खुलकर टैक्स चोरी कर रहे फोटो व्यवसायी : शिकायत प्रेषित

प्रिय मित्र ,

फोटो व्यवसायियों द्वारा खुलकर टैक्स चोरी करने के मामले में मैंने सेवा
कर के महानिदेशक, उत्पाद शुल्क और सेवा कर के आयुक्त ,वाणिज्यिक कर विभाग
के अधिकारियों समेत देश और प्रदेश के नीति नियंताओं को भी शिकायत
प्रेषित कर कार्यवाही करने की मांग की है l


दरअसल रक्षाबंधन पर मेरी बेटी ने रिटर्न गिफ्ट के रूप में हमसे फोटो
स्टूडियो में चलकर फैमिली फोटो खिंचाने को कहा l हम सभी ने राजाजीपुरम ई
ब्लॉक स्थित 'प्रेम कलर लैब एण्ड स्टूडियो' पर जाकर 6 फोटो खिंचाई और
मेरी बेटी ने 40 रुपये प्रति फोटो की दर से 240 रुपये और 10 रुपये प्रति
सॉफ्ट कॉपी की दर से 60 रुपये प्रेम कलर लैब एण्ड स्टूडियो के काउंटर पर
बैठे व्यक्ति को दे दिए l रसीद के नाम पर जब हमें एक पर्ची दी गयी जिस पर
किसी प्रकार के टैक्स आदि का अंकन नहीं था तो हमने पक्की रसीद की मांग की
l काउंटर पर बैठे व्यक्ति द्वारा भांति-भांति के बहाने बनाये गए और अंत
में कहा गया कि अभी रसीद बुक नहीं है और फोटो देते समय ही पक्की रसीद
देने का आश्वासन दिया गया l

कल शनिवार शाम मैं और मेरे पति फोटो और रसीद लेने गए l हमको फोटो और
सॉफ्ट कॉपीयाँ तो दे दी गयीं किन्तु पक्की रसीद नहीं दी गयी l जब हमने
इसकी शिकायत अधिकारियों से करने की बात कही तो प्रेम कलर लैब एण्ड
स्टूडियो पर बैठे लोग गुंडागर्दी पर उत्तर आये और बोले कि पक्की रसीद
नहीं मिलेगी, जहाँ चाहो शिकायत कर लो l प्रेम कलर लैब एण्ड स्टूडियो का
मालिक जैसा दिखने बाले व्यक्ति ने कहा कि उसके कई नेताओं और आईएएस
अधिकारियों से घरेलू सम्बन्ध है और वह अधिकारियों को लगातार घूस खिलाता
रहता है l उसने यह भी कहा कि उसके स्टूडियो पर छापा पद ही नहीं सकता है
l उसने कहा कि वह ही नहीं लखनऊ का कोई भी फोटो स्टूडियो पक्का बिल नहीं
देता है l

मेरे अनुसार इस प्रकार की टैक्स चोरी करने बाले व्यवसायी देशद्रोही हैं
और इनको कडा दंड मिलना ही चाहिए अतः मैंने लखनऊ परिक्षेत्र के सभी फोटो
स्टूडियो पर छापा मारकर इन टैक्स चोरो को दण्डित करने की मांग की है l

OWNERS OPERATING IN LUCKNOW REGION

Dear Sir,
I want to draw your kind attention towards the following incidence
where huge sales services are being done by certain photographers and
photo-shops without paying mandatory Sales Tax ,Value Added Tax and
Service Tax.


On 10th August 2014 My daughter thought to give a return gift to all
of us in the form of studio shot snaps by taking us to a Photo shop
named Prem Color Lab and Studio. There six snaps were taken by the
service provider and my daughter paid 240 rupees for 6 snaps and 60
rupees for soft copies of these snaps. We asked the shopkeeper to give
us a valid receipt but he declined and instead gave us a bogus receipt
bearing no. 5718 scanned copy of both sides of which are attached.
When we insisted on issuing of a valid receipt, owner of shop asked to
give us the one at the time of delivery of snaps.


Today ( Saturday ) evening, I and my husband went to the said shop to
take the snaps. Though shopkeeper gave photos and soft copies to us
but when we insisted on a valid receipt, he declined.


All staff and owners gathered and pressurized us not to insist on a
receipt. When my husband said that he shall go to authorities to make
a formal complaint, the owner said that they were continuously
greasing the palms of the authorities concerned through their union
and none of the photographer around Lucknow issue any formal receipt
for their sales and services.


