'तहरीर' ने गंगा में मिली लाशों और उन्नाव में मिले नर कंकालों के प्रकरण
की जाँच मानवाधिकारों के उल्लंघन के मद्देनज़र, प्रदेश की बदहाल क़ानून
व्यवस्था के मद्देनज़र और सत्ताधारी पार्टी द्वारा पुलिस संरक्षण में
अपने राजनैतिक प्रतिद्वंदियों अथवा सामाजिक/मानवाधिकार कार्यकर्ताओं की
हत्याओं के परिणाम होने की संभावना के मद्देनज़र सभी जिलों के
जिलाधिकारियों के माध्यम से सूबे के सभी जिलों के बंद पड़े सभी सरकारी
कक्षों की तत्काल जाँच कराकर ऐसे सभी प्रकरणों को सामने लाने और इन सभी
मामलों की सीबीआई जाँच कराने की की मांग की है ।.

उनका सीएम और उसका परिवार स्वस्थ है. दरअसल इस बात की तस्दीक़ मेरी एक
आरटीआई पर उत्तर प्रदेश शासन के गोपन विभाग के जनसूचना अधिकारी और विशेष
सचिव कृष्ण गोपाल द्वारा दिए गये जबाब से हो रही है.

मैने साल २०१३ में ०४ अप्रैल को मुख्यमंत्री द्वारा अपनी एवं अपने
परिवार की चिकित्सा सुविधा का विवरण और उस पर व्यय की गयी धनराशि के
विवरण की सूचना माँगी थी. बीते १८ नबंबर को उत्तर प्रदेश शासन के गोपन
विभाग के जनसूचना अधिकारी और विशेष सचिव कृष्ण गोपाल ने मेरी आरटीआई के
जबाब में मुझे बताया है कि सूबे के मुख्यमंत्री अखिलेश यादव द्वारा अपनी
एवं अपने परिवार के किसी भी सदस्य का कोई चिकित्सा प्रतिपूर्ति संबंधी
दावा गोपन विभाग में प्रेषित नही किया है और यह भी कि गोपन विभाग ने
मुख्यमंत्री अखिलेश यादव एवं उनके परिवार के किसी भी सदस्य के चिकित्सा
पर कोई भी धनराशि व्यय नहीं की है.

आज जब उम्रदराज राजनेताओं की बीमारियों की बजह से राजकोष पर अतिरिक्त
अधिभार आना रोज की सी बात हो गयी है, ऐसे में यूपी के सीएम और उनके
परिवार ने स्वस्थ रहकर यूपी को मुस्कुराने की कम से कम एक वजह तो दी.

imprisonment.

'TAHRIR' believes that the death penalty is the ultimate denial of
human rights. It is the premeditated and cold-blooded killing of a
human being by the state. This cruel, inhuman and degrading punishment
is done in the name of justice. It violates the right to life as
proclaimed in the Universal Declaration of Human Rights. TAHRIR
opposes the death penalty in all cases without exception regardless of
the nature of the crime, the characteristics of the offender, or the
method used by the state to kill the prisoner.

We, at TAHRIR believe that there have been and always will be cases of
executions of innocent people. No matter how developed a justice
system is, it will always remain susceptible to human failure. Unlike
prison sentences, the death penalty is irreversible and irreparable.
We believe that the arbitrary application of the death penalty can
never be ruled out. The death penalty is often used in a
disproportional manner against the poor, minorities and members of
racial, ethnic, political and religious groups. The death penalty is
incompatible with human rights and human dignity. The death penalty
violates the right to life which happens to be the most basic of all
human rights. It also violates the right not to be subjected to
torture and other cruel, inhumane or degrading treatment or
punishment. Furthermore, the death penalty undermines human dignity
which is inherent to every human being. The death penalty does not
deter crime effectively. The death penalty lacks the deterrent effect
which is commonly referred to by its advocates. As recently stated by
the General Assembly of the United Nations, "there is no conclusive
evidence of the deterrent value of the death penalty" (UNGA Resolution
65/206). It is noteworthy that in many retentionist states, the
effectiveness of the death penalty in order to prevent crime is being
seriously questioned by a continuously increasing number of law
enforcement professionals. Moreover, Public support for the death
penalty does not necessarily mean that taking away the life of a human
being by the state is right. There are undisputed historical
precedences where gross human rights violations had had the support of
a majority of the people, but which were condemned vigorously later
on. It is the job of leading figures and politicians to underline the
incompatibility of capital punishment with human rights and human
dignity. It needs to be pointed out that public support for the death
penalty is inextricably linked to the desire of the people to be free
from crime. However, there exist more effective ways to prevent crime.

High Court Allahabad has commuted death sentence of Surinder Koli to
life imprisonment on the ground of "inordinate delay" in deciding his
mercy petition.A division bench comprising Chief Justice DY
Chandrachud and Justice PKS Baghel held that execution of Koli's death
sentence would be "unconstitutional in view of the inordinate delay"
in deciding his mercy petition.The order has come on a Public Interest
Litigation filed by NGO People's Union for Democratic Rights (PUDR)
which contended that the period elapsed in disposal of Koli's mercy
petition was "3 years and 3 months" and, as such, execution of death
sentence would be in violation of the Right to Life granted in Article
21 of the Constitution.A petition was filed later by Koli himself,
challenging the death sentence on the same ground as the one stated in
the PIL, has also been clubbed with it.The death sentence was awarded
to him by a special CBI court at Ghaziabad on February 13, 2009.The
PIL was filed on October 31 last year, three days after the Supreme
Court rejected Koli's recall application. The death warrant issued by
the trial court on September 2 had fixed September 12 as the date of
hanging, though its execution was stayed in view of the apex court's
decision to hear the recall application. Rejection of the recall
application had cleared the decks for execution of the death sentence,
but it was stayed by the high court on October 31 when it decided to
hear the PIL.After his appeal against the trial court order was turned
down by High Court on September 11, 2009 while co-accused and his
employer Moninder Singh Pandher was acquitted, Koli filed a petition
before the Supreme Court challenging his conviction which was
dismissed on February 15, 2011.Koli, thereafter filed his mercy
petition before the Governor of Uttar Pradesh on May 7, 2011, which
was rejected 23 months later, on April 2, 2013.The mercy petition was
thereafter forwarded to the Union Home Ministry on July 19, 2013 and
it was turned down by the President on July 20, 2014.The court had
agreed to hear the PIL disagreeing with the Centre's preliminary
objection that "the convict (Koli) had not filed a petition (at the
time of filing of the PIL) challenging the rejection of his mercy
petition"."The proceeding which has been instituted before this court
is not in the nature of an appeal on merits against the order of
conviction."The petition seeks to question the constitutionality of
the execution of the sentence of death in the present case, on the
ground of a delay on the part of constitutional authorities in
disposing of the mercy petitions," the court had said.

(UPPCB) is unaware about any steps taken by the Centre or State to
clean the river Gomti, an RTI query by a 13-year-old Lucknow girl has
revealed.

Worse still, the pollution watchdog body doesn't even have any
information about the laws to keep a tab on people polluting the
river, the reply added.

