , but in reality the
process is being made as cumbersome as possible so that the
info-seekers are a demoralized lot as soon as they enter the UPSIC .

When enquired deeply , I came to know that there is no such written
order of any competent authority of UPSIC or the Government but only
verbal understanding of UPSIC officials to carryon the draconian
procedure to demoralize the info seeker in any possible way .

In Uttar Pradesh, the watchdog of transparency is too shy to be
transparent enough to disclose the details of funds received by it
from the Central Government .

The Central Government released funds under centrally sponsored scheme
for digitalization of various State Information Commissions with the
precondition that the money could only be spent on digitalization and
no hardware could be purchased out of this grant. Uttar Pradesh State
Information Commissions got Rs. 21 Lakhs from Centre. This was
revealed by Ministry of Personnel , Public Grievances and Pensions in
a RTI reply . " Rs. 21 Lakhs have been allocated to the state of Uttar
Pradesh for IT enablement " reads the reply of D.O.P.T. The issue was
raised by Secretary of Lucknow based Social Group YAISHWARYAJ Seva
Sansthan.

The U.P.S.I.C. received 2.1 million rupees in the name of the
computerization of the Information Commission but it has refused to
divulge details. Uploading of Information Commissioners' orders on
Commission's website could not be started yet. The failure to do so is
highly irresponsible act of officials of commission .

Public Information Officer Mata Prasad had admitted in a written
response sent to the Secretary of Lucknow based Social Group
YAISHWARYAJ Seva Sansthan that they have not started action so far and
also that no single official can be held responsible for failure of
U.P.S.I.C. to upload its orders on the website .

The RTI reply has other dark facts like there is no record of interim
orders of information commissioners and orders are not available in
digital form at all .

" We have written to the Governor of Uttar Pradesh to intervene and
take action as the situation is highly undesirable and detrimental to
the RTI act in Uttar Pradesh " said Vishnu Dutt Mishra , the treasurer
of YAISHWARYAJ.

लखनऊ। सीआईसी रणजीत सिंह पंकज की मनमानियां बदस्तूर जारी हैं। अब तो वह
आयोग को मिलने वाले खर्चो का हिसाब-किताब भी देने से कतराने लगे हैं।
केंद्र सरकार द्वारा कम्प्यूटरीकरण के नाम पर मिले 21 लाख रुपयों के खर्च
होने का ब्यौरा देने से ही सूचना आयोग ने इनकार कर दिया है। सरकार के
वफादार सिपाही की तरह वे अफसरों को बचाने के लिए अब अर्थदंड के मानदंड भी
बदलने लगे हैं। आयोग की लीपापोती वाली कार्यशैली से तमाम विभागों के अफसर
सूचना देने के नाम पर लाखों रुपए मांगने लगे हैं।

राज्य सूचना आयोग में कम्प्यूटरीकरण के नाम पर लाखों के वारे-न्यारे हो
चुके हैं। मगर सूचना आयुक्तों द्वारा परित आदेशों को आयोग की वेबसाइट पर
अपलोड करने की कार्यवाही अभी तक शुरू नहीं की जा सकी है। इस विफलता की
कोई जिम्मेदारी इसलिए नहीं ले रहा है क्योंकि कम्प्यूटरीकरण के मद में
मिले लाखों रुपयों का कहीं अता-पता ही नहीं है। आरटीआई ऐक्टिविस्ट उर्वशी
शर्मा ने सूचना का अधिकार के तहत आयोग के जनसूचना अधिकारी से पूछा था कि
राज्य सूचना आयोग के आदेशों को डिजिटल रूप में परिवर्तित कर संरक्षित
करने के लिए केंद्र व राज्य सरकार ने कितना धन मुहैया कराया है? आयोग के
आदेशों को वेबसाइट पर अपलोड न करने के लिए जिम्मेदार अधिकारी के नाम व
पदनाम की सूचना प्रदान करें। जनसूचना अधिकारी माता प्रसाद ने उर्वशी
शर्मा को भेजे जवाब में लिखा है कि सूचना आयोग में आयोग द्वारा धारित
आदेशों को वेबसाइट पर अपलोड करने की कार्यवाही अभी तक प्रारम्भ नहीं हो
पाई है। वेबसाइट पर अपलोड न करने के लिए किसी एक अधिकारी को उत्तरदायी
नहीं ठहराया जा सकता है। आयोग द्वारा पारित आदेशों को वेबसाइट पर अपलोड
किए जाने की प्रकिया चल रही है। यह कितना हास्यास्पद है कि आयोग में ही
सूचना के कानून की मंशा को रौंदा जा रहा है। केंद्र सरकार ने जिस मद के
लिए पैसा भेजा था उस पर कितना काम हुआ और कितना पैसा खर्च हुआ तथा आयोग
में कम्प्यूटरीकरण न होने के लिए कौन जिम्मेदार है, यह न बताना आयोग के
लिए नितांत शर्मनाक है।