To best of the knowledge above named shop owners are hardcore
criminals and they run a racket in Lucknow and had been making various
sales of illegally imported cameras and providing photography
services without paying sales tax, Service and VAT to the Government.


Evading Sales Tax, Service and VAT is not a good practice on their
part and leads to corruption practice, revenue loss to State
Government and Republic of India.


My prayer to you is to Conduct the raid and seize the book of
accounts of above named shop owners, Investigate the matter and
recover the evaded tax, Penalize the shop owners for malpractice and
tax evasion as per the state rules, Verify the authenticity of the
bills issued by the above mentioned shop owners.

I may be given the due prize money as per state guidelines for
revealing this to the authorities.


I would also like to request that the acknowledgement for receipt of
this complaint and the name of investigating officer be provided to me
who will be looking in this matter, as there is every apprehension
that the information provided to me will be misleading due to
political pressure and bureaucratic contacts of shop owners.


I request you to kindly take cognizance of my complaint and verify the
sales and services and initiate action against above mentioned shop
owners for tax evasion if any.

Did you know there is actually a difference between Mahjong (also spelled mahjongg, mah-jong, or mah-jongg) and Mahjong Solitaire? Mahjong is actually a 4 player game involving skill, strategy, calculation, and luck; while Mahjong solitaire is a tile matching, single player game.

‘Mah-jong’ can be translated from Chinese as ‘clattering sparrow’, ‘flax sparrow’ or possibly as ‘hemp bird’. The tiles when shuffled make a melodious noise reminiscent of the noise of numerous sparrows squabbling over scattered food crumbs.

Since many of us are addicted to this little game, I thought I’d put it up here in case we are ever away from our computer but have access to an Internet connection that way we can hustle on over here and get a fix! (Get to it already!)
How to Play

The goal is to clear the board by removing all the tiles from the layout. Layouts can differ in pattern, size and height. There exist hundreds of different layouts. You must remove the tiles in pairs. A pair consists of two tiles which both are a) “free” and b) identical (or of the same type).

A tile is “free” when:
no other tile is lying above or is partially covering it
no other tile is lying to the left or to the right of it

Two tiles are identical if they look exactly the same (of course…). An exception to this are the Flowers and Seasons tiles. They are non-identical matching tiles and belong to the same type. All the Flowers tiles match one another and all the Season tiles match one another. You should study them before starting a game.

Each tile appears four times in a standard solitaire mahjongg game. Again an exception for the Flowers and Seasons tiles who appear only once each during a game.

It’s not as easy as it sounds; you can end up with having matched the “wrong” pairs and you may find yourself stuck, with unmatchable tiles blocking other key tiles so you can’t clear the layout. You must be careful before removing a pair, you should look for where the remaining pair is in the layout and plan ahead. If all four of an identical tile are free, remove them to ‘unclutter’ the field. It’s not only a game of pure luck, you have to play strategic.
Strategy

Remember that there are four of each tile. When removing a pair, an identical pair exists in the layout. Is it trapped by your removal of the first pair?
Concentrate your efforts on long rows and tall stacks.
Plan ahead as many moves as you can.
If all four of a tile are available, remove them all to unclutter the field.
Identify as many matching pairs as possible. Check for tiles that need to be unblocked.
Beware of triples (three matching free tiles); choose carefully which pair you remove. Leave the one that’s blocking the least important tiles.
Concentrate on removing pairs that will unblock the most tiles.

बातें करते दिखाई और सुनायी दे जाते हैं पर क्या आप जानते हैं कि ये
आईएएस अपना अचल संपत्ति का विवरण सार्वजनिक करने के नाम पर मुंह छुपाये
घूम रहे हैं l कारण स्पष्ट है '' जब काली कमाई का बहुत कुछ है छुपाने
को, तो ये आईएएस बहाने ढूंढ़ रहे हैं आईपीआर न दिखाने को'' l इससे यह तो
स्वतः ही सिद्ध हो जाता है कि इनके आदर्शवादी भाषण कितने खोखले होते हैं
lमेरी तो आप सबसे अपील है कि आप इन दोहरे चरित्र के लम्पटों को पहचान लें
और इनका सामजिक वहिष्कार करें l