In reply to a the queries regarding expenses (by Centre or State) on
Gomti river cleaning, in a Right to Information (RTI) application by
Aishwarya Parashar, 13, the UPPCB said that it had no knowledge about
the money spent. Instead it asked the young activist to get the
details from the state's department of urban development.

"Every one is talking about cleaning the river. But they don't event
know how much they have done so far," said Aishwarya, who shot to fame
a few years ago after her RTI plea forced authorities to remove
garbage outside her school in the state capital. Surprisingly, the
UPPCB officials also said that they did not have any information about
any laws or directives to stop people from dumping garbage (mostly
after prayers) in the river.

The apathy doesn't stop here. The board took one year and three months
to come up with the reply to the RTI plea while the RTI Act mandates
the reply should come within 30 days. The plea was filed by Aishwarya
is October 2013.

Notably, the government had, of late, taken many initiatives for
cleaning Gomti. State chief secretary, Alok Ranjan had directed
diversion of all nullahs to sewage treatment plant and ban on
discharge of effluents directly into the river.

Even Lucknow's district magistrate Raj Shekhar had cleaned the river
himself regularly with teams of NGOs and had released some funds for
the cleaning of the river.

यूपी की राजधानी लखनऊ के सिटी मॉन्टेसरी स्कूल राजाजीपुरम शाखा की कक्षा
8 की छात्रा 13 वर्षीय ऐश्वर्या पाराशर की एक आरटीआई ने गोमती सफाई पर
सरकारी दिखावों की पोल खोल दी है .

दरअसल ऐश्वर्या ने साल 2013 के 25 अक्टूबर को सूबे के मुख्यमंत्री
कार्यालय में एक आरटीआई दायर करके उत्तर प्रदेश के गठन से अब तक गोमती
सफाई पर केंद्र सरकार और प्रदेश सरकार द्वारा खर्च किये गए रुपयों की
जानकारी माँगी थी . ऐश्वर्या ने गोमती में कूड़ा- कचरा डालने से रोकने
के लिए प्रदेश सरकार द्वारा किये गए आदेशों की जानकारी भी माँगी थी .

हालाँकि आरटीआई एक्ट में 30 दिनों में ही सूचना देने की अनिवार्यता है पर
सरकारी उदासीनता के चलते यह सूचना उत्तर प्रदेश प्रदूषण नियंत्रण बोर्ड
द्वारा लगभग 1 साल 2 महीने बाद ऐश्वर्या को दी गयी है. उत्तर
प्रदेश प्रदूषण नियंत्रण बोर्ड द्वारा ऐश्वर्या को दी गयी सूचना से
गोमती सफाई पर सरकारी दिखावों की पोल स्वतः ही खुल रही है.

ऐश्वर्या को दी गयी सूचना में उत्तर प्रदेश प्रदूषण नियंत्रण बोर्ड ने
स्वीकारा है कि चाहें केंद्र की सरकार हो या प्रदेश की सरकार, किसी ने
भी गोमती नदी की सफाई के लिए उत्तर प्रदेश के गठन से अब तक एक रुपया भी
खर्च नहीं किया है. उत्तर प्रदेश प्रदूषण नियंत्रण बोर्ड ने यह भी
स्वीकारा है कि उनके पास गोमती में कूड़ा- कचरा डालने से रोकने के लिए
प्रदेश सरकार द्वारा किये गए आदेशों की जानकारी नहीं है और ये जानकारी
लेने के लिए ऐश्वर्या को नगर विकास विभाग से संपर्क करने को कहा है.

उत्तर प्रदेश प्रदूषण नियंत्रण बोर्ड द्वारा दी गयी सूचना से व्यथित
ऐश्वर्या सबाल करती है कि जब केंद्र की सरकार और प्रदेश की सरकार ने
गोमती नदी की सफाई के लिए उत्तर प्रदेश के गठन से अब तक एक रुपया भी
खर्च नहीं किया है और उत्तर प्रदेश प्रदूषण नियंत्रण बोर्ड के पास
गोमती में कूड़ा- कचरा डालने से रोकने के लिए प्रदेश सरकार द्वारा किये
गए आदेशों की जानकारी ही नहीं है तो आखिर गोमती नदी की सफाई होगी
कैसे ?

गौरतलब है कि देश में 'आरटीआई बाली लड़की' के नाम से विख्यात ऐश्वर्या महज
8 साल की उम्र में अपनी आरटीआई से सिटी मॉन्टेसरी स्कूल राजाजीपुरम शाखा
के सामने से कूड़ाघर हटवाकर पब्लिक लाइब्रेरी बनबा चुकी हैं.

बापू नहीं 'राष्ट्रपिता' ,हॉकी नहीं 'राष्ट्रीय खेल', 26 जनवरी (गणतंत्र
दिवस), 15 अगस्त (स्वतंत्रता दिवस) और 2 अक्टूबर (गांधी जयंती) नहीं
'राष्ट्रीय अवकाश' जैसे कड़वे सच अपनी बिभिन्न आरटीआई से देश के सामने
उजागर करने बाली इस 'आरटीआई गर्ल' ऐश्वर्या ने गोमती नदी की सफाई की अपनी
इस मुहिम में सभी नागरिकों से सोयी सरकारों को जगाने में सहयोग की अपील
की है और आने बाले 15 फरवरी रविवार को राजधानी लखनऊ में गांधी पार्क
हज़रतगंज क्रासिंग के पास हस्ताक्षर अभियान आरम्भ करने की घोषणा भी की है.

कोई भी स्टडी या सर्वे l नहीं है यूपी सरकार के पास पिछले पांच सालों
में 'कुपोषण' की समस्या से ग्रसित पुरुषों , महिलाओं, किन्नरों, वालकों,
वालिकाओं और शिशुओं की संख्या की कोई भी सूचना l आखिर किस आधार पर
स्टेट न्यूट्रीशन मिशन के तहत जरूरतमंद लोगों तक पौष्टिक पदार्थ पहुंचाने
और इस मिशन से सूबे की एक लाख महिलाओं को जोड़े जाने के दावे कर रहे हैं
अखिलेश ? : शर्म करो,आखिर और कितना नीचे-नीचे-नीचे गिरोगे अखिलेश ! कम
से कम 'कुपोषण' जैसी समस्या को तो घिनौने राजनैतिक दाँव-पेंचों से मुक्त
रखा होता ।

सरकारी तामझाम और चमक-दमक के साथ आयोजित कार्यक्रम में बाल विकास
पुष्टाहार मंत्री की उपस्थिति में कुपोषण के खिलाफ 'राज्य पोषण मिशन'
(स्टेट न्यूट्रीशन मिशन) का शुभारंभ किया था l सीएम अखिलेश ने स्टेट
न्यूट्रीशन मिशन के तहत जरूरतमंद लोगों तक पौष्टिक पदार्थ पहुंचाने और
इस मिशन से सूबे की एक लाख महिलाओं को जोड़े जाने को अपना मकसद बताया था
।



