In what is likely to throw up a gamut of issues related to the
legality of permitting a candidate from contesting elections from two
constituencies at a single time, a writ petition has been filed before
the Hon'ble Supreme Court of India, by the 'Voters Party'- a political
party registered under section 29A of the Representation of Peoples
Act 1951 with effect from 03.01.2011, and represented its National
president, Mr. D.K. Giri, challenging the constitutional validity of
sub-sections (6) and (7) of Sections 33 and 70 of the Representation
of the People Act, 1951. The Union of India and the Chief Election
Commissioner have been arrayed as the respondents in the writ
petition.

The petitioner contends, in his writ petition, that the said
provisions promote a situation 'where a person files nomination paper
from two constituencies and manages to win from both the
constituencies and on winning from both the constituencies he is bound
by the existing law to vacate one of the seats thereby forcing a
unwarranted by election and its related expenses.'

Section 33 of the Representation of the People Act, 1951, inter alia,
provides that a person can contest a general election or a group of
bye-elections or biennial elections from a maximum of two
constituencies, while Section 70 of the Act, stipulates that if a
person is elected to more than one seat in either House of Parliament
or in the House or either House of the Legislature of a State (some
states have a Legislative Council or Vidhan Parishad as well, along
with the Vidhan Sabha), then he/she can only hold on to one of the
seats that he/she won in the election.

In the writ petition filed by the petitioner through Adv. Usha Nandini
V., the petitioner further avers that there have been several cases
where a person contests election from two constituencies, and wins
from both. In such a situation he vacates the seat in one of the two
constituencies. The consequence is that a bye-election would be
required from one constituency which would result in financial burden
on the public exchequer and the public would be forced to participate
in an unwarranted and forced bye-election. The petitioner has thus
sought for a mandamus declaring that the provisions under Sub-Section
6 and Sub-Section 7 of Section 33, Section 70 and any other relevant
Sections in the Representation of The People Act, 1951 which permits a
candidate to contest from two constituencies at a time in a single
election are unconstitutional.
The petitioner, in his writ petition, has adverted to the Background
Paper on Electoral Reforms that was prepared by the Core-Committee on
Electoral Reforms, a part of the Legislative Department of the
Ministry of Law and Justice in collaboration with the Election
Commission and released in 2010, wherein the Election Commission at
Issue No.6.5 had expressly recommended restricting the number of seats
from which a person can contest from in a particular election.

The petitioner says that the Election Commission had also, in fact,
proposed that if this provision was not changed, then if a person
contested from two seats, he/she should bear the entire cost of the
bye-election to the seat that he/she decides to vacate in the event
the person wins both seats and that the Governments have not
considered this issue seriously and so this provision stands as it is,
and the taxpayer money is being used to conduct the bye-election when
the candidate wins both seats.
The petitioner further contends that "the Election Commission's (EC)
proposal to bar a candidate from contesting in more than one
constituency, or seek reimbursement of the expenditure for holding the
bye-election is perfectly reasonable and fair and should be
implemented to save the citizens from an unwanted hardship and to
create a more fair and transparent electoral mechanism" and he has
sought for the issuance 'of an appropriate writ, order or direction
in the nature of mandamus directing the Respondent No. 2 to recover
the entire election expenses in the following situations:

An incumbent MLA contests for Lok Sabha, and on election vacates
the Assembly seat and vice versa;
A candidate who contest for both Assembly and Lok Sabha when
elections are held simultaneously; and
An elected member who vacates a seat and seeks re-election in
ensuing bye-election to establish his hold over the electorate, or to
change party affiliation.'

The petitioners avers in his writ petition that in all these cases,
the politician is clearly seeking to maximise his bargaining power or
further career prospects, and the people should not be made to pay for
the caprice or political insurance or greed of politicians and that
the state should be spared the expense in one of the two ways. First,
apart from barring multiple contests, an incumbent in a House must be
barred from contesting another election; a candidate vacating a seat
in a House must be barred from contesting in a bye-election for the
same House, or another House; and a candidate must be banned from
contesting for two different Houses simultaneously. Secondly, if any
candidate does contest for a second office, or vacates a seat and
contests in a bye-election, he / she must be made to pay the cost of
that bye-election.