यह मेरे प्रदेश का दुर्भाग्य है कि भारत के इन 445 बेशर्म विशिष्टों में
131 ( 29 प्रतिशत ) मेरे उत्तर प्रदेश के हैं l वर्ष 2010 के 38 ऐसे
'आईएएस' में से 6 ( 15% ) उत्तर प्रदेश के हैं, वर्ष 2011 के 49 ऐसे
'आईएएस' में से 3 ( 6 % ) उत्तर प्रदेश के हैं, वर्ष 2012 के 152 ऐसे
'आईएएस' में से 64 ( 42 % ) उत्तर प्रदेश के हैं और वर्ष 2013 के 206
ऐसे 'आईएएस' में से 58 ( 28 % ) उत्तर प्रदेश के हैं l यह आंकड़े स्पष्ट
करते हैं कि माया के मुकाबले अखिलेश के समय में यूपी के नौकरशाह दोगुने
से भी अधिक बेलगाम और स्वेच्छाचारी हो गए हैं और अखिलेश सरकार की
विफलता का यह एक मुख्य कारण है l


क्या यह दुर्भाग्यपूर्ण नहीं है कि देश की लोकसभा को 14. 84 प्रतिशत
सीटें देने बाले इस प्रदेश की वर्ष 2012 में देश के कुल बेशर्म
विशिष्टों की जमात में भागीदारी 42 % तक पंहुच गयी थी l अब ऐसी निकृष्ट
मानसिकता के आईएएस अधिकारियों के सहारे उत्तर प्रदेश किस दिशा में जाएगा
, इसका अनुमान तो कोई बच्चा भी लगा सकता है l

लखनऊ: उत्तर प्रदेश में आरटीआई कार्यकर्ताओं पर लगातार हो रहे हमले और
उत्पीड़न के खिलाफ 'नेशनल व्हिसल्ब्लोवर्स डे' पर बुधवार को जीपीओ स्थित
गांधी प्रतिमा के समक्ष आरटीआई और सामाजिक संगठनों से जुड़े लोगों ने
नुक्कड़ नाटक 'मदारी और बंदर' के माध्यम से एवं 'सीटी बजाकर' प्रदर्शन
किया। येश्वर्याज सेवा संस्थान के बैनर तले अपनी तरह का बेहद और अलग
प्रदर्शन कर आयोजक और आरटीआई कार्यकर्ता उर्वशी शर्मा ने कहा, "उत्तर
प्रदेश में प्रशासनिक और पुलिस अधिकारियों द्वारा राजनेताओं के इशारों पर
कार्य करके निर्दोष जनता को निरंतर ही प्रताड़ित किया जा रहा है और आम-जन
को प्रशासन और पुलिस से न्याय नहीं मिल रहा है। इन निंदनीय कृत्यों में
प्रशासन और पुलिस का पूरा तंत्र ही प्रत्यक्ष या अप्रत्यक्ष रूप से
सहभागी है।"

प्रशासनिक और पुलिस तंत्र राजनेताओं को अपना मदारी मान चुका है और उनके
इशारों पर बंधक बन्दर की तरह नाच रहा है।

उर्वशी ने कहा कि प्रदेश में आए दिन हो रहे दंगों तथा बदायूं, मोहनलालगंज
जैसे दुष्कर्म और हत्याकांड के मामलों की पुनरावृत्ति यह सिद्ध करती है
कि अपराधों के प्रति सरकार पूर्णतया: बहरी हो गई है।

उन्होंने कहा कि हम राज्य में बढ़ते अपराधों के प्रति सरकार के कानों तक
जनता की आवाज पंहुचाने के लिए सीटी बजाकर आक्रोश व्यक्त करते हुए

प्रदर्शनकारियों ने प्रदेश की ध्वस्त कानून व्यवस्था और मानवाधिकारों के
खुले उल्लंघनों के लिए प्रदेश सरकार को जमकर कोसा। उन्होंने प्रदेश में
सचेतकों और आरटीआई कार्यकर्ताओं की हत्याओं की घटनाओं को लोकतंत्र की
हत्या करार देते हुए सरकार से आरटीआई कार्यकर्ताओं और सचेतकों को झूठे
मामलों में फंसाए जाने की घटनाओं की सीबीसीआईडी से जांच कराने की मांग
की।

प्रदर्शनकारियों ने प्रशासनिक और पुलिस तंत्र को पारदर्शी और जवाबदेह
बनाकर प्रदेश में मानवाधिकारों के संरक्षण की मांग की और प्रशासनिक सुधार
और पुलिस सुधार के लिए तेरह सूत्री मांगपत्र सूबे के मुखिया अखिलेश यादव
को प्रेषित किया गया।