यूपी के बाल विकास सेवा एवं पुष्टाहार निदेशालय द्वारा मेरी एक
आरटीआई के जबाब से सीएम अखिलेश ने स्टेट न्यूट्रीशन मिशन के तहत
जरूरतमंद लोगों तक पौष्टिक पदार्थ पहुंचाने और इस मिशन से सूबे की एक
लाख महिलाओं को जोड़े जाने को अपना मकसद बताने सम्बन्धी अखिलेश सरकार की
मंशा पर जबरदस्त जबरदस्त प्रश्नचिन्ह् लग रहा है l

मेरा सबाल है कि जब यूपी में सरकार ने पिछले पांच सालों में 'कुपोषण'
के सम्बन्ध में कोई कोई भी स्टडी या सर्वे नहीं कराया है और यूपी
सरकार के पास पिछले पांच सालों में 'कुपोषण' की समस्या से ग्रसित
पुरुषों , महिलाओं, किन्नरों, वालकों, वालिकाओं और शिशुओं की संख्या
की कोई सूचना भी नहीं है तो आखिर किस आधार पर अखिलेश ने स्टेट
न्यूट्रीशन मिशन के शुभारम्भ पर जरूरतमंद लोगों तक पौष्टिक पदार्थ
पहुंचाने और इस मिशन से सूबे की एक लाख महिलाओं को जोड़े जाने के दावे कर
दिए दिए थे ? मेरा मानना है कि जरूरतमंदों के सम्बन्ध में बिना
तथ्यों के ही उन तक पौष्टिक पदार्थ पहुंचाने और इस मिशन से सूबे की
लाखों महिलाओं को जोड़े जाने के दावे कर अखिलेश ने 'कुपोषण' जैसी
समस्या को भी अपने घिनौने राजनैतिक दाँव-पेंचों में फाँसकर सस्ती
लोकप्रियता पाने के लिए झूँठ बोलकर वास्तविक कुपोषितों का मज़ाक बनाया है
l



मेरा प्रश्न यह भी है कि आखिर कब शर्म करेंगे और आखिर कब तक अखिलेश सूबे
की जनता को इस प्रकार मूर्ख बनाने के लिए ऐसे झूठे-झूठे हथकंडे अपनाते
रहेंगे ? क्या अखिलेश गम्भीरतापूर्वक कार्य भी करेंगे या नयी घोषणाएं
और महज कोरी भाषणवाजी ही होती रहेगी ?

putting a big question Mark on Success of Modi's 'Swacch Bharat
Mission' in UP!: It is as if Laws are made only to keep them buried
deep in official shelves.

Success of Narendra Modi's dream project 'Swach Bharat', proposed to
be completed in the next five years upto 150th anniversary of Mahatma
Gandhi in 2019, seems to be impossible in Uttar Pradesh, the largest
populated state of India. .Yes I am saying this on the basis of a RTI
reply from directorate of Local bodies of UP which states that in UP
not even a single person has been fined for littering the Public
Places in any of the districts of Uttar Pradesh in last 5 years. Its
altogether a different thing that you n me might have seen signboards
with cautions of penalties for littering public places Though
cleanliness has direct relationship with well-being, we all know the
reality as to how these public places are being littered all across
UP.

Recently, Union Government has moved an amendment for a more
stringent anti-smoking law with radical changes, including ban on sale
of loose cigarettes, raising the minimum age of a person buying
tobacco products to 21 years from existing 18, raising of fine to Rs
1,000 from Rs 200 on smoking in public places, increasing the maximum
fine to Rs 1 lakh from the existing Rs 10,000 , Ban to employ, engage
or use any person who is under 18 years of age in cultivation,
processing, sale of tobacco or tobacco products and removal of
designated smoking zones in hotels and restaurants .Yes, I am talking
of Cigarettes and Other Tobacco Products (Prohibition of Advertisement
and Regulation of Trade and Commerce, Production, Supply and
Distribution) (Amendment) Bill 2015, which were put out by the health
ministry on to seek suggestions from the public. But How far this new
law shall be effective, can easily be gauged by a RTI reply from
directorate of Local bodies of UP which states that in UP not even a
single person has been fined for smoking in Public Places in any of
the districts of Uttar Pradesh in last 5 years.

यूपी में हैं तो बेखौफ, वेफिक्र चाहें जहां गन्दगी करें या धूम्रपान; आपको दण्डित किये जाने का कोई चाँस नहीं !

यूपी में मायाराज हो या अखिलेशराज, पिछले पांच सालों में सार्वजनिक
स्थलों पर 'गन्दगी करने' या 'धूम्रपान करने' के लिए दण्डित किये जाने का
कोई भी मामला नहीं है दर्ज ! यूपी में नरेंद्र मोदी के 'स्वच्छ भारत
अभियान' की सफलता की संभावनाओं पर प्रश्नचिन्ह् ! : क्या क़ानून महज
बनाने और सरकारी अलमारियों में दफ़न करने की चीज मात्र हैं ?

प्रिय मित्र,
यूपी के स्थानीय निकाय निदेशालय द्वारा मेरी एक आरटीआई के जबाब से
प्रधानमंत्री नरेन्द्र मोदी के स्वच्छ भारत अभियान और केंद्र सरकार के
धूम्रपान निरोधक कानून में संशोधन की कवायद के यूपी में सफल होने की
संभावनाओं पर जबरदस्त जबरदस्त प्रश्नचिन्ह् लग रहा है l

जब यूपी में सरकार ने पिछले पांच सालों में सार्वजनिक स्थलों पर 'गन्दगी
करने' के लिए दण्डित किये जाने का कोई भी मामला दर्ज ही नहीं किया है
तो यूपी में नरेंद्र मोदी के 'स्वच्छ भारत अभियान' की सफलता की संभावना
भी नगण्य ही है l

जब यूपी में सरकार ने धूम्रपान निरोधक कानून के तहत पिछले पांच सालों में
सार्वजनिक स्थलों पर 'धूम्रपान करने' के लिए दण्डित किये जाने का कोई भी
मामला दर्ज ही नहीं किया है तो इस संशोधन से भी किसी बदलाव की
उम्मीद करना बेकार है l

मेरा सबाल यह है कि क्या क़ानून महज बनाने और सरकारी अलमारियों में दफ़न
करने की चीज मात्र हैं ? क्या कभी हमारे नीति-नियंता इन कानूनों को लागू
कराने के गम्भीरतापूर्वक प्रयास भी करेंगे या नयी घोषणाएं और महज
कोरी भाषणवाजी ही होती रहेगी ?

