observed as RTI Day .
1- In the past , the Maharashtra State Government has done so.
2- Even today many people are not aware of what the RTI is and how it
should be used, this is a much-needed move to be initiated by the
Central and all state governments to spread awareness among people
about RTI. To ensure that this directive is taken seriously, the
Governments should direct schools, colleges and institutes to arrange
seminars, lectures and debates based on this theme.
3- This observance shall give a chance to highlight the right to
information and to remember how important this right is for the
fulfillment of all the human rights. From securing the right to food,
healthcare and education, to preserving a healthy and sustainable
environment, to increasing people's participation in government and
achieving gender equality, having access to information is fundamental
if we are to fully exercise our rights in a meaningful way and take an
active role in shaping the societies in which we live.
4- The importance of access to information has long been recognized by
the international community. At its very start in 1946, the United
Nations General Assembly recognized that "freedom of information is a
fundamental human right and the touchstone for all freedoms to which
the United Nations is consecrated". Although originally envisaged as
an element of the right to freedom of expression, the right to
information is increasingly gaining recognition as a "foundational
right" necessary for the protection of every other human right.
Likewise , the Rio Declaration on Environment and Development
recognizes that the right to a healthy environment includes the right
to access government information about the environment, including
hazardous materials and activities.
5- The first right to know law was actually written in 1766, as part
of campaigning by a Finnish thinker named Anders Chydenius. The idea
was to promote open government through public access to papers. 244
years later, over 100 countries have some sort of laws promoting
citizen's right to know
6- The International Right to Know Day is an opportunity to remember
that each of us has a human right to information, and that effective
protection of this right is dependent on our government's willingness
to embrace policies of transparency and openness.
7- Around the world, campaigners for the freedom of government
information celebrate Right to Know Day on 28 September. As more and
more people all over the world are finding out, getting information on
what your government is doing can make a real difference in protecting
rights.

All info-seekers know that Getting info from the Public Authorities of
Uttar Pradesh is difficult but as the worst is yet to come , the
U.P.S.I.C. ( Uttar Pradesh State Information Commission ) is devising
novice ways for the public authorities to elude the impart of info
to the info – seekers.

one such illustration is given hereunder –

I wrote a letter to the Chief Minister of U.P. Ms. Mayawati on
24-09-09 on some issues related to the welfare schemes of Scheduled
castes , Scheduled tribes and the Other Backward Classes . On 26-10-09
I sent letter of section 6 to the PIO of CM office. Since no info was
furnished , the matter was sent to the U.P.S.I.C. as per the
provisions of the RTI act. The Case No. S1-575/C/10 was registered
which came for hearing on 29-04-2010 before SCIC sri Ranjit Singh
Pankaj.

The order says that it is not clear as to which department and
public-information the case is related to . The order further directs
me to appear before the commission on 27-07-10 alongwith a copy of my
letter dtd. 24-09-09 failing which it shall be assumed that I have
nothing to say n that the complaint is baseless n shall stand
cancelled.

I have received the abovementioned letter of U.P.S.I.C. by ordinary
post on 07-08-10. Letter no. 090-D-1/Ra.Su.AA./20 though dispatched
on 06-07-2010 has a clear date stamp of 06-08-10 of the postal
department. This shows a criminal conspiracy by the U.P.S.I.C. to stop
me from appearing before the commission n putting my point n get the
info.

There may be many such cases where modus - operandi of the commission
is to pass a conditional order for want of some paper making
appearance of the info-seeker before the commission mandatory ,
failing which the case to be cancelled and then delaying the posting
of dispatched notice and post it after date of hearing so that more n
more cases ( that are tough nuts for the government ) should be
cancelled without any impart of info.

Perhaps this is the way the corrupt n inefficient info-commissioners
of Uttar Pradesh are paying back their dues to the government . But
what our Mahamahim Governor is doing to ensure that there is no
constitutional lapse? Perhaps most of the times he is busy looking at
10 janpath and being too old has no time to care for all this .

N u all say India is marching ahead . ….a big joke . isn't it.

India might have been the jewel in the crown of the British empire but
it seems like the country does not care much for the bling in its
history.

The external affairs ministry has no documents proving that India ever
asked the United Kingdom (UK) goernment to return the Koh-i-noor
diamond.

A reply to an RTI application by Lucknow resident Urvashi Sharma
reveals that demand for the diamond may have been more of a request
and that too made for the sake of appearances. This, despite the
government's posturing at various times suggesting that it was indeed
serious about getting the diamond home.

The RTI application filed with the Prime Minister's Office and
transferred to the MEA sought certified copies of communication
between the governments of India and the UK in connection with
bringing back the Kohinoor diamond since 1947.

"The available documents with the concerned division of this ministry
with reference of the Kohinoor Diamond do not include any records of
correspondence, meeting, decision etc between the two governments,"
said the reply from the MEA dated June 24, 2010.

The British East Indian Company took the105 carat gemstone to London
after the annexation of Punjab in 1849. Since 1877, the famous diamond
has been a part of the Crown Jewels of the monarch.

Many times, after Independence, various governments have spoken of
demanding the return of the diamond.

Before the visit of the British prime minister David Cameron earlier
this month, Keith Vaz, the Indian-origin British MP, wanted him to
discuss the issue with India.

However, Cameron ruled out any possibility of returning the Kohinoor to India.

"What tends to happen with these questions is that if you say yes to
one, then you would suddenly find the British Museum empty," he told
the media in India.

"The Kohinoor" has always been in news as it is today as the British
Prime Minister David Camran visits India , but a RTI reply by Mr.
Debraj Pradhan , Joint Secretary ( RTI ) / CPIO Ministry of External
Affairs , New Delhi states that the available documents in the
ministry with reference to "The Kohinoor Diamond " do not include any
records of correspondence , meetings , decisions etc. between the
Government of India & the Government of United Kingdom after 15th
august 1947 to date.

I sent a request for information to The CPIO of Prime Minister Office
on 11-05-10 with IPO no. 60 E 054016 vide speed post no. SPEU
949479961IN dated 11-05-10 . The same was transferred to the Foreign
Secretary – Ministry of external affairs south block New Delhi vide
letter no. RTI / 1413/2010-PMR dated 14 May 2010 . by Mr. Debraj
Pradhan , Joint Secretary ( RTI ) / CPIO Ministry of External Affairs
, New Delhi has furnished me the above mentioned information vide
letter no. RTI/551/413/2010 dated 24th June 2010. This reply has given
me a shock .

This all exposes the real face of Governments ( run by politicians ) ,
which are making a fool of us post independence as the British did pre
independence .
Now onwards think hundred thousand times before believing any politician .

Don't you all think that this is the right time to demand the Kohinoor
back to India as the Commonwealth games are about to begin ? if yes
please join the movement with me to bring the pride of India back to
its people.