प्रदर्शनकारियों ने विगत दिनों मारे गए सचेतकों, आरटीआई कार्यकर्ताओं और
निर्दोष आमजनों की आत्मा की शांति के लिए दो मिनट का मौन रखकर
श्रद्धांजलि अर्पित की।

आज 'राष्ट्रीय सचेतक दिवस' 30 जुलाई 2014 पर लखनऊ में हज़रतगंज जीपीओ के
निकट स्थित महात्मा गांधी पार्क में सामाजिक कार्यकर्ताओं ने येश्वर्याज
सेवा संस्थान के बैनर तले 'मदारी और बन्दर' के माध्यम से एवं 'सीटी
बजाकर' सामूहिक प्रदर्शन किया l

येश्वर्याज सेवा संस्थान लोकजीवन में पारदर्शिता, जबाबदेही लाने और
मानवाधिकारों के संरक्षण के क्षेत्र में कार्यरत लखनऊ स्थित एक सामाजिक
संगठन है l

येश्वर्याज सेवा संस्थान की सचिव उर्वशी शर्मा ने बताया "उत्तर प्रदेश
में प्रशासनिक और पुलिस अधिकारियों द्वारा राजनेताओं के इशारों पर
कार्य करके निर्दोष जनता को निरंतर ही प्रताणित किया जा रहा है और आम-जन
को प्रशासन और पुलिस से न्याय नहीं मिल रहा है l इन निंदनीय कृत्यों में
प्रशासन और पुलिस का पूरा तंत्र ही प्रत्यक्ष या अप्रत्यक्ष रूप से
सहभागी है l आज का प्रशासनिक और पुलिस तंत्र भ्रष्टाचारियों और
सत्तानशीनों के अतिरिक्त समाज के किसी भी वर्ग के हित संरक्षित रखने में
बिलकुल भी तत्पर नहीं है l संक्षेप में कहें तो आज का प्रशासनिक और
पुलिस तंत्र राजनेताओं को अपना मदारी मान चुका है और उनके इशारों पर बंधक
बन्दर की तरह नाच रहा है l प्रशासनिक और पुलिस तंत्र को आइना दिखाने और
इनकी सोयी पडी अंतरात्मा को झकझोरने के उद्देश्य से ही हम आज 'राष्ट्रीय
सचेतक दिवस' 30 जुलाई 2014 पर राजधानी लखनऊ में 'मदारी और बन्दर' के
माध्यम से यह शांतिपूर्ण प्रतीकात्मक प्रदर्शन कर रहे है l "

उर्वशी ने कहा कि प्रदेश में आये दिन होने बाले दंगों तथा बदायूं
,मोहनलालगंज जैसे रेप और हत्याकांड के मामलों ने हमारी इस अवधारणा को
सिद्ध भी कर दिया है l यह अब किसी से छुपा नहीं है कि कैसे बन्दर बने
प्रदेश के आला पुलिस अधिकारी इन मामलों के निस्तारण में अपने मदारी
नेताओं के इशारों पर कानून को खूंटी पर टांगकर तरह-तरह की कलाबाजियां
खा रहे हैं और अपनी वेशर्मी को ही अपनी सफलता मानकर बन्दर की तरह जब-तब
खींसें नपोरते दिखाई दे रहे हैं l

उर्वशी ने बताया "प्रदेश में आये दिन होने दंगों तथा बदायूं ,मोहनलालगंज
जैसे रेप और हत्याकांड के मामलों की पुनरावृत्ति यह सिद्ध करती है कि
अपराधों के प्रति अखिलेश की सरकार पूर्णतया बहरी हो गयी है अतः हम यूपी
में बढ़ते अपराधों के प्रति अखिलेश की बहरी सरकार के कानों तक जनता की
आवाज पंहुचाने के लिए आज सीटी बजाकर आक्रोश व्यक्त करते हुए प्रदर्शन भी
कर रहे हैं l"

धरने के आरम्भ में प्रदर्शनकारियों ने विगत दिनों मारे गए सचेतकों,
आरटीआई एक्टिविस्टों और निर्दोष आमजनों की आत्मा की शांति के लिए दो मिनट
का मौन रखकर श्रद्धांजलि अर्पित की l प्रदर्शनकारियों ने प्रदेश की
ध्वस्त क़ानून व्यवस्था और मानवाधिकारों के खुले उल्लंघनों के लिए प्रदेश
सरकार को जमकर कोसा l धरने में पुलिस द्वारा सरकार के दबाब में आमजनता
को झूठे मामलों में फंसाकर प्रताड़ित करने का मामला प्रमुखता से उठा l