The petitioner has also pointed out that though in 2004, the Election
Commission (EC) had proposed to do away with the process of candidates
contesting elections from two seats at the same time, the same could
not be implemented till date and the interference of the Apex Court is
highly warranted. In this context, the petitioner has sought for a
mandamus 'directing the Respondent to implement the proposals of the
Election Commission of India to restrict a candidate from filing
nomination papers from more than one constituency; alternatively, if
the candidate contest the elections from two constituencies and wins
from both seats then the entire cost of the byelection for the seat
vacated in the particular constituency should be recovered as penalty
/ fine from the vacating candidate' and also for a mandamus 'directing
the Respondent No. 2 (Chief Election Commissioner) not to permit any
candidate who are holding the post of MLA in any State Legislative
Assembly/ Council or Rajya Sabha to contest for the Lok Sabha Election
or in any Legislative Assembly election and vice versa'.

In view of the impending general elections which is likely to be
notified by the Election Commission in the first week of March, the
petitioner has also filed an application along with the writ petition
seeking a direction to the Chief Election Commissioner, not to receive
more than one nomination from a candidate for Lok Sabha Elections and
also not to permit any member of State Legislative Assembly or Rajya
Sabha to contest the upcoming elections.

The writ petition which has been filed today, is likely to come up for
admission before the Supreme Court next week.

विज्ञप्ति के माध्यम से लगाए|

उर्वशी ने कहा 'मेरी एक आरटीआई के जवाब में उत्तर प्रदेश पुलिस मुख्यालय
ने जो आंकड़े दिए हैं वे वेहद चौंकाने वाले हैं l आंकड़ों के अनुसार यूपी
की पुलिस के 54 प्रतिशत पद खाली हैं अर्थात महज 46 प्रतिशत पद ही भरे हुए
हैंl

अब सोचने वाली बात है कि यदि एक पुलिसकर्मी पर दो पुलिसकर्मियों से भी
अधिक का कार्यभार लादा जायेगा तो वह अपनी ड्यूटी से तो न्याय कर ही नहीं
सकता है और ऐसा पुलिसकर्मी अपनी खीज निरीह जनता पर उतारता है जिसकी
परिणति मानवाधिकार उल्लंघन की घटनाओं के रूप में सामने आती है l

उर्वशी ने कहा कि लानत है उन भ्रष्ट चाटुकार रीढ़विहीन आईएएस आईपीएस
अधिकारियों पर जो सरकार के सामने सही तस्वीर न रखकर जनता से विश्वासघात
कर बुनियादी योजनाओं के स्थान पर उन सतही योजनाओं का ताना बाना बुनते
रहते हैं जिनमे मोटे कमीशन के गुंजाईश के साथ साथ राजनैतिक आकाओं की चाहत
भी हो और उससे भी अधिक लानत है उन जन प्रतिनिधियों पर जो बुनियादी
योजनाओं के स्थान पर उन सतही योजनाओं का ही ताना बाना बुनते रहते हैं
जिनमे मोटे कमीशन की गुंजाईश होl

उर्वशी ने कहा कि मुझे अफसोस है कि दो साल के कार्यकाल में अखिलेश ने
सार्वजनिक मंचों पर उपस्थिति तो दर्ज की पर जनता को बुनियादी संसाधन देने
में फेल ही रहे हैं|

hree years after completing the 2011 cencus, the government has still
not published the final figures.
The matter came to light when the office of the Registrar General of
India, governed by the Union Home Ministry, admitted in response to an
RTI, saying: "The Census 2011 figures not yet published." Census is
conducted every 10 years and the last census was conducted in 2011.

Lucknow-based RTI activist Sanjay Sharma wanted to know about the
numbers of kinnars (transgender community) and welfare schemes
initiated for them by the government. This led to a series of
communications between him and the government.

A shocked Sharma, while speaking to The Sunday Guardian, said he had
not expected such a reply from the Ministry. Though so far his RTI
focused on the issue of kinnars, he is now planning to file a fresh
appeal before the government to clarify whether the government is
using "provisional" figures of Census 2011 and also to fnd out why
there has been such a big delay in publishing the final Census 2011
figures.
"What is even more perplexing is that the Registrar General of India,
instead of providing details of kinnars, provided the figures of
Kanaura, Kinnara members, who come under the Scheduled Tribe category
in Himachal Pradesh. But the annexure giving detailed number of these
Himachal tribes gave the earlier Census figures of 2001. This reflects
that the government's claims of technological advancements,
including computerisation in India are hollow," said Sharma.