Almost a week after RTI activist Amit Jethava was shot dead near the
Gujarat High Court, the minister-in-charge of RTI Act on Thursday
denied any move to frame a law to protect RTI activists while the
Central Information Commissioner said it was the "job of the police"
to protect them.


"There is no proposal before the government to frame a specific law to
protect RTI activists," Minister of State for Public Grievances
Prithviraj Chavan said in his written reply before the Rajya Sabha.
Chavan was replying to a question by V Hanumantha Rao as to when "a
specific law will be put in place to protect RTI activists".


The minister said violence against activists, "when reported", was
investigated by the local police. "There have been reports in the
media, and the government has been informed about increased threat to
RTI activists. Such incidents, when reported, are investigated by the
local police," he said.

Chief Information Commissioner Wajahat Habibullah echoed Chavan's
views, saying it was the "job of the police" to protect RTI activists
and the information commissions had no "legal authority" to do so.
"The threat has now started emerging, society has to start thinking of
measures to protect itself," Habibullah told The Indian Express.


However, he said the Central Information Commission would surely
intervene if RTI activists facing threats approached it. "A certain
weightage is attached to the Information Commission. We will caution
the government against vested interests who threaten RTI activists.
These vested interests will think twice then," he added.


Jethava, who was campaigning against illegal mining in Gir Sanctuary
areas, was shot dead on July 20.


Meanwhile, Chavan said in the same reply that a new Bill to protect
whistle-blowers was nearing finalisation. The draft of the Public
Interest Disclosure (Protection of Informers) Bill, 2009, intends to
designate the Central Vigilance Commission (CVC) as the nodal
authority to which complaints against any central government employee
or central government-backed institution would be made. The CVC would
exercise the powers of a civil court, including powers to summon
anybody, order police probe and provide security to the
whistle-blower.

teach you RTI in their own language . This is what happened with the
info-seeker Ram Sewak Verma . He was in Uttar Pradesh State
info-commission on 27-07-10 for hearing of one of his many cases.
State info-commissioner Brijesh Kumar Mishra ( politically influenced
appointee as he is a kin of Satish Chandra Mishra ) has written a
letter to D.I.G. / S.S.P. of Lucknow to investigate the case for
misuse of RTI act by Ram Sewak Verma . The info-commissioner Mishra
has written that Verma's asking for info under RTI act causes undue
problems to public servants and causes undue hindrances in their
smooth functioning .

Though I am moving a rti application to UPSIC asking them as to under
which section of RTI act the Info-Commissioner Mishra has written
this letter to D.I.G. / S.S.P. of Lucknow to investigate the case
for misuse of RTI act by Ram Sewak Verma , but keeping in mind the
thick skinned & seasoned ( in corrupt atmospheres ) officials at UPSIC
, I know the fate of my application .

Political Compromises are continuously demolishing the democratic
structure of our country . The question is how far it shall go ?

LUCKNOW: In a first of its kind incident, a UP police home guard was
done to death allegedly for daring to seek information under the RTI
Act about government funds and work done by his village pradhan in
Bahraich. The accused pradhan's husband and four others have been
arrested in this connection. The police say the murder is fallout of a
40-year-old dispute between the two sides over a piece of land.

The incident took place in Katghar village under Ranipur police
station of Bahraich on Sunday afternoon. According to reports,
ex-pradhan of Katghar Mohan Singh, his son Vijay Pratap (32) alias
Babbu Singh, who is a home guard and had come home on a holiday, and
brother Satyadeo Singh was supervising some construction work on a
piece of land in the village when one Indrajeet Singh and his cohorts
reached the site.

Indrajeet is husband of the sitting village pradhan since the seat was
reserved for the fairer sex in the last elections.

"As soon as they reached us, they started abusing and eventually a
free for all ensued. Since we were not expecting a showdown and they
had come prepared with sticks and rods in hand, we could not do much
and they beat us severely," Satyadeo said recollecting the sequence of
events.

Help at hand to make RTI Act easier for common man

LUCKNOW: People who wish to seek information using Right to
Information (RTI) Act but do not know how to go about it have several
helping hands available now. RTI activists opened a resource centre in
Hazratganj last week to help RTI users. The applicants who are from
outside Lucknow can approach the Centre for help. Especially when they
want to know the status of their RTI applications pending with the
government departments or with the State Information Commission (SIC).

The volunteers at the Centre will track the status of the applications
and also inform the applicants about the same. The fee charged by the
Centre is currently only Rs 10, and even this is optional. Inaugurated
last week, it is too early to say how will the Centre fare. But the
RTI helpline which was started few months back has started receiving
calls from RTI users. "Most of them want to know simple things like
how to write an application," said activist Urvashi Sharma.

People can call up at 8081898081 and seek answers to their queries on
RTI. It could be anything from filing an application to finding
answers to the doubts about the use of the Act. The helpline is not a
toll-free number. It is functional between 8.00am to 10.00pm. Besides,
it only answers the queries made in either Hindi or English. But more
than the helpline number it is the online helpline
(aishwaryaj2010@gmail.com) which is getting good response from people.
"Sometimes we are unable to give a prompt response to people mailing
their queries to us, but we make sure that we provide them the
answers," said Sharma.

There is still very little awareness on the Act, though it has been
there for the past four years in Uttar Pradesh. Creating awareness on
the RTI Act has always been a prime concern and focus of the UP State
Information Commission (UPSIC) as well. The concise version of the
Act, a booklet popularly called `gutka', has been introduced by
commission to explain nitty-gritties of the Act. It explains to the
common man, how simple it is to file an RTI application. The booklet
has been published in Hindi. More so as the entire Act is available in
English, its translation in Hindi is more than needed for UP, where
maximum applicants are Hindi-speaking folks.

Anyone can obtain the booklet from the office of the PIO of the
commission or that of any of the information commissioners (ICs). The
booklet is available free of cost. The commission had published quite
a few of such booklets in the past, like 'Prashnotri' which explained
the procedures of disposal of an application and conditions under
which a PIO can be fined.

Sub. :Request for a C.B.I. Investigation in a matter involving
Illegalities / irregularities by Minister and officials (I.A.S./P.C.S.
) of Uttar Pradesh Social Welfare Department ( exposed by use of
R.T.I. Act 2005 ) and to take necessary steps to ensure safety of my
family

Hon'ble Madam,

The matter is related to Government G. B. Pant Polytechnic , Mohan
Road , Lucknow , Uttar Pradesh ( run by the Social Welfare
Department of Uttar Pradesh ) . This is the only institute of the
country which is run solely for the SC/ST/OBC students . Of the total
intake 70% are SC/ST & 27% are OBC .