Lucknow. 11/01/2015. यह बानगी है उन नारों की जो यूपी की
राजधानी लखनऊ में लगाते हुए आरटीआई कार्यकर्ताओं ने सूचना आयोगों में
सुनवाई के दौरान सूचनार्थियों को कुर्सी पर बैठाना सुनिश्चित कराने की
मांग समेत अन्य मांगों के लिए 'कुर्सी के साथ'हुंकार भरी l

तमिलनाडु में एक आरटीआई कार्यकर्ता के द्वारा कुर्सी मांगने पर सूचना
आयुक्तों द्वारा आरटीआई कार्यकर्ता को जेल भेजने के मामले से आक्रोशित
उत्तर प्रदेश के आरटीआई कार्यकर्ताओं ने आज लखनऊ के हज़रतगंज जीपीओ के
निकट महात्मा गांधी पार्क में 'कुर्सी' के साथ' धरना देकर देश भर के
सूचना आयोगों समेत सभी न्यायिक और अर्द्ध-न्यायिक प्रतिष्ठानों की
सुनवाइयों में सभी पक्षों को कुर्सी पर बैठाकर सुनवाई करने की मांग के
साथ देश के राष्ट्रपति, राष्ट्रीय मानवाधिकार आयोग के अध्यक्ष और देश
के सभी प्रदेशों के राज्यपालों को 11 सूत्रीय मांगो से सम्बंधित एक
ज्ञापन प्रेषित किया l

धरने में समाजसेवी नवीन तिवारी,उर्वशी शर्मा,संजय शर्मा,देवीदत्त
पाण्डेय,अशोक कुमार गोयल,हयात कादरी,राम स्वरुप यादव,सूरज प्रसाद,केदार
नाथ सैनी,ज्ञानेश पाण्डेय,होमेन्द्र कुमार,मीना पाण्डेय, तुलसी बल्लभ
गुप्ता,रोहित कुमार और अनामिका पोरवाल ने देश के आरटीआई एक्टिविस्टों
के मानवाधिकारों के संरक्षण के पक्ष में अपनी आवाज बुलंद की l

मानवाधिकार संरक्षण के क्षेत्र में कार्यरत सामाजिक संगठन 'तहरीर' के
संस्थापक संजय शर्मा ने बताया कि सूचना आयुक्तों द्वारा की जा रही
सुनवाइयों में सूचना मांगने बालों को खड़ा रहने को वाध्य करना सूचना
मांगने बालों के मानवाधिकारों का हनन है l सूचना आयुक्तों को सामंतवादी
मानसिकता का शिकार बताते हुए संजय ने कहा कि चाटुकारिता के चलते उच्च पद
पा गए सूचना आयुक्त शायद यह भूल रहे हैं कि देश में लोकशाही है जिसमे
जनता राजा है और सूचना आयुक्त जनता के सेवक मात्र हैं l

कार्यकर्ताओं ने धरने में लोकतंत्र समर्थक नारे लगाते हुए सूचना आयुक्तों
के विरुद्ध लंबित शिकायतों का निपटारा तीन माह में करने, सूचना आयुक्तों
के पद-ग्रहण से पूर्व उनको आरटीआई एक्ट और मानवाधिकारों सम्बन्धी
प्रशिक्षण अनिवार्य करने, सूचना मांगने बालों के खिलाफ शिकायत आने पर
उनके लंबित आरटीआई प्रकरणों को भी जांचों में शामिल करने समेत 11सूत्रीय
मांगो से सम्बंधित एक ज्ञापन राष्ट्रपति, राष्ट्रीय मानवाधिकार आयोग के
अध्यक्ष और देश के सभी प्रदेशों के राज्यपालों को प्रेषित किया l धरने
की समन्वयक संस्था द्वारा एक ज्ञापन राज्यपाल कार्यालय में प्राप्त भी
कराया गया l

संजय ने बताया कि वे देश के सभी प्रदेशों के आरटीआई और मानवाधिकार
कार्यकर्ताओं के संपर्क में हैं और यदि 3 माह में उनकी मांगें नहीं मानी
गयीं तो इस सम्बन्ध में शीघ्र ही देशव्यापी आंदोलन चलाया जायेगा l

धरने के बाद धरने की समन्वयक संस्था द्वारा एक ज्ञापन राज्यपाल कार्यालय
में प्राप्त कराया गया जिसकी स्कैन्ड कॉपी भी अपलोड की जा रही है l धरने
के कुछ फोटो भी अपलोड किये जा रहे हैं l

राष्ट्रपति, राष्ट्रीय मानवाधिकार आयोग के अध्यक्ष और देश के सभी

Sir/Madam,
TAHRIR ( Transparency, Accountability & Human Rights initiative for
revolution ) is a Bareilly/Lucknow based Social Organization, working
at grass-root level by taking up & solving issues related to
strengthening transparency & accountability in public life and
protection of Human Rights in India.

We are now writing to express our grave concern over incidents of
misbehavior with RTI users at the hands of Information commissioners
in various information commissions of India. A RTI users is a Human
Right Defenders ( HRDs).In all the cases of violations of human rights
of RTI users in the premises of Info-commissions, the information
commissioners are the Perpetrators. The Paris Principles are also not
followed in all matters relating to the CIC & SICs in the country when
they are actually Human Rights Institutions [HRIs] also and need to
adhere by the Paris Principles.

We are shocked by recent arrest of RTI activist Siva Elango in
Tamilnadu. Activists across the country have their experiences of
inhumane behavior by info-commissioners. UPSIC has long been harassing
RTI applicants and we have no hesitation to say that the
info-commissioners, who were perceived as the custodian of RTI act
have now started strangling the RTI Act. Like many other
info-commissions, UPSIC too has neglected the basic right of
activists to sit during a hearing. Previously IC Arvind Singh Bisht
sent Senior Citizen RTI activist Ashok Kumar Goyal to jail and very
recently same IC misbehaved with another Senior Citizen RTI activist
named Mahendra Agarwal. Activists in Uttar Pradesh are now scared to
appear in appeal proceedings in commissions as they may lodge cases
against them.

We feel that today the only jobs these commissions are performing are
to reject RTI applications and demoralize RTI applicants by harassing
them as the commissions allow government officials to sit during the
hearings, but they insist RTI applicants to stand till the proceedings
ends to demoralize them. The commissions are going easy on public
information officers (PIOs) who delay and deny information. Though the
commissions should impose a penalty of up to Rs 25,000 on a PIO for
failing to furnish information within 30 days and for deliberately
providing incorrect, incomplete and misleading information but they
are seldom doing it.No words can be strong enough to deprecate the
practice of making the parties to the proceedings stand like beggars,
especially when In Namit Sharma Case, the Apex Court has ruled that
Information Commissions are NOT judicial or quasi-judicial bodies.
There is lack of understanding of RTI Act by Info-commissions. Though
Sec 18 [3] gives Info-commissioners the status equal to a District
Judge who could exercise powers under Code of Civil Procedure 1908
[Order XVI] [Summoning & Attendance of Witnesses] but
info-commissioners had only power of a District Judge but they are not
a "Judge". So they have to exercise their authority / power through
authorities [Administration/Police]. Job of Information Commissioners
is only to ensure the petitioners get Information within time-frame
and nothing else.