धरने में महेंद्र अग्रवाल, हरपाल सिंह,राम स्वरुप यादव, अशोक कुमार
गोयल, नूतन ठाकुर,आलोक कुमार, नीरज कुमार,के के मिश्रा, आर डी कश्यप,
सूरज कुमार आदि ने प्रतिभाग कर प्रदेश में सचेतकों और आरटीआई
एक्टिविस्टों की हत्याओं की घटनाओं को लोकतंत्र की हत्या की संघ्या दी और
सरकार से आरटीआई एक्टिविस्टों और सचेतकों को झूठे मामलों में फंसाये जाने
की घटनाओं की सीबीसीआईडी से जांच कराने की मांग की l

प्रदर्शनकारियों द्वारा प्रशासनिक और पुलिस तंत्र को पारदर्शी और
जबाबदेह बनाकर प्रदेश में मानवाधिकारों के संरक्षण की मांग की गयी और
प्रशासनिक सुधार और पुलिस सुधार के लिए तेरह सूत्री मांगपत्र सूबे के
मुखिया अखिलेश यादव को प्रेषित किया गया l कार्यक्रम 11 बजे पूर्वान्ह से
3 बजे अपरान्ह तक चला l

आदरणीय महोदय,
आपको अवगत कराना है कि वर्ष 2012 में उत्तर प्रदेश की
जनता ने नव-अपेक्षाओं के साथ आपकी पार्टी को सत्ता की कुंजी सौंपी थी l
आपकी पार्टी से जनता की यह अपेक्षा थी कि नयी सरकार प्रत्येक क्षेत्र में
पूर्ववर्ती सरकार की अपेक्षा वेहतर परिणाम देने की मंशा के साथ कार्य
करेगीl

हमें आपको अत्यंत दुःख के साथ सूचित करना पड़ रहा है कि लोकजीवन में
पारदर्शिता, जबाबदेही लाने और मानवाधिकारों के संरक्षण के क्षेत्र में
आपकी सरकार ने कोई भी ठोस कार्य नहीं किया है और इसकी परिणति प्रदेश में
आये दिन होने बाले दंगों और प्रदेश में बढ़ते अपराधों के रूप में हो रही
है जिसका खामियाजा केवल और केवल आम जनता ही भुगत रही है l

हम आपसे जानना चाहते है कि प्रदेश में आये दिन होने बाले दंगों और प्रदेश
में बढ़ते अपराधों के लिए सूबे में तमाम पदों पर आसीन लोकसेवको की भी कोई
जबाबदेही है या नहीं l हम यह भी जानना चाहते हैं कि क्या ये लोकसेवक बिना
किसी जबाबदेही के यूं ही समय काटने का कार्य करते रहेंगे और प्रदेश को इन
समस्याओं से कभी भी निजात नहीं मिलेगी l