Use of Right To Information has exposed many illegalities /
irregularities of the department . In these illegalities the whole
governmental machinery was involved. The details are as given
here-under

1- Illegal appointments of Sri Pawan Kumar Mishra and Sri Krishna
Kumar Srivastava on class II gazetted posts –
Both the persons are fraudsters and are a black spot on the teaching
community . They got their initial appointments in the said
polytechnic on per period remuneration basis , though none of them
possessed the requisite qualifications as mentioned in service rules
of the department effective at that time . Later on they filed a writ
petition no. 2566(S/S) of 1995 . Papers obtained through RTI reveal
that all five annexure of this writ are false/misleading but the
department's corrupt officials never contested this position in the
hob'ble court . A bare perusal of memo of writ and documents on
records establish my point. Annexure no. 1 was not applicable in
social welfare department because it had its own servive rules in
1991, the duo made annexure no. 2 by manipulation , annexure no. 3
(representation) of Sri Srivastava was false as he was not a degree
holder in session 1992 ( which ended on 30th June 1992), annexure no.
4&5(representations) of Sri Pawan are false as he later produced
experience of the same period for which he showed himself as "
UNEMPLOYED " in these annexure . Not only this Sri Pawan showed
himself a degree holder in " MECHANICAL ENGINEERING " though in
reality he was a degree holder in "PRODUCTION ENGINEERING " and was
not eligible to hold the post of Lecturer-Mechanical. Later on based
on these false papers and with the help of the corrupt officials of
the department , the duo succeeded in getting the letter no.
399/26-1-96 dtd. 23 -01-96 issued in their favor.

2- Illegal appointment of Sri Pawan Kumar Mishra on the post of
workshop superintendent

Essential qualifications for the post of workshop superintendent
requires three years' experience which Sri Pawan Kumar Mishra did not
possess , so his appointment was illegal . But this illegality was
deliberately done by then Social Welfare Minister Smt. Premlata
Katiyar.

3- Illegal regularization of Sri Pawan Kumar Mishra and Sri Krishna
Kumar Srivastava on class II gazetted posts

Sri Pawan Kumar Mishra was regularized though he did not possess the
three years' experience ( essential qualification ) and Sri Krishna
Kumar Srivastava was regularized on a post clearly reserved for
Scheduled Caste . This way their regularizations were illegal . Though
then director Dr. Jagat Pal clearly brought this to the notice of the
regularization committee even then this illegality was committed by
the corrupt regularization committee comprising of

a) Sri Chandra Prakash (I.A.S. & then secretary – social welfare department )
b) Sri Hiramani Singh Yadav ( then Special Secretary – Karagaar
Prashashan evam Sudhar bibhaag)
c) Sri P.N.Yadav ( then Joint Secretary – Karmik Vibhaag )
d) Sri Mahesh Chandra Sharma ( then Special Secretary – Nyay Vibhaag )

Smt Anita Mishra's ( then Additional Director – Social Welfare )
missing signatures from the minutes, though he was a member and was
present also , shows her disconscent to be a part of the illegality
committed by the abovenamed four corrupts.

Sri Pawan Kumar Mishra Knows nothing about Workshop and is playing
with the lives of the poor SC/ST/OBC STUDNTS . No training in workshop
are given to students. This was made clear in report dated 22-11-08 of
Secretary B.T.E. U.P. but the corrupt/inefficient officials of Social
welfare never took any action.

4- Illegal grant of Promotional pay scale (of class I gazetted post to
Sri Krishna Kumar Srivastava

Sri Krishna Kumar Srivastava was illegally regularized on 30-09-2003
and was granted promotional pay scale on 09-12-2005 ( i.e. within a
period of two and a quarter years though as per service rules this can
be granted only after a period of eight years. This illegality was
committed by then Principal Secretary of the department Dr. R. C.
srivastava ( I.A.S.)

The order released by Dr. R.C. Srivastava could not be implemented due
to a technical flaw and same was returned back to the government.

In June 2006 , Sri K.K.Srivastava was arrested by Kakori Thana for his
involvement in copying the students in annual examinations .He was in
Custody for more than 48 Hrs. and so he was under deemed suspension
on 11-10-2006 even then the principal Secretary Sri D.C. Lakha (
I.A.S.) illegally issued corrigendum of the abovementioned order of
promotional pay scale and made it effective from back year 2004.

5- Illegal discharge of duties by Sri Krishna Kumar Srivastava from 09
april 2006 to date

Sri K.K.Srivastava was arrested by Kakori Thana for his involvement in
copying the students in annual examinations .He was in Custody for
more than 48 Hrs. and so he is under deemed suspension even today .
This illegality is persisting for reasons best known to the
corrupt/inefficient I.A.S. officials of the Uttar Pradesh Government.

6- Illegal grant of Promotion (on class I gazetted post to Sri Krishna
Kumar Srivastava

Sri Krishna Kumar Srivastava was in jail for helping students in
copying for more than 53 hours and was under deemed suspension from
08-04-2006 ( evening ) but was granted the actual promotion on a class
1 gazetted post without revoking his suspension. Sri Krishna Kumar
Srivastava is under suspension even today and has a break in service
in year 2006. This illegally was committed by then Principal Secretary
and now the commissioner of Social welfare Sri Prem Narayan – I.A.S.

7- No recovery of illegal grant of increments and allowances from the guilty

Not only this , R.T.I. applications filed by me exposed financial and
other irregularities of then principal Sri Ashok Kumar Bajpai . Sri
Ashok Kumar Bajpai granted illegal increments to Sri Pawan Kumar
Mishra and illegal allowance to himself , The Principle has accepted
this illegality on paper but the corrupt officials of the department
are not making any recovery from the guilty.

8- No Realization of Penalty money from officials of social welfare

Most of the departments' officials were penalized under R.T.I. Act by
the UPSIC in my cases but due to prevailing corruption no realization
has been made by the responsible authorities.

Since I am exposing irregularities of high ups , I always fear for my
family's safety also.

I want

1- A C.B.I. enquiry to punish all the high-level culprits involved in
all these irregularities ,
2- Cancel the illegal appointments under provisions of " The Uttar
Pradesh Public Services Regulation of Appointments Adhyadesh 2001 {
U.P. Ordinance No. 26 of 2001 – 2922(2)/XVII-V-1-2(Ka)35-2001 Lucknow
Dated 24 December 2001 }
3- Ensure recovery of public money from Sri Pawan Kumar Mishra Sri
Krishna Kumar Srivastava and any other officers / officials under "
General principles to regulate the enforcement of responsibility for
losses sustained by government through the fraud or negligence of
individuals "
4- Provide Security for my family's safety .

One more dead. Yet another person who raised his voice against corruption
was killed. And we remain silent.

Politicians, parties, the government, officials, moneyed people and
criminals have joined hands. They constitute a gang that is robbing the
nation. Anyone who dares to raise his voice against this gang is killed.

There is only one solution to this mayhem—the voice of the people. This
recent spate of brutal and senseless murders of those who have raised their
voice against corruption is a warning: our democracy is in danger; our own
lives are in danger. We are the only ones who can set this right.