"All future developmental schemes are planned on the basis of data
collected during the census and non-publication of the final Census
2011 data means that government is still relying on the obsolete
census 2001 data," he added.
Sharma said he had first approached the Ministry of Social Justice &
Empowerment in January 2014. The Ministry replied that an expert
committee has been constituted to look into the problems beings faced
by the transgender community and that "the committee is expected to
submit its report shortly". As regards their population, the Ministry
referred the matter to the Registrar General of India.

The Registrar General of India, in February, told the petitioner that
"actual number" of kinnars could not be obtained from the Census as
three codes (1 for male, 2 for female and 3 for others) were provided
while collecting data. As per the reply, "the Census officials were
directed to write 3 in case the person concerned was not willing to
write code 1 or 2"."Therefore, there is a possibility that people
other than kinnars could also have written code 3. There is also a
possibility that a kinnar might have written code 1 or 2. Therefore,
it is not possible to get the actual number of kinnars," said Vijay
Kumar, deputy director of the Office of the Registrar General of
India, in his reply to the petitioner. The government had released the
provisional data of the 5th Indian Census in 2011, the process for
which was conducted for one year starting from 1 April 2010. According
to it, the population of India was 1,210,193,422 as of 1 March 2011.

The final figures of the Census 2011 are still to be published,
Registrar General of India and Census Commissioner has said.

The office stated this while responding to a RTI query requesting it
details about the population of transgenders in Kinnaur district of
Himachal Pradesh.

The department said it was unable to furnish fresh data about their
population as the Census was not published yet.

"The data provided in the reply is based on the Census 2001 as the
Census 2011 is yet to be published," it said.

The mammoth exercise of the 15th Census began on 1 April 2010. In
April 2013, Home Minster Shushil Kumar Shinde had released the
statistics.

भारत के जनगणना 2011 के आंकड़े अभी तक प्रकाशित नहीं हुए है। सूचना के
अधिकार के तहत यह जनकारी प्राप्त हुई है। सूचना के अधिकार के तहत भारत के
महापंजीयक कार्यालय से चार मार्च 2014 को मिली जानकारी के अनुसार,
''जनगणना 2011 के आंकड़े अभी तक प्रकाशित नहीं हुए हैं।'' आरटीआई के तहत
प्राप्त जानकारी के अनुसार, ''आजादी के बाद भारत की जन गणना के तहत
अनुसूचित जाति और अनुसूचित जनजाति को छोड़कर समुदायों, जातिओं, जनजातिओं
आदि के बारे में जानकारी एकत्र करने का कार्य रोक दिया गया था।''

भारत के महापंजीयक ने हिमाचल प्रदेश के किन्नौरा किन्नर के बारे में
जानकारी देते हुए कहा कि यह समुदाय अनुसूचित जनजाति के तहत आता है और
इनकी संख्या के बारे में ब्यौरा 2001 की जनगणना के आधार पर दिया और कहा
कि 2011 के आंकड़े अभी प्रकाशित नहीं हुए हैं। लखनऊ स्थित आरटीआई
कार्यकर्ता संजय शर्मा ने भारत के महापंजियक से किन्नौरा किन्नरों की
संख्या के बारे में जानकारी मांगी थी।

गौरतलब है कि भारत की 15वीं राष्ट्रीय जनगणना एक मई 2010 को आरंभ हुई थी।
30 अप्रैल 2013 को केंद्रीय गृहमंत्री सुशील कुमार शिंदे ने जनगणना 2011
के अंतिम आंकड़े जारी किये थे। भारत में जनगणना 1872 में शुरू हुई और इस
बार पहली बार बायोमेट्रिक जानकारी एकत्र की गई है।

लगातार विवादों में घिरे रहने वाले आईपीएस अधिकारी अमिताभ ठाकुर को मानों
इन दिनों मुंह-मांगी मुराद मिल गयी है.

ठाकुर की संपत्ति की विजिलेंस जांच की सिफारिश की फाइल शासन में धूल जो
फांक रही है. लगातार अपने कृत्यों से पुलिस महकमे और राज्य सरकार को
कटघरे में खड़ा करने वाले अमिताभ ठाकुर को शासन का कौन अधिकारी बचा रहा
है, यह सवाल आजकल पुलिस महकमे में चर्चा का विषय बन गया है.

आईपीएस अमिताभ ठाकुर के खिलाफ डीजीपी के निर्देश पर आईजी कार्मिक ने उनकी
संपत्ति की प्रारंभिक जांच की थी. जांच में उनके खिलाफ लगे आरोपों के
पक्ष में कई अहम प्रमाण मिलने पर इस मामले की विस्तृत जांच के लिए
विजिलेंस जांच की सिफारिश की गयी.