उत्तर प्रदेश आबादी के लिहाज से विश्व का छठा देश हो सकता है परन्तु यह
विचारणीय है कि देश में ही शिक्षा, स्वास्थ्य, आधारभूत ढांचे के विकास
और पावर सहित कई दूसरे सेक्टरों में राजस्थान, मध्य प्रदेश, बिहार और
छत्तीसगढ़ जैसे बीमारू राज्यों ने भी वेहतर प्रशासनिक व्यवस्थाओं के बल
पर उत्तर प्रदेश को पछाड़ रखा है ।हम सभी का आपसे अनुरोध है कि हमारी
निम्नलिखित मांगों पर तत्काल प्रभाव से कार्यवाही कराकर कृत कार्यवाही
से हमको अवगत भी कराएं l यदि आपके द्वारा हमारी मांगों में उठाये
बिन्दुओं के सम्बन्ध में 6 माह के अंदर प्रभावी कार्यवाही कर प्रदेश की
जनता को प्रशासन और पुलिस से सम्बंधित उसकी समस्याओं का स्थायी समाधान
मुहैया नहीं कराया जाता है तो हम उग्र आंदोलन करने और मा० न्यायालय की
शरण में जाने को वाध्य होंगे जिसका पूर्ण उत्तरदायित्व आपका और आपकी
सरकार का होगा l
मांगें :
1- प्रदेश के प्रशासनिक अधिकारियों को अवांछित राजनैतिक दवाव से मुक्त
करने हेतु प्रदेश में स्वतंत्र सिविल सेवा बोर्ड को कार्यशील बनाया जाए l
2- प्रशासनिक अधिकारी का एक पद पर दो वर्ष की अवधि से पूर्व स्थानांतरण
केवल दंडस्वरूप ही किया जाये एवं ऐसे दण्ड का अंकन सम्बंधित अधिकारी के
सेवा अभिलेखों में किया जाये l
3- प्रशासनिक अधिकारियों के स्थानांतरण में अन्तर्निहित लोकहित को
स्थानांतरण से पूर्व ही सार्वजनिक किया जाये l
4- जिले में दंगे होने की घटना को जिलाधिकारी और वरिष्ठ पुलिस अधीक्षक की
व्यक्तिगत अक्षमता माना जाये और दंगे होने की घटना का अंकन संबंधित
जिलाधिकारी और वरिष्ठ पुलिस अधीक्षक के सेवा अभिलेखों में किया जाए l
5- प्रदेश की पुलिस को अवांछित राजनैतिक दवाव से मुक्त करने हेतु राज्य
सुरक्षा आयोग का गठन किया जाए l
6- प्रशासनिक और पुलिस अधिकारियों की
नियुक्ति,पदोन्नति,स्थानांतरण,अनुशासनात्मक कार्यवाही,सेवा देयकों के
भुगतान आदि को विनियमित करने की पारदर्शी प्रक्रिया अमल में लाई जाएl
इसके लिए पुलिस स्थापना बोर्ड का गठन किया जाए l
7- जांचों के लिए और कानून व्यवस्था बनाये रखने के लिए थानों में
पृथक-पृथक पुलिस बल फेज-वार तैनात किये जाएँ l
8- पुलिस के खिलाफ की गयी शिकायतों के सही निस्तारण हेतु जिला स्तर पर
एवं राज्य स्तर पर पुलिस शिकायत प्राधिकरण का गठन किया जाये l
9- दंड विधि ( संशोधन ) अधिनियम 2013 लागू होने की तिथि 03 फरवरी 2013 के
बाद प्रदेश में महिलाओं के विरुद्ध हुए अपराधों के सभी प्राप्त मामलों की
थानावार समीक्षा कराकर धारा 166A/166B के तहत दोषी पाये जाने बाले
पुलिस कर्मियों के विरुद्ध प्रथम सूचना रिपोर्ट दर्ज कराकर विधिक
कार्यवाही की जाए l
10- वादियों द्वारा थानों पर दिए गए शिकायती पत्रों की समीक्षा कराकर
मा० सर्वोच्च न्यायालय द्वारा रिट पिटीशन ( क्रिमिनल ) संख्या 68/2008
ललिता कुमारी बनाम उत्तर प्रदेश सरकार एवम अन्य मेँ दिनांक 12-11-2013
को प्रतिपादित क़ानून के अनुपालन में प्रथम सूचना रिपोर्ट दर्ज न करने के
दोषी पुलिस कर्मियों के विरुद्ध कार्यवाही कराई जाये l
11- प्रशासन और पुलिस को अतिश्रम की समस्या से निजात दिलाने के लिए रिक्त
पड़े पदों को तत्काल भरा जाए l
12- प्रशासनिक एवं पुलिस अधिकारियों द्वारा अपने उच्चाधिकारियों से
अथवा राजनेताओं से प्राप्त मौखिक निर्देशों को बिना लिपिबद्ध किये ऐसे
मौखिक निर्देशों के आधार पर की गयी कार्यवाही को अवैध मानकर सम्बंधित
प्रशासनिक एवं पुलिस अधिकारियों को ऐसे मामलों में दण्डित किये जाने का
नियम बनाया जाये l
13- पुलिस एवं प्रशासन से जुड़े प्रत्येक कार्मिक को मानवाधिकारों के
संरक्षण से सम्बंधित समुचित प्रशिक्षण दिलाया जाये एवं मानवाधिकार
उल्लंघन के प्रत्येक सिद्ध प्रकरण का अंकन दोषी कार्मिक के सेवा अभिलेखों
मेँ किया जाएl

Soon a memorial to 'shame' society on growing sexual crimes

Stirred by a series of sexual crimes in the state and elsewhere, an
NGO has decided to build a Nirbhaya Memorial to the women who were
victims of such crimes and to stir society's conscience against such
acts.