Whenever any activist exposes corruption against someone mighty in the
government, it is futile to expect any protection from police, which is
directly controlled by the political executive. It is also futile to expect
the anti-corruption agencies in that state to take any effective action
because these anti-corruption agencies are directly controlled by political
executive. The police and anti-corruption agencies, on the contrary, collude
with the corrupt. They either turn a blind eye to complaints and threats or
openly victimize the complainant.

Therefore, there is a strong need for an institution which is completely
independent of political executive and has adequate powers and resources to
deal with such issues.

A rally has been organized to denounce the murder of Amit Jethwa and demand
that all parties make a public commitment to put appropriate systems in
place to address corruption.

This rally will take place on Monday, July 26, 2010 at 6 pm. We will gather
at Gandhi Peace Foundation (ITO, in front of Deen Dayal Upadhyaya library)
and move toward the Samadhi of Babu Jagjivan Ram (in front of Rajghat).

Please come and join us for this important event. Let us raise our voices
together!

The rally is jointly being organized by several organizations including
NCPRI, Parivartan, National Alliance for People's Movement (NAPM), Aasha
Parivar, Yva Koshish, Journalist's Union for Civil Society, Sadbhav Mission,

In a shocking incident RTI activist from Junagadh Amit Jethwa, who has
fought many issues, was shot dead near Gujarat High Court in Ahmedabad
a few minutes before. Our sources here say he was fighting some
illegal mining gang in state who might have got him killed.
May his soul rest in peace and his death only motivates us to take the
corrupt officials with more vigor.

Blaming the messenger no solution to Kashmir disturbances, says IFJ

(IFJ/IFEX) - 8 July 2010 - The International Federation of Journalists
(IFJ) is deeply disturbed at the drastic erosion of the atmosphere for
journalism, following month-long civil disturbances in the Indian
state of Jammu and Kashmir.
Cities in the Kashmir valley have been under curfew for a number of
days since widespread demonstrations began in the region early in
June. On July 7, as the army was summoned out of its barracks, the
curfew was extended to cover the movement of all civilians, and word
was put out that press passes would no longer be honoured.

The situation resulted in all Kashmir's media personnel being confined
to home. Photographers and news cameramen in the capital, Srinagar,
were assaulted as they sought to record the day's events. Some had
their professional equipment confiscated by security agencies.

The day's incidents followed similar occurrences on July 6, when at
least 12 photographers working for local, national and international
media were assaulted in Srinagar and suffered injuries of various
degrees of seriousness, as security forces sought to restrain them
from recording ongoing demonstrations.

As the photo-journalists and news cameramen were attacked, senior
police officers were heard remarking that without media attention the
demonstrations would soon lose momentum.

Text-messaging services through the mobile phone network remain
suspended in the entire Kashmir region. Voice telephone services are
subject to frequent and unexplained disruption, especially in the
northern Kashmir region.

"Targeting and blaming the messenger is not an appropriate response
for official agencies in Kashmir as they seek to restore civic peace,"
IFJ Asia-Pacific Director Jacqueline Park said.

On July 2, authorities in the region of Jammu sealed the premises of
three publications on the grounds that they had allegedly carried
false and misleading news reports that tended to aggravate tensions
between religious communities. The following day, copies of Greater
Kashmir and Kashmir Uzma, the leading newspapers in English and Urdu
in the Kashmir valley, were seized as they were being readied for
distribution.

"The IFJ urges authorities in Jammu and Kashmir to follow a policy of
transparency and accountability rather than seek to throttle the flow
of news, whether good or bad," Park said.

"The heavy-handed response seen so far creates an atmosphere where
rumour and innuendo flourish, further embittering civic relations."

The IFJ extends its support to the media community of the state,
gathered on the platform of the Press Guild of Kashmir, which has
strongly denounced the curbs imposed on media by state authorities and
the use of force against media personnel.

Need your help

This is exciting! Along with 187,759 people I signed a petition asking the Prime Minister to hold a public consultation before taking a decision on the nuclear liability bill. These petitions were delivered to the Standing Committee looking at the bill and now they have decided to hold a public consultation.

The bill in its current form lets the foreign corporations get away by paying a meagre amount in case of a nuclear accident in India. The major chunk of the expenses will be borne by the Indian tax payers. But now we have a chance to change this bill and make it stronger.

Greenpeace, an NGO working on this issue, has prepared an open letter which states the changes required in the bill. Just like the petition, this letter will stand a chance of being considered if lots of us sign it. We have less than two weeks to change the bill and prevent another Bhopal in the making.

Lucknow-based Aishwarya Sharma (9) has created sensational history by
becoming the youngest citizen ever to file an application under the
Central government's Right to Information Act, 2005. A class IV
student of the Rajajipuram branch of Lucknow's renowned City
Montessori School, Aishwarya's application, filed on November 30 last
year, demanded an explanation as to why she and her school mates had
to wade through an overflowing garbage disposal dump to reach their
school. The application filed under s.6 of the Act highlighted the
danger it posed to school children and demanded action by the
municipality to shift the garbage site from Lucknow's Talkatora Road.

Guided by her mother Urvashi, an RTI activist, young Aishwarya
describes the application process as a valuable learning experience.
"Now my entire class and even the whole school knows about the RTI
Act, 2005, and is aware that the Act can force people in government to
do their work," says Aishwarya.

Prior to filing, Aishwarya wrote to chief minister Mayawati's office
last October, with a plea for removal of the germs infested heap. When
she didn't receive a reply, her mother egged her on to file her now
celebrated application under the RTI Act, dipping into her own piggy
bank to pay the Rs.10 fee that is mandatory under provisions of this
historic legislation. In her handwritten application, Aishwarya asked
two questions of the chief minister's public information officer:
whether it was legally permissible to locate a garbage disposal site
near a school, and who would be held responsible if it became a source
of infection for children in her school.

In February this year, Aishwarya received a response from the Lucknow
Nagar Nigam (municipal corporation), informing her that the city's
health officer and mayor had directed that the site and stench be
cleared. "Although the letter from LNN doesn't answer my questions, my
entire school is delighted that the rubbish dump is gone. Instead
there is a public library with books, newspapers and magazines," says
Aishwarya whose initiative has attracted a steady stream of
photographers and media persons to her home and school in the city's
suburban Rajajipuram area.