We, therefore urge you to immediately take necessary steps to ensure that :
All judicial, quasi-judicial bodies and all commissions in the country
should offer a chair during proceedings.

i. All pending complaints of misbehavior/ misconduct and abuse of
authority against Information Commissioners be disposed-off on merits
within 3 months and all Info-commissioner, proved guilty be
immediately dismissed.
ii. All the appointments at info-commissions across the country be
made in a transparent manner while ensuring that persons of real
eminence, intact integrity and of Humane mindset are sent there for
working.
iii. All cases of harassment of RTI users, reported till now, be
probed immediately thorough transparent, effective and impartial
investigation.
iv. Rights of RTI activists who are also human rights defenders be
upheld including their right to associate, assembly, peacefully
protest, criticize and free expression – all of which have generally
been denied in all the cases reported so far.
v. Before registering the cases of the allegations against RTI users,
motive between the RTI user & the Information Commission and record of
pending applications of RTI user at info-commission be first taken
into account.
vi. All annual reports of the Info-commissions are made ready and
produced before the Parliament/ State Legislatures.
vii. Training on provisions of RTI act be mandatorily provided by
DoPT GOI New Delhi & State governments to all info-commissioners
before their taking the charge.
viii. NHRC & SHRCs are made to mandatorily undertake a special
training sessions for all Chairpersons and Members of all the CIC &
State Information Commissions.
ix. That the Judicial Academies be made to undertake a special
training on the rights of human rights defenders to all members of the
police & judiciary and to ensure that all police officers & judicial
officers are made to adhere strictly the law of arrest and judicial
remand as directed by the Criminal Procedure Code and the judgements
of the Hon'ble SC.
x. Local district officials puts an end to all acts of harassment
against all RTI Activists and all human rights defenders in general to
ensure that in all circumstances they carry out their activities
without any hindrances.
xi. Conform with the provisions of the UN Declaration on Human Rights
Defenders, adopted by the General Assembly of the United Nations on
December 9, 1998, especially Article 1, which states that "everyone
has the right, individually and in association with others, to promote
and to strive for the protection and realization of human rights and
fundamental freedoms at the national and international levels",Article
12.2, which provides that ""the State shall take all necessary
measures to ensure the protection by the competent authorities of
everyone, individually and in association with others, against any
violence, threats, retaliation, de facto or de jure adverse
discrimination, pressure or any other arbitrary action as a
consequence of his or her legitimate exercise of the rights referred
to in the present Declaration" and More generally, ensure in all
circumstances the respect for human rights and fundamental freedoms in
accordance with in accordance with the Universal Declaration of Human
Rights and with international human rights instruments ratified by
India is strictly adhered to in India .

कंट्रोल ट्वीट' महज कोरे वक्तव्य हैं l मुख्यमंत्री कार्यालय ने इस
सम्बन्ध में किसी भी अभिलेखीय साक्ष्य को सर्वजनिक नहीं किया है l यूपी
सरकार और इसके मंत्री तो झूठे वक्तव्य देने के लिए ही जाने जाते हैं अतः
मुख्यमंत्री कार्यालय के दोनों 'डैमेज कंट्रोल ट्वीट' की सत्यता जांचने
हेतु मैंने सूचना और प्रसारण मंत्री अरुण जेटली से फ़िल्म 'पीके' के
निर्माता, यूएफओ मूवीज और क्लब एक्स प्रीमियर्स को जांच के दायरे में
लाकर जांच कराने की मांग की है l

मैंने यूपी के मुख्यमंत्री कार्यालय में एक आरटीआई भी दायर की है और मुझे
विश्वास है कि यूपी सीएम कार्यालय में दायर यह आरटीआई सच से पर्दा अवश्य
उठाएगी l

These screenshots taken by me make it clear that everything is not

फिल्म पीके का विडियो सीडी जारी नहीं हुआ है और ऐसा फिल्म की आधिकारिक
रिलीज के 90 दिन बाद ही होगा। ऐसे में अखिलेश ने जिस तरीके से फिल्म
देखी, वह एक अपराध है।पिछले आई ऋतिक रोशन की फिल्म 'बैंग बैंग' की
पाइरेसी मामले में दिल्ली हाईकोर्ट ने बेहद कड़ा फैसला सुनाया था। दिल्ली
हाई कोर्ट ने विभिन्न इंटरनेट और टेलीकॉम सेवा प्रदाता कंपनियों को उन 72
वेबसाइट को ब्लॉक करने का आदेश दिया था जिन्होंने 'बैंग बैंग' को पाइरेसी
के जरिए रिलीज से पहले ही लोगों तक पहुंचा दिया था।

अखिलेश भले ही सैफई महोत्सव में महिला सशक्तीकरण की बात करें, कैबिनेट
में राज्य महिला सशक्तिकरण मिशन के लिए प्रावधान को मंजूरी दें ,रानी
लक्ष्मीबाई सम्मान कोष की स्थापना करें या महिला हेल्पलाइन की बात करें
या और कोई घोषणा पर यदि राज्य महिला आयोग के आंकड़ों को सूचक माना जाये
तो सिद्ध होता है कि महिलाओं के सम्मान को सुरक्षित रखने, महिला अपराधों
पर लगाम लगाने और पीड़ित महिलाओं को मदद मुहैया कराने में अपने ढाई वर्ष
के कार्यकाल में अखिलेश यादव अपनी पूर्ववर्ती मायावती के मुकाबले नितांत
असफल ही रहे हैं l

महिला आयोग में मेरे द्वारा दायर एक आरटीआई से खुलासा हुआ है कि मायावती
के नेतृत्व बाली बहुजन समाज पार्टी सरकार के मुकाबले अखिलेश के नेतृत्व
बाली समाजवादी सरकार में महिला आयोग में दर्ज शिकायतों में 42% की वृद्धि
हुई तो वहीं मामलों के निस्तारण में 45% की कमी आयी है l मायाराज में
महिला आयोग में दर्ज शिकायतों के निस्तारण की दर 85% थी जो अखिलेश के समय
में घटकर महज 33% रह गयी है जिसकी वजह से महिला आयोग में लंबित मामलों
में 557% की भारीभरकम बढ़ोत्तरी दर्ज की गयी है l सभी आंकड़े मायावती के
अंतिम ढाई वर्ष के कार्यकाल और अखिलेश के आरंभिक ढाई वर्ष के कार्यकाल
के हैं l


महिला आयोग के आंकड़े बताते हैं कि मायावती के अंतिम ढाई वर्ष के कार्यकाल
( 15-09-2009 से 14-03-2012 तक ) में महिला आयोग को महिला उत्पीड़न के
55301 मामले पंहुचे जो अखिलेश के आरंभिक ढाई वर्ष के कार्यकाल (
15-03-2012 से 14-09-2014 तक ) में बढ़कर 78483 हो गए l मायावती के अंतिम
ढाई वर्ष के कार्यकाल ( 15-09-2009 से 14-03-2012 तक ) में महिला आयोग
द्वारा महिला उत्पीड़न के 47319 मामले निस्तारित हुए जो अखिलेश के
आरंभिक ढाई वर्ष के कार्यकाल ( 15-03-2012 से 14-09-2014 तक ) में घटकर
26007 रह गए l वित्तीय वर्ष 2014 -15 में 16 दिसम्बर तक राज्य महिला
आयोग गैर वेतन मद में प्राप्त 1 करोड़ में से 40 लाख से भी कम धनराशि
ही खर्च कर पाया है l