सबसे हैरत करने वाली बात तो यह है कि आयोग के पास सूचना आयुक्तों द्वारा
पारित अंतरिम आदेशों का विवरण भी नहीं है। दूसरे मुख्य सूचना आयुक्त की
कुर्सी पर बैठे रणजीत सिंह पंकज सरकार के खिलाफ सरकार के वफादार सिपाही
जैसा काम करने का आरोप लगने लगा है। होमगार्डस मुख्यालय संबंधी एक मामले
में आवेदनकर्ता सलीम बेग का कहना है कि पंकज आदेश लिखाते समय कहीं भी
जिक्र नहीं करते कि जुर्माना 250 रुपए के हिसाब से कितने दिन का लगा रहे
हैं? नियमानुसार 25 हजार रुपए जुर्माना है। बेग का कहना है कि अगर सूचना
मांगने के दिन से विलंब 100 दिन का होता है तो 25 हजार रुपए जुर्माने की
धनराशि वसूली जाती है।कम्प्यूटरीकरण के नाम पर मिले पैसों का आयोग नहीं

MAID IN INDIA

India has just signed a UN convention to give new rights to its 4.75 million maids. How will this affect the middle class? And how will the new guidelines work on the ground, asks Saira Kurup

    Given a choice, Sapna Maudgal would rather do without her full-time maid. But holding daytime jobs, the techie and her doctor husband have little choice but to depend on Neelima, 20, to take care of their six-year-old daughter and the house. "We had to pay Rs 20,000 to the agency as registration, and her salary is Rs 3,500. That's quite a sum for us, and she's not that well-trained too," says Sapna.

    Neelima might be having a relatively safe working environment, but lakhs of others in the country, mostly women, sweep and swab in the domestic space, sometimes for long hours and in abusive environments. In India, official estimates talk of 4.75 million workers employed in private

households. NGO estimates point to up to 20% of the total workforce in India being employed in domestic work and that one-fifth of them are working full-time.

    It's for improving the lot of this large vulnerable section that India and 469 other countries signed a convention in Geneva recently under the aegis of the International Labor Organization. The convention requires governments to bring domestic workers within the ambit of labour legislations on minimum wage, working hours, day of rest in a week, overtime wages, terms of employment, social security, and maternity protection. It also contains detailed requirements for governments to regulate private employment agencies, investigate complaints and lays down special measures for migrant workers.

    But how would it be implemented? Would employers be willing to see them as "workers" and not "servants" or even "family members" who are at their beck and call 24x7? Who would regulate the working conditions of a part-time worker who works, say, five houses in a day? Ravi Wig, president of the Employers Federation of India, who was the only Indian representative to vote against the convention in Geneva, says, "I think the first requirement is employment generation in a country where 25 crore people are unemployed. The best social security is to give a man a job. Also, imagine that you are at work, your mother is alone at home, and an inspector from the labour department comes to check the working conditions of the domestic worker. I felt it was premature."

    That invasion of the private space is probably what's spooking employers. Father Jose Vattakuzhy, secretary of the commission for labour of the Catholic Bishops Conference of India, which is helping the government in the drafting a national policy on domestic workers, says, "They feel that when we standardize domestic work, our homes will become the workplace." He adds that employers had been opposing the extension of the Rashtriya Swasthya Bima Yojana to domestic workers, but he's happy now that the government has done the needful.

    Not all employers share such reservations. Delhi homemaker Vimala Prasad says, "Domestic workers are likely to give their 100% only when they know that they are being taken care of." Some years ago, says Vimala, her husband bought life insurance policies for the full-time maid and her child, and even paid the premium during the time she worked for them.

    Activists are hoping that more such employers show see their domestic helps as workers and less as "kaamwali" and "naukrani". Sister Christy, national coordinator of the National Domestic Workers' Movement that is campaigning for dignity in domestic work, says, "Domestic workers are not included in the Minimum Wage Schedule; there are no welfare boards for them in many states and they are deprived of social security. We have a long way to go to achieve the aim of dignifying domestic work. The government should take responsibility to give social security, pension, define working hours, and introduce a comprehensive legislation."

    But official attempts at establishing equity have been lethargic. "It's three years since Maharashtra passed the Domestic Workers Welfare Board Act, but the board has not started functioning. It's not been decided who would be the members. We get promises but nothing concrete has been done," says Sister Christy. Some states like Kerala and Tamil Nadu have either included domestic workers in the minimum wage schedule or included them in social security schemes etc, but that's simply too little.