भ्रष्टाचार व कुप्रशासन के मामलों में नौकरशाह बेपरवाह

लखनऊ। कुप्रशासन, भ्रष्टाचार, शोषण व अन्याय को नियंत्रित करने के
उद्देश्य से लाया गया सूचना का कानून यूपी में धराशायी हो चुका है। कानून
का पालन कम दुरुपयोग ज्यादा हो रहा है। आकंठ भ्रष्टाचार में डूबी
नौकरशाही ही नहीं चाहती है कि सूचना के अधिकार का इस्तेमाल उसके विरुद्ध
हो। इसलिए ज्यादातर भ्रष्टाचार और कुप्रशासन के मामलों में मांगी गई
सूचनाएं वादी को नहीं मिल पा रही हैं जिसकी वजह से ही 32 हजार से भी
ज्यादा वाद राज्य सूचना आयोग में लम्बित पड़े हैं।

यूपी में 14 सितंबर 2005 को उत्तर प्रदेश राज्य सूचना आयोग के गठन की
अधिसूचना जारी करने के साथ ही आरटीआई की प्रक्रिया शुरू हो गई थी। 20 जून
2006 से आयोग ने कानून का संचालन भी प्रारम्भ कर दिया था। तत्कालीन मुख्य
सूचना आयुक्त न्यायमूर्ति एमए खान और राज्य सूचना आयुक्त ज्ञानेन्द्र
शर्मा ने शुरुआती दौर में कानून को आगे बढ़ाने की दिशा में पुरजोर पहल भी
की थी। वादी के प्रार्थना पत्रों पर सूचनाएं भी मिलनी शुरू हो गई थीं। उस
दौरान कई भ्रष्ट और नाकारा अफसरों की पोल भी खुली। यह सूचना के कानून का
ही प्रभाव था कि अंबेडकर उान निर्माण से सम्बंधित सारी सूचनाएं सरकार के
न चाहते हुए भी मुहैया करानी पड़ी। इसी मामले में आयोग ने कानून के
प्रभाव का इस्तेमाल करते हुए कैबिनेट सचिव शशांक शेखर और तत्कालीन मुख्य
सचिव पीके मिश्रा को तलब भी किया था। आयोग की सक्रियता का ही परिणाम था
कि वर्ष 2006-07 में 9633 वाद दायर हुए और तत्परता के साथ उसी वर्ष 5716
मामलों का निस्तारण कर सूचनाएं उपलब्ध कराई गईं। मगर जैसे-जैसे यह कानून
तेजी के साथ लोकप्रिय होता गया वैसे-वैसे ही शासन व प्रशासन में बैठे
अफसर आरटीआई को लेकर नाक और भौह सिकोड़ने लगे।

दरसल 50 से भी अधिक वर्षो से सरकारी विभागों की कार्यसंस्कृति में आरटीआई
ने हस्तक्षेप करना शुरू कर दिया था। सरकारी योजनाओं में पूछे जाने वाले
सवाल अफसरों को सालने लगे। चूंकि आयोग उस दौरान वादी को सूचना दिलाने के
लिए अफसरों की लगाम कसने लगा था इसलिए एक तरफ सरकारी मशीनरी कानून से
पल्ला झाड़ने की कोशिश में लगी हुई थी तो दूसरी तरफ सूचना मांगने वालों
की तादात एकदम से दोगुने से भी ज्यादा हो गई। कानून की शुरुआती पहल का ही
परिणाम था कि पहले वर्ष आए 9633 मामलों के विपरीत वर्ष 2007-08 में राज्य
सूचना आयोग में 25238 नए वाद दायर किए गए। यह संख्या 2008-09 में 32475
हो गई। 09-10 में 56671 तक जा पहुंची। जनसूचना अधिकारियों, विभागों में
नियुक्त प्रथम अपीलीय अधिकारियों की हीलाहवाली का परिणाम यह रहा कि 09-10
में लम्बित वादों की संख्या 32811 तक जा पहुंची।

चूंकि कानून नया था और उसके सामने मुश्किलों की फेहरिस्त लम्बी थी इसलिए
सूचना के अधिकार अधिनियम के सामने कई ऐसे मौके भी आए कि सरकार से लड़ाई
लड़नी पड़ी। प्रदेश में भ्रष्टाचार के मकड़जाल में उलझी नौकरशाही बार-बार
आरटीआई के रास्ते में अवरोध बन कर खड़ी हो जा रही थी। यह सिलसिला आज भी
जारी है। भ्रष्टाचार व कुप्रशासन से जुड़े विभाग हर तरफ रोड़ा अटकाने में
जुटे हैं। आश्चर्यचकित कर देने वाली बात यह है कि खुद मुख्य सचिव अतुल
गुप्ता ने अपने दफ्तर को लोकप्राधिकारी कार्यालय मानने से इंकार कर दिया
था। ज्यादातर अधिकारियों को कानून के बारे में न तो जानकारी है और न ही
वे अधिनियम को जानने में कोई दिलचस्पी ले रहे हैं। लिहाजा वादी द्वारा
मांगी गई सूचनाओं को या तो टाल देते हैं या फिर भ्रामक सूचनाएं देकर अपना
पल्ला झाड़ लेते हैं।

नियुक्त नहीं हुए जनसूचना अधिकारी

प्रदेश में कानून को लागू करने व उसका उद्देश्य सार्थक बनाने में सबसे
बड़ी भूमिका जनसूचना अधिकारियों की है। कानून को लागू होने के दो वर्ष तक
अधिसंख्य सरकारी विभागों में जनसूचना अधिकारी और प्रथम अपीलीय अधिकारी तक
नामित नहीं हो पाए थे और आज भी स्थिति यह है कि कई एक विभागों में
जनसूचना अधिकारी की नियुक्ति नहीं हो पाई है। यहां तक कि कानून को
क्रियान्वित करने के जिम्मेदार मुख्य सचिव जैसे लोकप्राधिकारी के दफ्तर
में ही जनसूचना अधिकारी नामित नहीं किया गया था। आयोग के पहल के बाद ही
मुख्य सचिव अतुल गुप्ता ने बाकायदा आदेश जारी कर जनसूचना अधिकारी नियुक्त
करने तथा कानून से अनिभिज्ञ अपीलीय अधिकारियों को अधिनियम की पुस्तिका का
अध्ययन के लिए 14 जुलाई 2008 को शासनादेश जारी किया।

पैरवी करने से कतराते रहे अफसर

18 जनवरी 2010 को सरकार को होश आया कि राज्य सूचना आयोग में विचाराधीन
मामलों की संख्या बढ़ रही है। विचाराधीन मामलों के लिए जिम्मेदार सरकार व
नौकरशाह जानबूझकर न तो वादी के आवेदन पर गंभीर दिखे और न ही आयोग में
लंबित वादों की पैरवी में उपस्थित हुए। राज्य सूचना आयोग ने जब इसमें
सख्त रुख अपनाया तो शासन की सचिव अनीता सिंह ने सभी विभागों के प्रमुख
सचिवों, सचिवों तथा विभागाध्यक्षों को पत्र लिख कर पैरवी करने के
शासनादेश जारी किया।

कनिष्ठ अफसरों पर रही जिम्मेदारी

बड़े अधिकारियों को कानून से इतनी चिढ़ हो गई थी कि वे आयोग में लगे
पैरवी के लिए जनसूचना अधिकारी व प्रथम अपीलीय अधिकारी को न भेज कर सबसे
कनिष्ठ अधिकारी को पैरवी के लिए भेजते रहे।

The atrocities on RTI activists and RTI users are increasing
exponentially with each passing day , Many of them resulting in their
murders . Each murder is Death of honesty , death of transparency and
death blow to the RTI act .

