कराकर श्री राजेश चंद्रा द्वारा अवैध रूप से किये गए कार्यों को
शून्यीकृत घोषित कराते हुए श्री राजेश चंद्रा को कठोर दंड देने की

LUCKNOW: The Right to Information (RTI) Act may have helped unearth
some of the biggest scams and anomalies in schemes like NRHM and
MGNREGA, but it is yet to become a potent tool to fight injustice for
the common man. And the biggest stumbling block is the attitude of the
government departments. The Act lays down that information should be
provided within 30 days to the seeker.

But a survey taken up by an NGO shows that six months is the average
time taken to answer an RTI query in UP by the government departments.
Most of the times, information provided is either incomplete or
irrelevant. The number of rising complaints at the State Information
Commission (SIC) shows that government departments are yet to take the
Act seriously.

"Reason why we get more complaints than appeals is the non-functional
first appeals authority," said an information commissioner. The RTI
Act was enacted by the Parliament on June 15, 2005. In UP, the Act was
made functional in April 2006. Despite being in existence for the past
six years, the Act is yet to be implemented in letter and spirit in
the state. Talking to RTI applicants who come to the commission
everyday from far-flung districts makes one realise the ground
reality.

Many applicants said that they had missed the date of hearing in their
case on some or the other occasion in the past because they did not
get the notice by the commission delivered on time. The commission,
though, has started uploading the cause list on its website, the low
net penetration does not make it happening. There are applicants who
have waited for years to get the information they sought. The poor
level of awareness about the Act is another major roadblock. The
government should keep conducting workshops and seminars to educate
people and officers about the Act. A lot can be changed for RTI if
State Information Commission (SIC) is given financial autonomy.
"Central government should fund state information commissions to
retain their autonomous structure," said sources. State government can
allocate a contingency fund for the SIC also.

LUCKNOW: The RTI applicants who make several rounds of the state
information commission to obtain the copy of the orders pertaining to
their RTI applications will heave a sigh of relief. The Uttar Pradesh
State Information Commission (UPSIC) has finally started uploading its
orders on the website. Applicants can log on to the commission's
website (upsic.up.nic.in) and get the orders downloaded.

The applicants can do it from their respective districts. Officials at
the commission shared that orders are being uploaded on a daily basis,
as soon as the copy of the judgment is made available to the online
department.The commission is also planning to upload the orders passed
in the past. "But that will take sometime," said officials. The
digitalisation of records at the commission was a long-pending move.
There were growing complaints that applicants were being harassed by
the staff of the commission when they sought the copy of the orders.
The online data will cut down the complaints.The commission had got
central funds to make its data available online, last financial year.
In response to an RTI query, the department of Personnel and Training
(DoPT), New Delhi, said it had allocated Rs 21 lakh to the commission
for digitalisation.

The commission had got funds, in the past as well, to make most of its
functioning online. However, the commission could only upload the
information about upcoming cases for hearing, in all these years, to
inform the applicants.The UPSIC will enter its seventh year of
functioning on March 22, 2012. And, it still does not have compiled
data on number of orders passed by different information
commissioners. The digitalisation of records can make it possible.

UPSIC starts (negligible) uploading of its orders of its choice

dear all,

since long we had put our tremondous efforts to get the orders
uploaded on UPSIC website.

from sending memorandums to the authorities , discussing the matter
with the upsic and administrative reforms department (ADR )to press
our demand , raising RTIs with central government , upsic & ADR ,
holding public meetings and dharnas to press our demand , the
activists toiled hard to achieve this .

our relentless efforts have been successful to the extent that upsic
has now started uploading some of its orders on its website. though
the uploaded orders constitute a negligible fraction of total orders
but this is a ray of hope to all the activists of uttar pradesh.

from the beginning our demand is to have 100 percent orders on the website.

we thank all who gave us support in this endeavour and ask them for
more support in the days to come so that we should find all the orders
of upsic on its website.

tomorrow i shall visit upsic to press our demand of uploading of all
upsic orders on its website.

In a Strange case of its own class , Rajesh Chandra the APIO /the
principal of lucknow based G. B. Pant Polytechnic denied info to the
info-seeker though the Appellate Authority had ordered the PIO to
provide the info .
Lucknow based Social worker & RTI Activist Urvashi SharmaUrvashi
Sharma sent request under RTI act 2005 to the PIO of the said
institute to get certified copies of certain records . Urvashi got no
reply within 30 days and was forced to send first appeal which was
decided on 21-02-12 by the appellate authority who directed the PIO
for discharge of the information i.e. certified copies as required by
Urvashi.
"When I got reply to my RTI query , I was shocked to see that the APIO
denied the same info for which the appellate authority has already
directed the PIO for discharge of the information .The reply was sent
by the APIO and the principal of the said institute Rajesh Chandra
vide letter no. C-1151/sa.ka./poly/2011-12 dated 02-03-2012 .This
shows the pathetic state of RTI implementation in Uttar Pradesh .
Public Servants like Rajesh Chandra are a black spot on the face of
our civilization which wants to fight corruption with crusaders like
Anna Hazare . Rajesh Chandra deliberately violated subsection 2 of
section 6 of RTI act 2005 by raising objectionable queries to me
thereby completely ignoring Subsection 2 of section 6 of RTI act 2005
which clearly states "An applicant making request for information
shall not be required to give any reason for requesting the
information or any other personal details except those that may be
necessary for contacting him."