तत्कालीन डीजीपी पहले तो इस सिफारिश को काफी दिनों तक दबाये रहे लेकिन
बाद में इसे लेकर विवाद खड़ा होने पर उन्होंने अपनी सेवानिवृत्ति से
पूर्व शासन से इसकी संस्तुति कर दी. अब शासन में यह मामला पिछले तीन माह
से लंबित पड़ा है.

गृह विभाग के अधिकारी इस बाबत कुछ भी बोलने से कतरा रहे हैं. इस बाबत
प्रमुख सचिव गृह एके गुप्त से दो बार एसएमएस कर जानकारी मांगी गयी लेकिन
उन्होंने कोई जवाब नहीं दिया. वहीं डीजीपी मुख्यालय के अधिकारी भी इस
मामले में चुप्पी साधे हुए है.

उन्होंने कहा कि विभागीय नियम उन्हें अपना पक्ष रखने से प्रतिबंधित करते
हैं, अत: वे तथ्यों के विस्तार में नहीं जाकर मात्र इतना कहेंगे कि चूंकि
वे स्वयं निरंतर पारदर्शिता की वकालत करते रहे हैं, वे अपने संबंध में
ऐसी किसी भी जांच का स्वागत करते हैं क्योंकि वह जानते हैं कि वे किसी
प्रकार से गलत नहीं हैं.'

क्या है मामला : दरअसल 1992 बैच के आईपीएस अफसर अमिताभ ठाकुर ने वर्ष
2010 में केन्द्रीय गृह मंत्रालय को दी गयी अपनी अचल संपत्ति की
जानकारी(इम्मूवेबिल प्रोपर्टी रिटर्न) में बताया था कि उनके और उनकी
पत्नी के नाम से लखनऊ व बिहार में दस संपत्तियां है.

राजधानी के गोमतीनगर स्थित विरामखंड में एक एचआईजी मकान, खरगापुर में
पांच प्लाट व उजरियांव में एक पांच हजार स्क्वायर फिट में मकान है.

इसके अलावा बिहार के मुजफ्फरपुर, पटना, सीतामढ़ी में भी उनके पास मकान व
कृषि भूमि है. इन सभी संपत्तियों से उनकी वार्षिक आय दो लाख 88 हजार 390
रुपये है। उनके पास इतनी संपत्तियां होने के मामले ने जब तूल पकड़ा तो
उन्होंने बाद के वर्षो में दाखिल किये गये अपने आईपीआर में उनके नाम केवल
दो संपत्तियां ही होने का दावा किया.

उन्होंने अपनी पत्नी के नाम आठ संपत्तियों की जानकारी नहीं दी जबकि यह
नियमों के विपरीत था. इसे लेकर डीजीपी मुख्यालय ने उनके खिलाफ प्रारंभिक
जांच करायी जिसमें इस मामले की विजिलेंस जांच की सिफारिश की गयी.

डीजीपी मुख्यालय के सूत्रों के मुताबिक उन्होंने अभी वर्ष 2012 व 2013 का
आईपीआर दाखिल नहीं किया है.

पहले भी हो चुकी है विजिलेंस जांच : अमिताभ ठाकुर के खिलाफ विजिलेंस जांच
का यह पहला मामला नहीं है. इससे पहले अप्रैल 2003 में भी उनके खिलाफ
विजिलेंस जांच हो चुकी है.

उन पर आरोप लगा था कि वे एसपी देवरिया के पद पर रहने के दौरान अपनी पत्नी
नूतन ठाकुर के नाम से एनजीओ चला रहे हैं. ठाकुर ने इस बाबत कोर्ट में
दावा किया था कि इस जांच में उन्हें क्लीन चिट मिल चुकी है.

UP Women more harassed in AKHILESHraj than MAYAraj : UPSWC data reveals 23% increase in reported women harassment cases while disposal rate decreased by a whopping 54% in AKHILESHRAJ :Akhilesh led govt. less sensitive towards women harassment issues as on a scale of 100, Akhilesh scores a poor 27 as compared to Maya’s 72: White Elephant Women Commission of UP keeps no tab on registration of FIRs on cases reported with it.