Pendency in info-commissions is providing a good shelter to the
corrupts and long pendencies with non-compliance of penal clause of
rti act ( in letter n spirit ) by almost all info-commissioners is
the real cause of all these murders because once one files rti to
expose corruption , he buys enmity with the corrupts. If the case is
drawn very long , the corrupt gets the time to mastermind the evil
plans resulting in murders.

Simple exchanges of e-mails is no solution to this problem so I
request all rti activists across the globe to call a meeting at any
place and chalk out a concrete plan to safeguard the interests of rti
activists / rti users. May be we should plan a dharna in delhi on
international right to know day , 28th September 2010 and a meeting
with PM & Sonia Gandhi focused on this issue only.

Another Right to Information (RTI) activist has been murdered in
Maharashtra. Datta Patil, an activist from Ichalkaranji in the
Kolhapur district, was found dead on May 22. This is the latest among
the increasing number of attacks against activists in Maharashtra.
Less than 6 months ago, RTI activist Satish Shetty, had been killed in
Talegaon near Pune.

Patil who was well known in his hometown Ichalkaranji in the Kolhapur
district for taking on administrators via the RTI act was attacked
with a sword.

Friend and activist Appa Patil said, "He was involved in a lot of
social causes. He exposed corruption amongst several politicians and
bureaucrats."

Patil had made several enemies due to his activism.

Patil had petitioned the local court against horse trading during
municipal council elections. He had also demanded an inquiry into the
assets of 2 former police inspectors. He had lodged several complaints
against construction by a prominent builder.

Assistant Police Inspector, Ichalkaranji, Anil Vibhute said, "We are
yet to make some arrests in this case... once we do that we can zero
in on who the main perpetrator is."

Six persons have now been arrested for Patil's murder but many insist
they are not the main perpetrators.

Though RTI act shall turn 5 in a few months from now , In Uttar
Pradesh the Government Machinery is taking this act too casually to
understand .

In this regard I am reproducing below the thoughts of one of the
fellow-activists chamaraj bangi ji
"Babu log are not taking RTI lightly and casually. They have taken it
as an enemy. They curse RTI Act. They are seriously trying to subvert
it. They never give straight replies. They have perfected the craft of
circumventing it. They are busy devising subtle ways to avoid it at
the same time, without inviting any of the penal provisions of RTI
Act. They are now masters in discouraging activists and frustrating
all efforts to make them accountable and answerable. Political class
is blessing the bureaucracy and the babu-dom.

In this country if one gives up scruples and says good-bye to values,
every thing comes his way without any effort. Otherwise, we have to
fight for every small matter. But how long this struggle ? There
should be light at the end of the tunnel. But we are groping in the
dark tunnel without any sign of any end or glimmer of hope, leave
alone light. There are several countries who started development much
later than India. But sadly, today we are lagging. "

The frustration of bangi ji is frustration of every rti-user in the
country. certainly there r good people n bad people both . the day
there are
all bad people the system shall collapse so shall it if there r all
good people. The system is working until n unless there is a balance .
I think so just to console myself , keep myself cool so that I should
keep on working because if I think otherwise , disheartened I shall
put my head against the wall. Fortunately or unfortunately I am in
uttar pradesh where the PIO/AA/Info-commissioner nexus has made
getting the info an uphill task . Perhaps our babus have learnt the
act very well. They know that information empowers citizens , then Why
empower the citizen ? so they are playing all dirty games in there
effort to escape discharge of info to the citizens. They Know that
transparency and accountability shall contain Corruption , so why do
anything to kill their holy-cow , the corruption that is making money
for them like anything. India may be lagging but it is not because of
active bad powers but
because of inaction of the good ones .How many active rti-activists
are there ? The act's intentions are that each n every citizen of
India should be an rti-activist because unless n until they know their
rights , they can not exercise them . So RTI act is the mother of all
past n future acts. If this happens , we shall have the real "Swaraj"
in INDIA. Right now it is a distant dream we all r fighting for .

Now from dreamland to reality-ground of RTI in U. P. Here babus are
leaving no stone unturned to strangle the act and generally whatever
order is passed by the PIO is being dittoed by the AA and the
info-commissioners irrespective of info-seekers valid objections .

In one Case Mr. Vijay Kumar Singh , Anusachiv /PIO of Home ( Police )
section – 15 of Uttar Pradesh Government who vide letter no. 04
rajyapal/6-pu.-15-2010 Lucknow dated 20 may 2010 , has directed the
info seeker to file appeal in the Central Information Commission
against the order of the Uttar Pradesh State Information Commission
though there is no such rule in rti act till date. The copy of the

has not given any info . neither the name of the official responsible
for the lost letter is given nor the record of last 3 years' lost
letters are given.

of Babus of Uttar Pradesh towards the RTI Act and its compliance .
When this is the case of Secretariats , one can easily understand the

SUCHNA KENDRA , a R.T.I. Clinic as a one stop centre to help RTI users
.
The Jan Suchna Kendra shall be centrally located at Hazratganj in
Lucknow at a walking distance from the U.P.S.I.C. and shall be
inaugurated in the month of June 2010. It shall have a rti-library
apart from all other basic requirements of an office. Soon it shall
have its sub-centers first in all commissionaires and then in all
district headquarters. These centers shall be run by rti-volunteers on
self-finance basis. All are welcome to join our campaign against

Respected Police Authority,

This is to inform you that I am a social activist wand have been using
RTI Act for social welfare & elimination of corruption from higher
education, along with other areas of social justice and working for
nation integration as a responsible citizen of our pride nation &
secretary of PROJECT VIJAY . I had to reach railway station for
Varanasi by Train No. 0458 Train Name ANVR BSB SF SPL, PNR no.
230-6614506, which was scheduled to depart from Lucknow JN 02:00 AM
today (25th May 2010) to Varanasi, but i met with an accident last
night (Time 00:45 AM & Place- Lohia Fourway, near Ram Manohar Lohiya
Park Gomti Nagar Lucknow Uttar Pradesh). The accident which looked
intentionally planned, occurred
with a new white car with dark black window glasses (don't know the
brand name) which hit my bike deliberately due to which one of my legs
got fractured and I could not reach to Lucknow Railway Station.
Moreover, it returned at the same spot after a little while to inspect
the amount of damage done and speeded away.

Its my kind request to the authorities to be more vigilant so that
activists like me would not have to go through such incidents.

unified approach is the need of the hour to ensure selections as per
the letter n spirit of the rti act when mr. gyanendra sharma , mr.