    Baijnath Rai, general secretary of the Bharatiya Mazdoor Sangh, who was the Indian representative of workers at the Geneva meet, points out, "Even if the government ratifies the convention fast, it would take the law at least a year-and-a-half to come into effect. Just think, of the 188 conventions India has ratified, it has implemented only 43 so far."

    However, more than any number of laws, it would be the attitudinal change that's urgent. Sapna Maudgal is not too happy about the fixed hours of work or the overtime wages clause. But the representative of a placement agency in Gurgaon that provides domestic workers to expats, diplomats and the upper middle class, is optimistic: "Some clients might even consider giving health benefits if it's economically viable. Already, many clients are sending their cooks to culinary classes to upgrade their skills." Isn't charity, after all, expected to begin at home?

AND WHAT ABOUT THOSE ABROAD?

    The lure of fat salaries and a good life take a number of Indian domestic workers abroad, to work for Indian families there. Many a time, it's a happy arrangement for both parties. But there are also whispers about abuse and harassment of workers which often go unreported. And, sometimes, these cases make headlines as with Prabhu Dayal, the Indian consul-general in New York, who has been accused of forced labour and harassment.

    "The laws are weak" to handle such cases, says human rights activist and advocate Asim Sarode. He cites the 2008 case of a domestic worker Kalpana Salunke who was working for a Indian couple in Spain. "She faced a lot of abuse by the male employer and a Spanish friend of his. Her hands were tied behind her back and she was given electric shocks. That's when she ran away," Sarode says. Salunke tried to file a case with the Spanish police, but it being a Friday evening, with the police stations reportedly closed for the weekend, she could not do so. Her employers, on coming to know that she had taken refuge in an Indian club, came and immediately put her on a flight to India. "We have sent complaints to the Spanish police but the family is absconding since then. Now we have filed a complaint with the CBI and are planning to approach the Supreme Court,"

    says Sarode.

    At the national level, activists have been protesting the exclusion of domestic workers from the purview of the sexual harassment in the workplace Bill, meant for protection of women. Father Jose Vattakuzhy, secretary of the Catholic Bishops' Conference of India's commission for labour, says, "It's a sad thing. Our worker representatives have met Sonia Gandhi and spoken to her about it." Urvashi Sharma, president of Lucknow-based group Yaishwaryaj, has been running an online campaign for the inclusion of domestic workers in the Bill. She says, "One of the objections being made is that some of the harassment cases by domestic workers are false – how would we deal with them? But even in the genuine cases, there's little action. Mostly, the worker is asked to reach a compromise."

LUCKNOW: The UP State Information Commission (UPSIC) is getting a new
incumbent and this time a woman. The notification declaring the
appointment of Khadijatul Kubra as the new Information Commissioner
(IC) reached UPSIC on Tuesday.

The commission has 10 ICs. A post got vacant after the retirement of
Gyanendra Sharma early this year.

Though curtains are down on who will be the new IC, but yet there is
no information regarding Kubras educational background.

The notification introduces Kubra as the wife of MJ Akhtar, media
advisor to the chief minister.

When asked about the background of the new incumbent, Yogendra Singh,
secretary, UPSIC, said, we only have this single line notification and
can not say anything more on this.

The state chief information commissioner and information commissioner
are appointed by the governor on the recommendation of a committee
consisting of the chief minister (who is also the chairperson), leader
of opposition in legislative assembly and a cabinet minister to be
nominated by the chief minister.

However, Governor Office could not reveal much about the new
appointee. While the information officer was not available for
comment, GB Patnaik, principal secretary, governor, could not be
contacted despite repeated attempts.

The staff at his office, however, denied that any information on the
new ICs educational and professional background was available at the
office. Any information on this will only be available with the
government, said the staff at Governor Office.

The RTI Act clearly defines the eligibility norms for state chief
information commissioner and information commissioners. The ICs shall
be persons of eminence in public life with wide knowledge and
experience in law, science and technology, social service, management,
journalism, mass media or administration and governance ".

When will the new IC take oath is also not known. "We are trying to
call her up but could not speak to her," said secretary, UPSIC. The
RTI activists in UP, on the other hand, have sent a memorandum to the
governor. We want the appointment of ICs to be a fair procedure, said
activist Urvashi Sharma.

Minister of Uttar Pradesh .

" The Uttar Pradesh Government's move is unconstitutional and the whole
process needs to be stalled at once.Time and again , YAISHWARYAJ has
raised its demands of fair appointments of information commissioners
as per the letter & spirit
of the RTI act 2005 . " reads the Memorandum.

The procedure , eligibility norms etc. for appointments of information
commissioners have been laid down in Chapter IV of RTI Act 2005 .