Nutan Thakur, an office-bearer of NGO People's Forum, said the forum
has an 8,000 sq ft piece of land in Khadgapur in the Gomtinagar
extension for the memorial, named after the Dec 16, 2012, Delhi
gang-rape victim. The memorial would not only be for highlighting many
such cases of sexual assault, crimes and brutality perpetrated against
women but also to "shame" the assailants and society at large that
"such heinous crimes continue under their watch".

The memorial would also have a counselling centre for women facing
"similar situations" and would work to alert them before it's too
late.

"The idea is to salute the women's spirit which in many avatars in
Hindu mythology is an incarnation of Shakti," Nutan Thakur's husband
Amitabh Thakur, a senior IPS officer, who is also contributing to the
memorial that is likely to be completed by the first week of January
2015, told IANS.

"We, as responsible citizens, have taken it upon ourselves to ensure
that such crimes are not only adequately highlighted but also not
brushed under carpet by a society which does not want to live with
shame and pain beyond a certain timeline," he mused while explaining
how, when such incidents take place, there is a wave of public
sentiment that soon wanes.

The idea behind the memorial - which will have a statue of a woman in
abstract and symbolic along with a demon-like man out to assault her
sexually - was to ensure that the pain lingers on until it shakes the
people into a permanent action mode, Amitabh Thakur said.

Thus, the memorial would also have a small museum where memories of
these crimes would be preserved in the form of pictures of victims,
the stories of their families, their dreams, paper cuttings of news
reports and details of the police action or inaction with a detailed
follow up, he added.

Asked if this would be akin to extending the pain of such tragedies,
he said this was the whole idea behind the memorial! "Does brushing
aside the incidents lessen the pain and increase the safety of women,"
he asked.

The forum has begun talks with some local architects and are in the
process of fund collection for the memorial, they say. "It is a
memorial for a social cause and we hope that there would be some
sculptors who would volunteer to take up the statue's design and
fabrication and we will then follow it up," Nutan Thakur told IANS.

The forum is also in the process of talking to the parents and
families of such victims and will try to detail the life they lived
and the macabre ends they met. "We would also try to asses, assimilate
and showcase how normal dreams were shattered due to the uncontrolled
lust and unchecked criminal instincts," Nutan Thakur said.

Uttar Pradesh has recorded a quantum jump of 55 per cent in sexual
crimes and rapes over the previous year, union home ministry data
shows. Politicians and police, however, chose to look the other way.
May be, the memorial will shame them enough! One can only keep one's
fingers crossed.

This refers to media reports on claims of A.D.G. Ms. Sutapa Sanyal led
Uttar Pradesh police teams and Counter claims of Mr. Amitabh Thakur, a
Senior IPS officer of Uttar Pradesh regarding Mohanlalganj rape and
murder case in Lucknow.
On one hand A.D.G. Ms. Sutapa Sanyal led Uttar Pradesh Police teams
are said to have concluded that the incident was a single-person act
and they have arrested the accused Mr. Ram Sewak Yadav. The Police has
rejected the reports of rape and concluded that the victim died of
excessive bleeding. Even A.D.G. Ms. Sutapa Sanyal is said to have
informed the media that the accused tried to rape the victim and on
being resisted tore her clothes, injuring her private parts. Ms.
Sutapa Sanyal is said to have added that when the injured and bleeding
victim asked the accused for water, he told her the location of hand
pump on the school campus and left where afterwards the victim bled to
death.

On the other hand Mr. Amitabh Thakur, a senior I.P.S. officer of Uttar
Pradesh cadre, who is said to have visited the crime scene himself,is
said to have contradicted his own department's claims regarding
solving the said Rape & Murder case.Mr. Thakur didn't find any
substance in said single accused theory of Police.Mr. Thakur is said
to have concluded that Involvement of more people was not properly
probed, Police was not able to recover the murder weapon,Mobile of the
deceased remains untraced,Facts leading to the murder do not
interconnect and also that the Sequence of events as told by the
police are not backed by evidence. Mr. Thakur is said to have alleged
that to him the Police seemed to have buckled under media and other
pressure and also that the Police seemed to be in a hurry to show the
case solved.


Not only this Mr. Thakur has shared a mail on Yahoo-group also in
which he has imposed serious allegations on credibility of police
department of Uttar Pradesh. Mr. Thakur has written in his mail that
the Mohanlalganj case has established that People's faith in police
was lacking.