This act of Rajesh Chandra is highly unwarranted and shows that either
he is unable to understand the RTI Act or is deliberately

violating the RTI act 2005 . Rajesh Chandra went to the extent of
disobeying the orders of the Appellate Authority who has directed the
PIO for discharge of the info as required by me. This act of Rajesh
Chandra is highly unwarranted and shows that he works arbitrarily in
an autocratic manner and is not concerned to obey the orders of the
superiors at all , that too in a matter related to the implementation
of RTI act . I am sure that the APIO Rajesh Chandra denied the
certified copies of records to me with the malafide intent to keep his
irregularities / corruption under wrap." told Urvashi.
With today's swearing-in ceremony of the new and the youngest chief
minister of the state , Uttar Pradesh is rising high on the hopes that
things shall get into shape, but how far these hopes shall turn into
reality , Only time will tell .

irregularities/corruption under cover

dear all
I am presenting before you the case of a RTI act violator and a
disobedient public servant Mr. Rajesh Chandra the Principal of
Government Govind Ballabh Pant Polytechnic Mohan Road Lucknow, the
APIO who has become so much autocratic in his behavior that he
disobeyed orders of the Appellate Authority and denied info with the
malafide intent to shield his irregularities/corruption.


The case goes like this . I sent request under RTI act 2005 to the PIO
of the said institute on 12-01-12 to get certified copies of certain

I got no reply within 30 days and was forced to send first appeal
which was decided by the appellate authority who directed the PIO for
discharge of the information i.e. certified copies as required by me.

When I got reply to my RTI query dated 12-01-12 , I was shocked .The
reply was sent by the APIO and the principal of the said
institute Mr. Rajesh Chandra vide letter no.

A perusal of the said letter of Mr. Rajesh Chandra ,the APIO & the
Principal of Government Govind Ballabh Pant Polytechnic Mohan Road
Lucknow reveals that Mr. Rajesh Chandra has :-
1. deliberately violated subsection 2 of section 6 of RTI act 2005 by

Rajesh Chandra : Principal Government G. B. Pant Polytechnic : A Wolf in a Sheep's Skin

Based on various complaints received on the Mobile Helpline against
Corruption , I am submitting this feature on fraud ,Financial
Illegalities / Economic Offences ,Administrative Incapability and
autocratic attitude of Mr. RajeshChandra the Principal of Government
G.B.Pant Polytechnic , Lucknow .


1- Fraud

A} by altering letter no. 874-82 dated 26-11-11 issued by the
office of the said institute and also destroying/suppressing the
original government record;

B} By skipping the filing of F.I.R. filed and investigation in cases
of theft and burglary in the institute that were
reported to principal of the institute by the various employees;

2- Financial Illegalities/Economic Offences in given cases
A}Forwarding Vehicle Loan Advance form of contractual employee Mr.
Pawan Kumar Mishra to Directorate of social Welfare ( Reference letter
no.428-29 dated 10 May 2011 issued by Directorate of social Welfare
);

B}Granting annual increment to Mr. Pawan Kumar Mishra effective from
the very first day i.e.01-06-2001 of his joining the post of Workshop
Superintendent ( Reference letter no. C-1541 dated 22 February 2011
issued by the office of the said institute);

C}Granting benefits of up-gradation to Assistant Lecturers of the
said institute effective from 19-08-2008 though they were entitled to
get the same effective from 09-11-2010 ( Reference letter no. 3534
dated 09-11-10 issued by Social Welfare Section -1 of Uttar Pradesh
Government);

D}Delay in recovery of penalty imposed on 28-04-2009 by UPSIC on the
Principal of the said Institute in case no. 3848/C/S-1/2007 (
Reference letter no. 1523 dated 07-09-11 issued by administrative
reforms Section -2 of Uttar Pradesh Government);

3- Administrative Incapability cases

A} Administrative Incapability in carrying out academic activities in
the said Institute and thus ruining the future of Scheduled Caste

Students ( Reference letter no. C-906 dated 02 December 2011 issued by
the office of the said institute);

B} Administrative Incapability in getting the institute approved by
AICTE for academic session 2011-12 ;


4- Cases of autocratic attitude and disregard to orders of seniors

A}Treating himself as Public Information officer though he is
Assistant Public Information officer ( Reference letter no. C-2149
dated 05 February 2008 issued by Directorate of social Welfare );


B} Authorizing Non-Technical Lecturers to carry out the work of the
Principal of the institute during his leave . This Move of Mr. Chandra
violates the order of Hon'ble High Court Allahabad , Lucknow bench
passed on 11-09-2009 in Writ Petition No. 8886 (MB) of 2009. Hon'ble
High Court Allahabad , Lucknow remarked "We are not only surprised but
shocked to note that the office of the Principal is being managed
presently by Additional District Development Officer, (Samaj Kalyan),
who according to the petitioner is not at all qualified for holding
the post of Principal, it being a technical post" ;

C} Accepting to be chief orator of a public function at a time when
model code of conduct was in force due to ongoing assembly polls 2012;

D} Conducting programs to spread a particular religion in the said polytechnic;


I have written to the authorities concerned to look into the fraud
,Financial Illegalities / Economic
Offences , Administrative Incapability and autocratic attitude
/disobedient attitude (working against the orders of the higher
authorities) of Mr. Rajesh Chandra ,Principal ,Government G.B.Pant
Polytechnic , Lucknow and punish him according to the prevailing
rules of the land to save the future of hundreds of Scheduled Caste
future technocrats of India.

From the foregoing discussion we can conclude that Rajesh Chandra
Principal of Government G. B. Pant Polytechnic is a A Wolf in a
Sheep's Skin .