Subsection 3 of Section 15 states about the appointing authority etc."
The State Chief Information Commissioner and the State Information
Commissioners shall be appointed by the Governor on the recommendation
of a committee consisting of—
(i) the Chief Minister, who shall be the Chairperson of the committee;

(ii) the Leader of Opposition in the Legislative Assembly; and
(iii) a Cabinet Ministrer to be nominated by the Chief Minister.
Explanation.—For the purposes of removal of doubts, it is hereby
declared that where the Leader of Opposition in the Legislative
Assembly has not been recognised as such, the Leader of the single
largest group in opposition of the Government in the Legislative
Assembly shall be deemed to be the Leader of Opposition "

Subsection 5 of section 15 further states the eligibility norms " The
State Chief Information Commissioner and the State Information
Commissioners shall be persons of eminence in public life with wide
knowledge and experience in law, science and technology, social
service, management, journalism, mass media or administration and
governance "

Expressing over the memorandum , Prabhuta , one of the members of the
group YAISHWARYAJ said that The spirit of the act is that all members
of the committee should necessarily take part in the process of
appointment and should note
down their views on each and every aspect. This is not being followed
in most of the appointments. Such appointments are ab-initio-void and
needs to be scrapped.

Further , the act emphasizes the word " Appointment " and not "
Nomination " . The procedure adopted so far is clearly the nomination
and not the appointment. Appointment means appointment after giving
fair chance to all eligible citizens in consonance to article 14 & 16
of the Constitution of INDIA and then selecting and appointing the
best as per the procedure and norms laid down in the advertisement by
the state government.

Wayback , we have sent memorandums on this issue to the authorities of
the state including the governor which are pending for action with
the Government of Uttar Pradesh and the Government is going to make
another arbitrary nomination of
information commissioner without any advertisement for appointment.
This is illegal and shows dubious intentions of state government with
respect to RTI implementation so YAISHWARYAJ has again requested the
governor to stall this unconstitutional process at once and forever
and strive for ways to ensure fair appointment on the said post.

Members of YAISHWARYAJ alongwith other RTI activists of Uttar Pradesh
also demanded time to meet and apprise the Governor the long pending issue of
fair appointments of information commissioners as per the letter and
spirit of RTI ACT 2005 and many other issues over which the Government
of Uttar Pradesh seems to be intentionally acting against the ACT.

Dear all Citizens of India ,

We all know that the Joint Drafting Committee on the Lokpal Bill has
deferred the question of including the office of the Prime Minister
and the higher judiciary to be discussed later . The Joint Drafting
Committee proposes to draft the said bill by June 30.

YAISHWARYAJ is at your doorsteps once again . This time we are before
you with the simplest of the pledges of being the part of the direct
democracy i.e. an initiative / a proposition . Through this
initiative/proposition , YAISHWARYAJ is asking for your opinion as to
whether the Prime Minister and the Judiciary should be within the
purview of LOKPAL or not . All you have to do is just to opine for or
against the said proposal by writing Yes or No. Of course Your

Lucknow: Action speaks louder than words but not for UP State
Information Commission (UPSIC) which believes in pronouncing
hard-hitting orders and acting little on them. The fact that UPSIC so
far has recovered only 1% of the total fine imposed on government
departments for not keeping up with the RTI Act lends strength to the
claim.

The cases where PIO either refuses to accept the application for
information or knowingly gives misleading, incorrect or incomplete
information or does not provide information within the given 30 days,
the commission slaps a fine of Rs 250 per day for the days till the
application is received and information is given. The maximum penalty
is Rs 25,000.

The UPSIC has slapped a total fine of Rs 53,63,500 since October
2006 (the time it started functioning) till February 2011 but the
recovery is as low as 1%. Rs 62,500 recovered as fine from the erring
government departments is a pittance compared to the total amount.
Penalising government departments is a last possible action taken by
the central and state information commissions to make the public
information officers (PIOs) act promptly on RTI applications. However,
leniency exhibited by the UPSIC for government departments does not
augur well for RTI implementation in the state where it is already
marred by official apathy.

An RTI applicant, Salim Baig, had asked the administrative reforms
department (ARD), the nodal department for implementation of RTI in
UP, about the amount of fine imposed on and recovered from the
government departments for acting sluggish on RTI front by the UPSIC.
The commission has penalised 30 departments in 231 pending cases till
February 2011. The fine, hence collected, goes to the state treasury.

in the last meeting of the joint drafting committee on the anti-graft
Lokpal Bill ,which comprises of five central ministers and five
representatives of the civil society ,reports are that there was a
deadlock in the talks or they had broken down on the issue of
inclusion of prime minister and higher judiciary within the ambit of
proposed lokpal.

Even the government has sent letters to their sect containing
questions on several issues including: whether the prime minister and
the higher judiciary should be brought under the purview of the
Lokpal.