लखनऊ। उत्तर प्रदेश प्राविधिक विश्वविालय द्वारा संचालित कराई जाने वाली
राज्य प्रवेश परीक्षा से मिलने वाले करोड़ों रुपयों की लूट मची है।
अनुसचिव और विश्वविालय के कुलपति से लेकर प्रमुख सचिव तक परीक्षा आयोजित
कराने के नाम पर लाखों रुपए मानदेय व पारिश्रमिक बटोरने में जुटे हैं।
राज्य प्रवेश परीक्षा का आयोजन भले ही सफलता पूवर्क सम्पन्न न हो पा रहा
हो मगर प्रमुख सचिव स्तर तक के अफसर अपना मानदेय वसूलने में जरा सा भी
संकोच नहीं करते हैं। तकरीबन एक लाख रुपए प्रतिमाह वेतन पाने वाले प्रमुख
सचिव आलोक रंजन को पैसों की इतनी कमी हो गई कि उन्होंने भी बहती गंगा में
आखिरकार डुबकी लगा ही ली। प्रमुख सचिव साहब ने भी यूपीटीयू की परीक्षा
सफल कराने के लिए एक लाख 25 हजार रुपए ऐंठ लिए। यूपीटीयू की राज्य प्रवेश
परीक्षा कराने के नाम पर धन ऐंठने वाले अफसरों का खुलासा सूचना के कानून
के तहत मांगी गई जानकारी से हुआ है। विश्वविालय के कुलसचिव यूएस तोमर ने
सूचना आयोग को लिखित रूप से बताया है कि वर्ष 2008 में राज्य प्रवेश
परीक्षा सम्पन्न कराने के नाम पर विश्वविालय के कुलपति प्रो. प्रेमव्रत
को एक लाख 50 हजार रुपए मानदेय तथा 40 हजार रुपए पारिश्रमिक, प्रमुख सचिव
आलोक रंजन को एक लाख 25 हजार रुपए, विशेष सचिव आरएन सिंह को 50 हजार
रुपए, कुलसचिव यूएस तोमर को एक लाख 25 हजार रुपए मानदेय व 50 हजार रुपए
पारिश्रमिक, विवि के वित्त अधिकारी राजवर्धन को 50 हजार रुपए मानदेय व 25
हजार रुपए पारिश्रमिक, विवि के परीक्षा नियंत्रक प्रो. वीके सिंह को 50
हजार रुपए मानदेय व 30 हजार रुपए पारिश्रमिक, संयुक्त परीक्षा नियंत्रक
डॉ. जेपी पांडेय को 40 हजार रुपए मानदेय व 20 हजार रुपए पारिश्रमिक,
वित्त व लेखाधिकारी गोपाल खरे को 30 हजार रुपए मानदेय व 16250 रुपए
पारिश्रमिक तथा अनुसचिव अनिल कुमार वाजपेयी को 20 हजार रुपए मानदेय
प्रवेश परीक्षा से अर्जित आय से दिया गया है।

प्रवेश परीक्षा से प्राप्त हुए करोड़ों रुपयों की बंदरबांट इसी तरह जारी
है। यूपीटीयू के कुलपति कृपाशंकर ने बताया कि परीक्षा सम्पन्न बनाने के
लिए इस प्रकार के मानदेयों और पारिश्रमिक बड़े अफसरों को देने का कोई
सरकारी प्राविधान नहीं है और न ही इस सम्बंध में किसी प्रकार का कोई
शासनादेश जारी हुआ है। विवि के ही पूर्व वित्त व लेखाधिकारी बीएल राठोर

यूपीटीयू के कुलसचिव के विरुद्ध 25 हजार रुपए के जुर्माने का आदेश पारित
किया है। वादी ने आयोग को बताया कि विवि ने पूरी सूचनाएं उपलब्ध नहीं
कराईं हैं। राज्य सूचना आयुक्त ने विवि की लापरवाही को देखते हुए इस
सम्बंध में विभागीय प्रमुख सचिव कार्यालय के जनसूचनाधिकारी को आदेश दिया
है कि वे अगली सुनवाई के दौरान स्वयं उपस्थित होकर बताएं कि इस प्रकरण
में प्राविधिक विश्वविालय की प्रवेश परीक्षा के कार्य के लिए मानदेय व
पारिश्रमिक भुगतान का क्या आधार है? मेजर संजय यादव ने यह भी आदेश दिया
है कि इस सम्बंध में आवश्यक नियमों व शासनादेशों की प्रमाणित छाया
प्रतियां भी प्रस्तुत करें। 24 जून को फिर सुनवाई होगी।प्रमुख सचिव आलोक
रंजन को एक लाख 25 हजार

पूर्व कुलपति प्रेमव्रत को डेढ़ लाख

विशेष सचिव आरएन सिंह को 50 हजार

Ensure free expression and opinion for Maoist supporters, Human Rights
Watch urges

(Human Rights Watch/IFEX) - New York, May 7, 2010 - The Indian
government should not equate peaceful political speech with criminal
acts while conducting its operations against armed Maoist groups,
Human Rights Watch said today.

The Indian government appears to have threatened to curb the right to
freedom of expression by treating it as equivalent to providing
material or physical support for criminal acts by the proscribed
Communist Party of India (Maoist), also known as Naxalites, which the
government has banned.

"The Indian government should think twice before trying to silence
political discussion and demanding endorsement of its views on Maoist
groups," said Brad Adams, Asia director at Human Rights Watch. "The
recent views expressed by the Indian government against so-called
sympathizers could be understood as carte blanche by local authorities
to harass and arrest critics of Indian government policy."

On May 6, 2010, the Home Ministry issued a statement saying that, "It
has come to the notice of the government that some Maoist leaders have
been directly contacting certain NGOs and intellectuals to propagate
their ideology and persuade them to take steps which would provide
support to the CPI (Maoist) ideology." Government officials warned
members of civil society that the Unlawful Activities (Prevention)
Act, 1967, which calls for imprisonment of up to 10 years, could be
used to punish individuals in contact with the Maoists. Home Minister
P. Chidambaram had earlier called upon civil society demanding "voices
of condemnation of those who have, erroneously, extended intellectual
and material support to the CPI (Maoist)."

The Maoists claim to speak for the rights of the marginalized,
including landless peasants, tribal groups, and Dalits. Maoists have
been responsible for serious abuses, including the destruction of
schools and hospitals, extortion, torture, and killings. The Indian
government has acknowledged that the failure of the government to
provide adequate services and development opportunities has led to
disaffection and support for the Maoists in some areas.

The Indian government has carried out armed operations to restore law
and order in areas dominated by the Maoists and to protect the
population. Some state governments combating the Maoists, particularly
in Chhattisgarh, have long subjected human rights defenders and
activists to surveillance, arbitrary travel restrictions, filing of
false cases, arbitrary arrests, and slander campaigns in the press.
Journalists often practice self-censorship to protect themselves from
government harassment. Arbitrary arrests, torture, and extrajudicial
killings by government forces create a risk of fueling anger and
recruiting people to the Maoist cause, Human Rights Watch said.