इन आंकड़ों के खुलासे से अखिलेश के महिला-अस्मिता सुरक्षित रखने के वादे
कटघरे में आ गए है और महिला आयोग की कार्यप्रणाली पर एक बड़ा प्रश्नचिन्ह
लग गया है l इन आंकड़ों के खुलासे से यूपी पुलिस की महिलाओं को न्याय दे
पाने में असफलता भी सामने आ रही है क्योंकि एक महिला पुलिस से निराश होने
पर ही महिला आयोग में जाती है l महिला आयोग की अकर्मण्यता का तो हाल ये
है कि 25 सदस्यीय महिला आयोग वित्तीय वर्ष 2014 -15 के 71% समय में गैर
वेतन मद का महज 40 % ही खर्च कर पाया है हाँ यह बात अलग है कि महिला
आयोग के अधिकांश सदस्य सत्ताधारी समाजवादी पार्टी के 'प्रचारकों' का काम
बखूबी कर रहे हैं l

BAHINJI's , reveals RTI

Dear Friend,
As soon as power was exchanged in UP from BSP to SP, Uttar Pradesh
State Women Commission ( UPSWC ) receipt counters witnessed spurt in
complaints from victim women of UP and situation is even worsening
with SP nearing to complete its third year in Power. All the
inaugurations and launchings, made by Akhilesh Yadav, in the name of
Women-empowerment or in the name of stalling the crimes against women
etc. have proved to be mere rhetoric with no actual respite to the
half-population of the largest ( population-wise) state of India.

RTI data received under RTI from UPSWC paints a seriously grim picture
of two & half year rule of Akhilesh Yadav, with is exactly half tenure
of present Government (provided claims made by Laxmikant Bajpai of
BJP about SP 70 MLAs being in touch with BJP are not true ).RTI data
immensely downgrades Akhilesh Yadav with respect to his predecessor
Mayawati when it comes to safety and security of women in UP.

RTI data also exposes UP police department's inability to properly
address cases related to crime against women because its an eternal
truth that a women approaches women commission only when she fails to
get justice from the police.

Snapshots of data comparison of ending two & half year rule of
Mayawati & two & half year rule of Akhilesh Yadav reveals that crime
against women increased by 42% in Tipu's Raj as compared to Bahinji's.
Victim Women became more helpless in SP's rule as disposal rate of
complaints received in UPSWC decreased by 45% as compared to BSP's
Rule. Even UPWC failed to properly address the traumatic problems of
half-population of UP as pendency rose by a whopping 557% in Akhiles's
regime when compared to Mayawati's. Disposal rate at UPWC was 85% in
Mayaraj which has diminished to a mere 33% in Akhileshraj despite
there being 25 members working at UPSWC ( including Chairman ).

RTI shows that UPSWC's other than salary budget is Rs. 1 crore but
during 8 & a half months time UPSWC has consumed less than 40 lakh
rupees meaning thereby that during 71% time of this fiscal UPSWC has
consumed 40% of its fiscal non-salary allocations. To me, this is
just because of slack, indifferent, insensitive and corrupt mindset of
members at UPWC towards problems of women who are there just to
show-off there position and later be a part of general- loot-culture
like all other government departments consuming there budgets during
end of month of march in that fiscal year.

If Akhilesh Yadav will still say that as a CM, he really feels the
woes of Women living in UP and is serious to address & resolve them?
To me he is only a good actor which he should be because he has long
been in the company of acting-stalwarts like Big B, Jaya Prada, Jaya
Bacchan and many more. But People don't want actors acting while
sitting in the chair of Rulers. People want honest hearts and when one
inaugurates something with honest heart, the whole world tastes the
fruit of success cultivated out of this inauguration.

The big question is whether situation will not deteriorate in rest 2 &
½ year rule Akhilesh and will Akhilesh be able to move nearer and/or
touch the benchmarks on women-safety, set by his predecessor Mayawati,
leave alone the question of surpassing them.

My straight answer is, not at all and this answer is just because in
his first half tenure as CM, Akhilesh has, through his various acts
have proved that he is too immature a politician to effectively rule a
state like UP.

½ year rule Akhilesh and will Akhilesh be able to move nearer and/or
touch the benchmarks on women-safety, set by his predecessor Mayawati,
leave alone the question of surpassing them.

My straight answer is, not at all and this answer is just because in
his first half tenure as CM, Akhilesh has, through his various acts
have proved that he is too immature a politician to effectively rule a
state like UP.

42% increase in cases of crime against women, 45% decrease in disposal
of women's complaints, 557% increase in pendency of women's
complaints, disposal diminished from 85% to 33% in SP's rule : In
71% time of this fiscal UPSWC merely consumed 40% of its non-salary

अखिलेश भले ही सैफई महोत्सव में महिला सशक्तीकरण की बात करें, कैबिनेट
में राज्य महिला सशक्तिकरण मिशन के लिए प्रावधान को मंजूरी दें ,रानी
लक्ष्मीबाई सम्मान कोष की स्थापना करें या महिला हेल्पलाइन की बात करें
या और कोई घोषणा पर यदि राज्य महिला आयोग के आंकड़ों को सूचक माना जाये
तो सिद्ध होता है कि महिलाओं के सम्मान को सुरक्षित रखने, महिला अपराधों
पर लगाम लगाने और पीड़ित महिलाओं को मदद मुहैया कराने में अपने ढाई वर्ष
के कार्यकाल में अखिलेश यादव अपनी पूर्ववर्ती मायावती के मुकाबले नितांत
असफल ही रहे हैं l

महिला आयोग में मेरे द्वारा दायर एक आरटीआई से खुलासा हुआ है कि मायावती
के नेतृत्व बाली बहुजन समाज पार्टी सरकार के मुकाबले अखिलेश के नेतृत्व
बाली समाजवादी सरकार में महिला आयोग में दर्ज शिकायतों में 42% की वृद्धि
हुई तो वहीं मामलों के निस्तारण में 45% की कमी आयी है l मायाराज में
महिला आयोग में दर्ज शिकायतों के निस्तारण की दर 85% थी जो अखिलेश के समय
में घटकर महज 33% रह गयी है जिसकी वजह से महिला आयोग में लंबित मामलों
में 557% की भारीभरकम बढ़ोत्तरी दर्ज की गयी है l सभी आंकड़े मायावती के
अंतिम ढाई वर्ष के कार्यकाल और अखिलेश के आरंभिक ढाई वर्ष के कार्यकाल
के हैं l


महिला आयोग के आंकड़े बताते हैं कि मायावती के अंतिम ढाई वर्ष के कार्यकाल
( 15-09-2009 से 14-03-2012 तक ) में महिला आयोग को महिला उत्पीड़न के
55301 मामले पंहुचे जो अखिलेश के आरंभिक ढाई वर्ष के कार्यकाल (
15-03-2012 से 14-09-2014 तक ) में बढ़कर 78483 हो गए l मायावती के अंतिम
ढाई वर्ष के कार्यकाल ( 15-09-2009 से 14-03-2012 तक ) में महिला आयोग
द्वारा महिला उत्पीड़न के 47319 मामले निस्तारित हुए जो अखिलेश के
आरंभिक ढाई वर्ष के कार्यकाल ( 15-03-2012 से 14-09-2014 तक ) में घटकर
26007 रह गए l वित्तीय वर्ष 2014 -15 में 16 दिसम्बर तक राज्य महिला
आयोग गैर वेतन मद में प्राप्त 1 करोड़ में से 40 लाख से भी कम धनराशि
ही खर्च कर पाया है l