Such serious allegation by a senior I.P.S. officer of the stature of
I.G. against the preliminary outcome of A.D.G. Ms. Sutapa Sanyal led
enquiry teams of Uttar Pradesh Police should not go unnoticed and
unaccounted.

When credibility of an officer of the stature of A.D.G. of Uttar
Pradesh Police has been questioned by a Senior IPS officer of same
Uttar Pradesh Police then it is for sure that the deceased women shall
never get justice from such insensitive, inhumane and sycophant
Police personnel. Please punish the defaulter Police Personnel after a
proper D.G.P. level probe into the objections as raised by Mr. Thakur.


In order to ensure that the deceased women should get THE JUSTICE from
the system, I, as a Social Activist, am raising my just and legitimate
demand for a C.B.I. probe in this matter. Please get the matter probed
by C.B.I. in the larger interest of the society so that all culprits
be brought to books and future occurrences of such shameful events
should be minimized in Uttar Pradesh.

सूचना मांगने वाले को ही सजा..!

अखिलेश राज में उत्तरप्रदेश में यूं तो सरकारी तंत्र की मनमानी कायम है।
मगर लोकसभा चुनाव में समाजवादी पार्टी की करारी हार के बाद लोगों की
मुश्किलों और बढ़ गई हैं। ताजा मामले में तो सूचना मांगने वाले को ही सजा
सुना दी।

इसी कड़ी में एक ऐसा अनोखा मामला सामने आया है, जिसमें उत्तरप्रदेश के
पूर्व मुख्य सूचना आयुक्त रंजीतसिंह पंकज ने बीते 6 जून को अपने अधिकार
क्षेत्र से परे जाकर सूचना मांगने वाले व्यक्ति को ही कारावास की सजा
सुना दी। राज्य सूचना आयोग कानूनन न्यायालय नहीं है पर पंकज ने बिना
अधिकार के ही सीआरपीसी की धारा 345 के साथ पठित आईपीसी की धारा 228 के
तहत न्यायालय की अवमानना की कार्यवाही में यह तुगलकी आदेश जारी किया हैl

सीआरपीसी की धारा 345 में केवल किसी सिविल, दांडिक अथवा राजस्व कोर्ट
द्वारा ही कार्यवाही की जा सकती है, जबकि सर्वोच्च न्यायालय ने भारत
सरकार बनाम नमित शर्मा की रिव्यू याचिका (सिविल) संख्या 2309/2012 के
आदेश दिनांक 3 सितंबर, 2013 के द्वारा स्पष्ट कर दिया है कि सूचना आयोग
न्यायालय नहीं है इसलिए सीआरपीसी की धारा 345 इस मामले में लागू ही नहीं
होती हैl

आईपीसी की धारा 228 में केवल न्यायिक कार्य करने बाले लोकसेवक के मामले
में ही कार्यवाही की जा सकती है, जबकि सर्वोच्च न्यायालय ने भारत सरकार
बनाम नमित शर्मा की रिव्यू याचिका द्वारा स्पष्ट कर दिया है कि सूचना
आयुक्त न्यायिक कार्य नहीं करते हैं अपितु प्रशासनिक कार्य करते हैं
इसलिए आईपीसी की धारा 228 भी इस मामले में लागू ही नहीं होती हैl

आरटीआई एक्ट में सूचना आयुक्त की अवधारणा आरटीआई एक्ट के संरक्षक के रूप
में की है पर यह कहने में कोई झिझक नहीं है कि यही सूचना आयुक्त आज
भ्रष्टाचारियों से सुपारी लेकर आरटीआई एक्ट के किलर की भूमिका में सामने
आए हैं और प्रदेश में आरटीआई एक्ट का गला घोंटकर आरटीआई एक्ट की मंशा की
हत्या करने पर आमादा हैंl

उत्तर प्रदेश में सूचना कानून के रक्षक के ही सूचना कानून के भक्षक बनने
के इस मामले में आरटीआई कार्यकर्ता उर्वशी शर्मा ने उत्तरप्रदेश के
राज्यपाल और सर्वोच्च न्यायालय के मुख्य न्यायाधीश को पत्र लिखकर न्यायिक
जांच कराने की मांग की है। चूंकि पंकज हाल ही में सेवानिवृत्त हो चुके
हैं, अत: उर्वशी शर्मा ने न्यायिक जांच कराने की मांग की है।