The population in affected areas is often caught between the Maoist
combatants and government security forces. The Maoists frequently
demand food or shelter at gunpoint and engage in forcible recruitment.
Government forces often arrest and abuse those same villagers,
claiming that they are Maoist supporters.

"The Indian government is well aware that security operations often
result in increased rights abuses," Adams said. "An active and
fearless civil society that monitors abuses by both sides is crucial
to ensure the protection of civilians. Threats to civil society have
no place in a democracy."

(ARTICLE 19/IFEX) - 29 April 2010 - In Mexico, the Right to
Information (RTI) is entrenched in the Constitution and there is a
Federal Transparency Law which gives effect to this right. However,
because Mexico is a federal republic, each one of its 32 local state
congresses must approve their own RTI legislation.

The ARTICLE 19 and FUNDAR Index measures the Federal Transparency Law
and 32 local RTI laws against the country's Constitutional mandate and
national legislative development, also establishing a baseline setting
out the minimum criteria to protect RTI.

The Index also evaluates RTI legislation against international
standards and best international practices. It sets international
human rights law and standards for freedom of information as an ideal
benchmark to protect and enhance Access to Information.

"It is absolutely crucial that there is sound legal recognition of the
right to access information, although this is just one of many
challenges in fully realising this right. At the same time, the
exercise of the right to information is one of the best ways to ensure
active participation in the democratic process," comments Darío
Ramírez, Director for ARTICLE 19's Mexico office. "Therefore, this
Access to Information Index for Mexico provides a methodology that we
expect will potentially become a tool that could be used across the
world to enhance access to information."

For its construction, a list of the elements which make up the
normative provisions of each of the transparency and access to
information laws in the country was drawn up. The Index includes a
chart for processing this information which is grouped in several
categories. Therefore, it is an instrument of measurement which allows
comparisons to be made among pieces of legislation, and which
demonstrates, among other things, the level of protection of the right
of access to information nationwide; the degree of individual
development of each piece of legislation and its internal coherence,
its trends and omissions, and which informs about legislative
performance in areas such as the construction of institutional
guarantees, the regulation of procedures or the incorporation of
criteria to regulate the administration of access to public
information.

Measured against the constitutional mandate, 19 of the 32 local
legislations that were analysed failed on the Mexico's Access to
Information Index. The state with the lowest rating is the state of
Guerrero. This is also the state with the lowest human development in
the country and the highest levels of poverty. The lack of guarantees
for the exercise of the Right to Information is a condition that
inhibits the possibility of overcoming these precarious situations.

The Index shows that, even though the Mexican Federal Transparency Law
undoubtedly contributed to the definition of legal guarantees for the
Right to Information in Mexico, it needs to be reformed in order to
efficiently protect and enhance this right. For example, the federal
law fails to incorporate political parties and unions as public
authorities that must comply with the Transparency Law, therefore
inhibiting public scrutiny of national economic resources; it also has
serious deficiencies in the stipulated criteria for classifying
information, which might impede access to public interest information;
also it lacks transparent criteria for the appointment of Information
Commissioners, which eventually might compromise its decision making
independence.

The results also showed that local RTI laws in Mexico are weak,
especially in defining procedures to proactively disclose public
information and establishing sanctions for public officials who
undermine or contravene transparency processes. There are also few
systems in place to effectively appoint transparency commissioners who
would oversee compliance with the access to information laws.

The ARTICLE 19/FUNDAR Index sets out legal benchmarks for the
promotion of progressive legislation that will more effectively
guarantee the realisation of the Right to Information.

Dear Friends,

I attach herewith my latest write-up in matters concerning RTI to
propose that the State Government and Governor should frame Rules under
Sections 27 and 28 of RTI Act to set up a mechanism for appointment of Chief
Information Commissioner and Information Commissioners, and to monitor the
working of the Information Commission. I request you to study the paper
deeply and give your suggestions for what the Rules should contain. The idea
is that on the basis of well thought out and practical concepts, a draft of
Rules may be prepared and be forwarded with a Memorandum to State Government
and Governor to adopt so that the Act becomes really effective.

We can send the draft also to President of India and Prime
Minister in the context of Section 12 of the Act.

if ur name is janadhikar bharat or its an institution ?

It is not too much on Aishwarya. what she has done is really a
heculian task. if u want to ask the thousands of people living nearby
the garbage house ( now library ) , go there n assk n u shall know
what she has done . go there between 5pm to 9 pm n see tens of people
reading books n periodicals of the library.

cms is no ordinary school n mr. jagdish gandhi is no ordinary man .
ask him of the contribution of aishwarya n u shall come to know what
she has done.

. you sould not pay heed to this issue of Aishwarya's RTI episode ,
and that's entirely your outlook n i respect ur point of view.

if u have so much hatred n jealosy against children , do ask
moderators n if u r the moderator , pls. get my mail id banned. but
then how come u say yourself to be a social worker when u cannot
accomodate success of the children i.e. future india.

encouraged by aishwarya many children are going for rti . so if this
will cause some harm to the nation ?

KG Balakrishanan' s judgment on "pre marital living - Live in
relationship quoting Lord Krishna? because i am not so witty .
perhaps u r more witty than HE balakrishnan ji then who is stopping u
, just go ahead and comment these forums are there for such
discussions and moderators ate there to judge the contents.

so far as aishwarya's issue is concerned , it shall bring a paradigm
shift in the arena of RTI.

as far as act is concerned , itis there to help fecilitate even the
illiterate ones to get the info what to say of a class III student who
can write his/her application on her own. also don't forget motto
behind RTE.

sec 3 of act states " subject to the provisions of this act , all
citizens shall have the right to information "

sir , so i want to know if aishwarya is a citizen of INDIA or not ? if
there is any age bar to become citizen of INDIA.

section 6 of rti act further says "

obtain any information under this Act, shall make a request in writing
or through electronic means in English or Hindi or in the official
language of the area in which the application is being made,
accompanying such fee as may be prescribed, to-

Officer, as the case may be, of the concerned public authority;
(b) the Central Assistant Public Information Officer or State Assistant Public

as persec 6 (1) , i want to know if aishwarya is a person or not ? if
even an illiterate person cannot file rti in his own name by telling
it orally to the PIO who shall write it in his name where he shall put
his thumb impression?

as per sec 6 (2) , i want to know if there is any age bar to go for rti ?

as per the act if a minor is a citizen and a person or not ?

if Yes why can't he make an RTI Application on her/his own ?

Where Does the need arisefor a directly actingGuardian ?

sir , i do agree that if there are some legal tecnicalities , those
should be taken care of keeping in mind Implications ( if any ) of
Such an Acceptance on RTI . then again don't u think these are we who
are killing the spirit of rti.