इन आंकड़ों के खुलासे से अखिलेश के महिला-अस्मिता सुरक्षित रखने के वादे
कटघरे में आ गए है और महिला आयोग की कार्यप्रणाली पर एक बड़ा प्रश्नचिन्ह
लग गया है l इन आंकड़ों के खुलासे से यूपी पुलिस की महिलाओं को न्याय दे
पाने में असफलता भी सामने आ रही है क्योंकि एक महिला पुलिस से निराश होने
पर ही महिला आयोग में जाती है l महिला आयोग की अकर्मण्यता का तो हाल ये
है कि 25 सदस्यीय महिला आयोग वित्तीय वर्ष 2014 -15 के 71% समय में गैर
वेतन मद का महज 40 % ही खर्च कर पाया है हाँ यह बात अलग है कि महिला
आयोग के अधिकांश सदस्य सत्ताधारी समाजवादी पार्टी के प्रचारकों का काम
बखूबी कर रहे हैं l



As soon as power was exchanged in UP from BSP to SP, Uttar Pradesh
State Women Commission ( UPSWC ) receipt counters witnessed spurt in
complaints from victim women of UP and situation is even worsening
with SP nearing to complete its third year in Power. All the
inaugurations and launchings, made by Akhilesh Yadav, in the name of
Women-empowerment or in the name of stalling the crimes against women
etc. have proved to be mere rhetoric with no actual respite to the
half-population of the largest ( population-wise) state of India.

RTI data received under RTI from UPSWC paints a seriously grim picture
of two & half year rule of Akhilesh Yadav, with is exactly half tenure
of present Government (provided claims made by Laxmikant Bajpai of
BJP about SP 70 MLAs being in touch with BJP are not true ).RTI data
immensely downgrades Akhilesh Yadav with respect to his predecessor
Mayawati when it comes to safety and security of women in UP.

RTI data also exposes UP police department's inability to properly
address cases related to crime against women because its an eternal
truth that a women approaches women commission only when she fails to
get justice from the police.

Snapshots of data comparison of ending two & half year rule of
Mayawati & two & half year rule of Akhilesh Yadav reveals that crime
against women increased by 42% in Tipu's Raj as compared to Bahinji's.
Victim Women became more helpless in SP's rule as disposal rate of
complaints received in UPSWC decreased by 45% as compared to BSP's
Rule. Even UPWC failed to properly address the traumatic problems of
half-population of UP as pendency rose by a whopping 557% in Akhiles's
regime when compared to Mayawati's. Disposal rate at UPWC was 85% in
Mayaraj which has diminished to a mere 33% in Akhileshraj despite
there being 25 members working at UPSWC ( including Chairman ).

RTI shows that UPSWC's other than salary budget is Rs. 1 crore but
during 8 & a half months time UPSWC has consumed less than 40 lakh
rupees meaning thereby that during 71% time of this fiscal UPSWC has
consumed 40% of its fiscal non-salary allocations. To me, this is
just because of slack, indifferent, insensitive and corrupt mindset of
members at UPWC towards problems of women who are there just to
show-off there position and later be a part of general- loot-culture
like all other government departments consuming there budgets during
end of month of march in that fiscal year.

If Akhilesh Yadav will still say that as a CM, he really feels the
woes of Women living in UP and is serious to address & resolve them?
To me he is only a good actor which he should be because he has long
been in the company of acting-stalwarts like Big B, Jaya Prada, Jaya
Bacchan and many more. But People don't want actors acting while
sitting in the chair of Rulers. People want honest hearts and when one
inaugurates something with honest heart, the whole world tastes the
fruit of success cultivated out of this inauguration.

The big question is whether situation will not deteriorate in rest 2 &
½ year rule Akhilesh and will Akhilesh be able to move nearer and/or
touch the benchmarks on women-safety, set by his predecessor Mayawati,
leave alone the question of surpassing them.

instead of doing something concrete to stop the homeless from dying
due to cold, UP Govt. is busy providing 'Right to Entertainment' to
Safai.
Recently, Uttar Pradesh's biggest rural festival, Saifai Mahotsava,
being held at the native village of Uttar Pradesh Chief Minister
Akhilesh Yadav, organised by the Samajwadi Party MP Tej Pratap Yadav
was inaugurated by Rajya Sabha MP Jaya Bachchan. Ruling Yadav clan of
Uttar Pradesh was present in full force at Samajwadi Party president
Mulayam Singh Yadav's home district Mainpuri last Friday to launch the
17th edition of Saifai Mahotsav.
In 2013, the extravagant festival was criticised in view of the
Muzaffaranagar riots. Facing flak over the festivities in Saifai, Last
year Uttar Pradesh Government went too law to ban media from Saifai
Mahotsav from covering the event.
However, that did not deter Samajwadi Party Government to celebrate
the festival this year. Mulayam Singh Yadav went ahead and said that
not only the people living in urban centers have the right to enjoy
dance, but rural folks also take pleasure in it. Mulayam linked it to
'right to entertainment'.
Mulayam Singh's nephew Ranbir Singh used to hold an annual wrestling
meet in Saifai but after his demise in 1997, the party started
organising the event as Saifai Mahotsav every year so much so that the
event became a state financed event whenever Samajwadi party was in
Power in Uttar Pradesh.
This year also, Uttar Pradesh's Culture Department Secretary Anita
Meshram might have made media statements that state government has
approved Rs. 1 crore for the mahotsav but the fact is that the state
funded Saifai mahotsavs are closely-guarded secrets for UP government
so much so that Culture department's spineless officials are forced to
make lame excuses and play 'Hide & Seek' with info-seeker's RTI pleas
just to avert disclosure of info even when sought under RTI act.
A year ago, on 26-12-2013, this Lucknow based Social Activist Sanjay
Sharma had shot off a RTI plea to the PIO of CM office of UP. On first
point, Sanjay sought documents contained in files related to the whole
processes from proposal to decision making regarding organizing of all
Saifai Mahotsavas to which Dr. Lavkush Dwivedi of Culture Directorate
of UP, on 18 December 2014, has informed Sanjay that Information
sought by him is not clear. On Second point, Sanjay sought info of
Money spent from state coffers on all 'Safai Mahotsavas' ( Starting
from very first Mahotsava ) to which Dr. Lavkush Dwivedi has written
that it was not clear in RTI plea as to details of which year were
sought by Sanjay. On Third point, Sanjay sought Money earned by state
Govt. from organizing of all 'Safai Mahotsavas' ( Starting from very
first Mahotsava ) to which Dr. Lavkush Dwivedi has written that No
such points related to income from organizing of all 'Safai
Mahotsavas' are concern of Culture Department.
"Saifai mahotsavs are closely-guarded secrets for UP government so
much so that Culture department's spineless officials are forced to
make lame excuses and play 'Hide & Seek' with my RTI plea just to
avert disclosure of info even when sought under RTI act, so I have
every reason to doubt intentions of SP Govt. in organizing such
Mahotsavas" said Sanjay.
Sanjay told that on 13 January 2014,he had filed another RTI
application in the office of the district magistrate, Etawah but this
has got no response till date. This application sought response on the
money spent in holding the event, guest list, programme list, money
spent by district administration and state government and frequency of
flights that operated to bring guests to the venue but on none of the
eleven points information ever came. "Even UP state information
commission, full of sycophant info-commissioners, refused to listen to
my complaint and same was dismissed by Information commissioner Vijay
Shankar Sharma" said Sanjay.
With grim picture being painted by UPSIC, the highest authority in
RTI matters in UP, Sanjay feels that info on loot of public money on
such events shall always remain a secret.
Terming State Govt's illogical viewpoint of providing 'Right to
Entertainment' to Safai @ deprivation of 'Right to life' to homeless
of UP as tragic, inhumane and autocratic, Sanjay condemned spending on
Safai Mahotsava from State coffers as a shear wastage of public money
and that too only to quench of thirst of unending Ego of political
rulers of UP and referring the Death Toll In Uttar Pradesh Due to Cold
as 125, demanded the Govt. to ensure 'Right to Life' to each n every
homeless of UP before going to Safai like events.
Sanjay told that he is approaching Raj Bhavan of UP to personally
meet the Governor and apprise him of this high handed approach of
rulers of UP in this matter in detail to bring things to their logical
ends.