Come 8th march and we all hear much of hue & cry from all quarters of
Government boasting of government's endless efforts to ensure safe
environment for women of Uttar Pradesh. Akhilesh too has always been
seen & heard seconding this stand of government. On the eve of Women's
day,the big question is whether all such tall claims by our government
are true or not and also as to whether these are based on facts &
figures or are just based on whims & fancies of some sycophant
officers & politicians of our state who are leaving no stone unturned
to befool the real rulers i.e. U n me?


To adjudge the actual situation, I thought UTTAR PRADESH STATE WOMEN
COMMISSION data could be an important indicator of
crime-against-women situation in UP.


On 16-12-13, I shot off a 11 point RTI to UPSWC. Through this RTI I
demanded information on no. of cases reported, no. of cases disposed,
no. of cases that turned into registering of FIRs etc. Also to know
the change brought by Akhilesh in this arena , I thought to compare
the previous Maya Government and present Akhilesh Government,so I
asked data for last 21 months of Maya Government & for first 21
months of Akhilesh Government.

The information furnished by UPSWC vide letter no. 5364 dated
17-01-14 reveals an increase of 9205 cases during Akhilesh's regime.
This translates into a 23% increase in Women harassment cases as
reported in UPSWC.


The data reveals that during 21 months of Akhilesh govt. , UPWC
received 49265 cases and disposed off 13429 cases only i.e. @ 27%
disposal rate as compared to 40060 cases received and 28952 cases
disposed off by UPWC during last 21 months of Maya govt i.e. @ 72%
disposal rate.

The data also reveals that during 21 months of Akhilesh govt. , UPWC
could dispose-off 13429 cases as compared to 28952 cases disposed by
UPWC during last 21 months of Maya govt. This means a decrease of
disposal by 15523 cases which translates into 54% decrease of diposed
cases in Akhilesh govt.

Contrary to popular belief that Women Commission helps the victims in
their fight against crime till it reaches its logical ends, UPWC has
revealed that it neither helps in registration of FIRs in cases
reported with it nor does it keep any record of registration of FIRs
on cases reported with it.

Isn't is enough to prove that like other commissions this Women
Commission too is nothing but only a White Elephant and a Burdon on
state's exchequer.

I am going to launch a campaign to ensure time-bound relief to the
applicants of UPWC , to make it mandatory for UPWC to keep tab on
registration of FIRs on its cases and also ensure follow-ups on thus
registered FIRs.


I would like Akhilesh to come out of ring of sycophants as suggested
by his father Mulayam Singh, start acting like a professional engineer
also also to rely only on fact-based scientific studies to give to UP
what it wants from its governments.

Hip flexors - the most underdeveloped muscle group in strength training

Despite their importance to a wide range of athletic and sporting activities, the hip flexors are the most neglected major muscle group in strength training. It is very rare to find training programs that include hip flexor exercises. By contrast there is usually a great deal of emphasis on exercises for the leg extensors.
There are some obvious reasons for this comparative neglect. The principal muscles involved in hip flexion are the psoas and the iliacus, collectively known as the iliopsoas. Because they are relatively deep-seated rather than surface muscles they may have been overlooked by bodybuilders who have traditionally been the major innovators in strength training. Secondly, there are no obvious ways to adequately exercise them with free weights. Finally, these muscles do not have the obvious functional importance of their extensor counterparts. Yet, as antagonists, both hip and knee flexors perform a vital role in controlling the rate of descent and ascent in leg exte nsion exercises such as the squat.
There is no corresponding problem of underdevelopment with the muscles responsible for knee joint flexion, the hamstring group. Okay, so sometimes bodybuilding exercises hurt. But how do you know when it's a good hurt or a bad hurt?

Rest -- Avoid all activities that aggravate your injury. You may even need to skip your gym workout for a couple of weeks. Rest can mean the difference between a long recuperation (and possibly medical invasive procedures) or just a few days or a few weeks off.
Ice -- Ice helps reduce swelling by restricting blood flow. 15-20 minutes, three to four times a day is recommended as long as the pain remains.
Compression -- Put pressure on the injured site to help keep swelling down. You want to wrap a bandage or a towel tightly enough to feel some pressure but not enough to cause numbness or affecting blood circulation.
Elevation -- Elevate the injured area to reduce swelling.
Your condition should improve with "RICE" treatment. Most of the time, you should see some results within 20 minutes of treatment. However if the pain persists or gets worse, then it time to see your doctor or a sports physician as your condition may be worse than what was initially thought to be.