We, at TAHRIR feel that State Government's illogical viewpoint of
providing 'Right to Entertainment' to Safai at the cost of deprivation
of 'Right to life' to homeless of UP is tragic, inhumane and
autocratic and so we are condemning these behind the iron-curtain
spending on Safai Mahotsava from State coffers as a shear wastage of
public money and that too when all this is being done at the whims &
fancies of ruling Yadav Clan of UP, just to quench of thirst of
unending Ego of these insensitive political rulers of UP.

TAHRIR feels that the death toll In Uttar Pradesh Due to Cold as 125
is a not only deprivation of 'Right to life' to the deceased but a
complete failure of UP Government's functioning also and so we are
raising our demand to inquire all incidents of these deaths, get FIRs
of murder registered against the public authorities who failed to
protect these deaths due to cold and take appropriate measures to
ensure 'Right to Life' to each n every homeless of UP before
Government is going to Safai Mahotsava like events.

Sir, TAHRIR is , through this memorandum approaching your good-self to
personally meet us so that we should apprise your good-self with
TAHRIR's point of view of this high handed approach of rulers of UP in
this matter in detail so that things should be brought to their
logical ends. In the meantime, your good-self is requested to
intervene and take appropriate action in this matter and oblige.

India.///Death Toll In Uttar Pradesh Due to Cold has Rises to 125 but
instead of doing something concrete to stop the homeless from dying
due to cold, UP Govt. is busy providing 'Right to Entertainment' to
Safai.

Recently, Uttar Pradesh's biggest rural festival, Saifai Mahotsava,
being held at the native village of Uttar Pradesh Chief Minister
Akhilesh Yadav, organised by the Samajwadi Party MP Tej Pratap Yadav
was inaugurated by Rajya Sabha MP Jaya Bachchan. Ruling Yadav clan of
Uttar Pradesh was present in full force at Samajwadi Party president
Mulayam Singh Yadav's home district Mainpuri last Friday to launch the
17th edition of Saifai Mahotsav.


In 2013, the extravagant festival was criticised in view of the
Muzaffaranagar riots. Facing flak over the festivities in Saifai, Last
year Uttar Pradesh Government went too law to ban media from Saifai
Mahotsav from covering the event.
However, that did not deter Samajwadi Party Government to celebrate
the festival this year. Mulayam Singh Yadav went ahead and said that
not only the people living in urban centers have the right to enjoy
dance, but rural folks also take pleasure in it. Mulayam linked it to
'right to entertainment'.

Mulayam Singh's nephew Ranbir Singh used to hold an annual wrestling
meet in Saifai but after his demise in 1997, the party started
organising the event as Saifai Mahotsav every year so much so that the
event became a state financed event whenever Samajwadi party was in
Power in Uttar Pradesh.

This year also, Uttar Pradesh's Culture Department Secretary Anita
Meshram might have made media statements that state government has
approved Rs. 1 crore for the mahotsav but the fact is that the state
funded Saifai mahotsavs are closely-guarded secrets for UP government
so much so that Culture department's spineless officials are forced to
make lame excuses and play 'Hide & Seek' with info-seeker's RTI pleas
just to avert disclosure of info even when sought under RTI act.

A year ago, on 26-12-2013, this Lucknow based Social Activist Sanjay
Sharma had shot off a RTI plea to the PIO of CM office of UP. On first
point, Sanjay sought documents contained in files related to the whole
processes from proposal to decision making regarding organizing of all
Saifai Mahotsavas to which Dr. Lavkush Dwivedi of Culture Directorate
of UP, on 18 December 2014, has informed Sanjay that Information
sought by him is not clear. On Second point, Sanjay sought info of
Money spent from state coffers on all 'Safai Mahotsavas' ( Starting
from very first Mahotsava ) to which Dr. Lavkush Dwivedi has written
that it was not clear in RTI plea as to details of which year were
sought by Sanjay. On Third point, Sanjay sought Money earned by state
Govt. from organizing of all 'Safai Mahotsavas' ( Starting from very
first Mahotsava ) to which Dr. Lavkush Dwivedi has written that No
such points related to income from organizing of all 'Safai
Mahotsavas' are concern of Culture Department.

"Saifai mahotsavs are closely-guarded secrets for UP government so
much so that Culture department's spineless officials are forced to
make lame excuses and play 'Hide & Seek' with my RTI plea just to
avert disclosure of info even when sought under RTI act, so I have
every reason to doubt intentions of SP Govt. in organizing such
Mahotsavas" said Sanjay.


Sanjay told that on 13 January 2014,he had filed another RTI
application in the office of the district magistrate, Etawah but this
has got no response till date. This application sought response on the
money spent in holding the event, guest list, programme list, money
spent by district administration and state government and frequency of
flights that operated to bring guests to the venue but on none of the
eleven points information ever came. "Even UP state information
commission, full of sycophant info-commissioners, refused to listen to
my complaint and same was dismissed by Information commissioner Vijay
Shankar Sharma" said Sanjay.

With grim picture being painted by UPSIC, the highest authority in RTI
matters in UP, Sanjay feels that info on loot of public money on such
events shall always remain a secret.

Terming State Govt's illogical viewpoint of providing 'Right to
Entertainment' to Safai @ deprivation of 'Right to life' to homeless
of UP as tragic, inhumane and autocratic, Sanjay condemned spending on
Safai Mahotsava from State coffers as a shear wastage of public money
and that too only to quench of thirst of unending Ego of political
rulers of UP and referring the Death Toll In Uttar Pradesh Due to Cold
as 125, demanded the Govt. to ensure 'Right to Life' to each n every
homeless of UP before going to Safai like events.

Sanjay told that he is approaching Raj Bhavan of UP to personally meet
the Governor and apprise him of this high handed approach of rulers of
UP in this matter in detail to bring things to their logical ends.
